The judge’s sentence for Hurst was ruled unconstitutional because it violated the sixth amendment, which includes the right to an impartial jury, and a recommendation from a jury is not enough for a ruling to be made. This case is now being send to Florida’s Supreme Court for further proceedings. This could impact actions towards other inmates
