Ten Amendments To The Bill Of Rights

The bill of rights is a popular document that was not originally in the US constitution, but anti federalists wanted a bill of rights really bad because supposedly they were afraid of a strong central government. They did not want another king so some states refused the constitution until there was a bill of rights. Along with being afraid of a central government they wanted a limited government so that government could not control them. The anti federalists also thought the government would not protect their individual rights enough so they wanted a bill of rights.

The Bill of Rights contains 10 amendments that were designed to protect the people and prevent an over powerful government. There are 3 amendments that are absolutely needed in order for the government to protect the people. That being said the 3 amendments that the people absolutely need are the 1st, 10th, and 2nd amendments. We need the 1st amendment because without freedom of speech, press, assembly, religion, and petition, there is no personal liberty, and without it, we wouldn’t be allowed to disagree with the government. The 10th amendment prohibits the government from becoming too large and taking over the states, and that’s important because without that, the government could easily take over the United States, and not be punished.

Due to the British oppression, every American, including our founding founders, wanted greater protection of their rights. To accomplish this, James Madison drafted the Bill of Rights and by the end of 1791, every state had ratified the first ten amendments. The First Amendment is primary, not just because it is at the beginning, but because it articulates the First Freedom and the nature of that freedom. It states that “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.” By connecting the freedom of religion with the freedoms of speech and press, the First Amendment showed the people of America what it is to be a human (Bill of Rights).

The Second Amendment of the United States Constitution is the amendment of the United States Bill of Rights that protects the right to keep and bear arms. The amendment clearly states that a well-regulated Militia, being necessary to the security of a Free State, the right of the people to keep and bear Arms, shall not be infringed. This means that citizens of the United States shall be able to carry firearms within reason to do so, when pertaining to safety. The Second Amendment has been disputed over the years and has become very controversial for many reasons. On one hand, it is considered to be one of the most important amendments in the Constitution because it presents the citizens of the United States with a means to protect themselves. On the other hand, some feel that over the years, certain citizens have over stepped their second amendment rights and as a result, there have been a number of national tragedies with numerous casualties.

America’s gift to my generation is our rights. One right in particular is the second amendment of the constitution “The Right To Bear Arms”. The second amendment of the bill of rights guarantees the right to own firearms and use them. The second amendment was approved 8 years after the revolutionary war.The second amendment was created December 15 1791. The ten amendments were created so they wouldn’t be put in a situation where they were controlled by a tyrannical government again, and to set the foundation for our newly founded government. The ten amendments were written in independence hall in Philadelphia. The second amendment isn’t just referring to the use of a weapon as a means of hunting but to protect you or many persons if needed.

Imagine you're sleeping at night and then suddenly, you wake up. You walk in into your kitchen and grab a glass of water and hear a noise, you realize there is someone in your house. What's your first action, what are you going to do? Our second amendment protects us in this situation. To summarize the amendments were made to protect the people’s rights and were added to the constitution in 1791. James Madison helped write the first draft, but it was Thomas Jefferson’s idea to have a Bill of Rights. Many more people agreed to have the Constitution when the Bill of Rights was added. There are still more amendments being added to the Constitution from this day, but the ten first amendments will always be the basic rights of the people and be known as the Bill of Rights.They will always be applied to our form of government.

The tenth amendment of the Bill of Rights is about how the powers that are not given to the United States government in the Constitution are given either to the States or to the people. This means that the States or the people get the power that is not given to the government by the Constitution. For example, the right to abortion and marriage. Also the safety like CIA, federal marshals, driver's license and health for the people. Before many states did not allow gay/lesbian marriages now every state does. It was each state's decision to decide if they will allow gay/lesbian marriages. My argument for this amendment is that the government does not control everything so there is no tyranny and the states actually get to decide on something.

In my personal opinion, I would not change any of the first ten amendments to the Constitution. First, the Constitution is not a simple document that can be changed overnight; it will take a long time because of the diverse positions and opinions about it. An important provision of the Bill of Rights is the protection of freedom to publish, as provided by the First Amendment. This protection applies to all kinds of publications, even those that print unpopular opinions. In most censorship cases, every attempt is made to suppress the written word after publication, not before. Minnesota passed a law in 1925 that sought to prevent newspapers, magazines, and other publications from printing obscene, malicious, scandalous and defamatory material. This law was called the Minnesota Gag Law . This law allowed private citizens and/or public prosecutors to request a court injunction to shut down any publication that was known as a public nuisance. Publishers of newspapers had to show that they had good motives for anything they were going to print before they printed it.

Due to the current society’s rise in violence, advocates of gun ownership argue that the Second Amendment allows citizens to “bear arms” and their right to owning them should not be taken away because it is attacking their freedom. On the other hand, opponents of gun ownership claim that militias are the only ones who need to be equipped with firearms. This perpetual dispute is the reason why the writers of the Second Amendment should have phrased the amendment in a clearer and coherent way. Till this day, the issue that remains unsolved is figuring out what the amendment is intended for and who is entitled under it. The language of the Second Amendment creates many discrepancies in the way people interpret it and as time is progressing, the Second Amendment is being used as a means for self-defense and due to that the utilization of guns is being regulated, not infringed.
