Every driver on the road is expected to demonstrate a certain level of responsibility. This is critical if we want to make sure drivers are safe on our roads. However, accidents do happen and often, they are the result of the driver's negligence. Negligence is defined as the inability to demonstrate responsible behavior. Drivers are required to have a duty of reasonable care which means that they have to ensure they avoid actions that could possibly harm another party. If they fail to do so, they are said to be negligent. Whenever a driver drives a vehicle knowing that he is under the influence of drugs and/or alcohol, he is being negligent. If he gets into an accident while being in this state, he is liable for any damages that result from his negligence. According to statistics from the Ohio State Highway Patrol (OSHP), 305,964 traffic crashes occurred in Ohio in 2016. These crashes resulted in 1,133 fatalities and 112,000 injuries. Out of the total crashes, 12,243 were alcohol-related. 313 of these crashes were fatal and led to 346 deaths and 7,199 injuries. 30.5% of the deaths in 2016 were the result of alcohol-related crashes. This is a huge number and a significant area of concern as far as Ohio is concerned. The fact of the matter is that being hit by a drunk driver can be one of the most frustrating experiences for any individual. This is especially true if the accident results in serious injuries that end up changing your life completely. Things can get even more
Drinking and driving is said to be the primary contributor to automotive related deaths. “By law, a driver is considered to be impaired by alcohol if his or her blood alcohol content is 0.08 percent or higher” (Holzmueller). As a matter of fact, “in 2010, about 86 percent of all fatalities alcohol-involved crashes were in cases where a driver or pedestrian had a BAC of .08 or higher” (“The Economic and Societal Impact of Motor Vehicle Crashes, 2010” 147). Laws and penalties have been created and applied in recent years that make it more difficult to get away with drinking and driving. If drivers are charged with alcohol-impaired driving, “they face suspension or revocation of their license” (Holzmueller).

According to the statistics of Ohio Safety and highway patrol, in a year, many cases of alcohol related crashes are common in the state. For example, in 2007 alone, a total of over 15.000 alcohol related accidents were reported .In these reported accidents, over 450 people were reported dead and more than 8,500 sustained injuries. In this regard, strict application of this law helps reduce the high number of alcohol linked accidents and as well as reducing the death toll on alcohol related accidents.
