I am pro bono counsel to Clean-Cut Lawn Care, LLC. It has been alleged in your claim that Clean-Cut Lawn Care, LLC used “copyrighted material” in the form of an image on their social media (Facebook page). In response, please be advised that Clean Cut Lawn Care, LLC is a limited liability company. This shall serve as a reply to your “Masterfile Corporation’s Copyright Infringement Claim” dated June 22, 2016 regarding my client’s use of “the photograph.” The facts and circumstances surrounding the alleged use would lead one to conclude that it was unintentional and accidental. There is no evidence as to where my client allegedly obtained a copy of “the photograph.”
In the novel Bless Me, Ultima by Rudolfo Anaya, one of the main characters, Ultima is accused many times of being a witch. Ultima is a curandera who uses herbs and medicines to cure people. She goes to live with Antonio Marez, a young boy who lives in the llano with his parents and two sisters due to the fact that she cannot live by herself and had nowhere to stay. Although many people think she is a witch, her use of herbs, medicines, and scapulars show that she is merely just a curandera. With her use of chants and having her spirit in her owl, many are led to believe that she is really a witch.
The proverb “All roads lead to Rome” refers to the fact that many different routes can lead to the same result. Likewise, the path to one’s destiny depends on the person. For example, Tony’s journey to his destiny in Rudolfo Anaya’s Bless Me, Ultima is different than Paikea’s in Witi Ihimaera’s Whale Rider. Their destinies are different, but their destinies are inevitable events, regardless of the path they take to achieve it. However different their journeys may be, there are always certain elements that are universal among all journeys to destiny.
A curandero is a Mexican-American folk healer that heals physical, mental, and spiritual illnesses. The folk healer uses prayer, faith, and herbal remedies to heal. People associate repeated healing with healthy relationships between people, culture, and the environment. In the poem, “Curandera”, by Pat Mora and the novel, “Bless Me, Ultima”, by Rudolfo Anaya portray the curandera in different and similar ways. The literary works consist of common characteristics and qualities that the curanderos possess irrespective of the different genders. In both poems, the curanderos are knowledgeable. Besides, they have a close connection with nature, and the people from their towns respect them greatly.
There is some controversy over a character in the book Bless Me Ultima, by: Rudolfo Anaya. Ultima is a controversial character because some people think she is a witch or bruja. Other people think that she is a curandera or an herb doctor. She could be a bruja, a curandera, or she could be both. There are some credible events to explain how she is a witch.
The moon, ocean, and wind shape and sculpt the earth. The moon creates the tides, and lights the earth at night. The ocean erodes the earth, making sand where dirt and water meet. The wind molds the landscape of the earth, carrying dust, seed, and storm. These different forces of nature define the earth’s form, creating coasts, rivers, mountains, and deserts. In the novel Bless Me, Ultima by Rudolfo Anaya, María, Gabriel, and Ultima shape Antonio, creating internal conflict, pressure, independence, and strength. The conflicting dreams of Gabriel and Maria, along with a crisis of faith, create Antonio’s internal conflict, which Ultima and Gabriel help resolve.
I definitely agree with you that the society viewed Ultima either in a good way or a bad way. In my opinion, the old townspeople, who knew Ultima for many years really had a loving and compassionate emotion for her, just like Narciso. These people have viewed Ultima as a healer based on their own personal experiences of Ultima healing their loved ones. On the other hand, the culture of the new townspeople were unaware of Ultima’s healing powers that they automatically assumed it was witchcraft.
There are countless people within our society who do not believe in the old, traditional way of doing things. Doctors are very popular in today’s society, but many years ago people relied mainly on healers. Our ancestors relied on healers to help cure them, they would give the sick a remedy and a few days later they were as healthy as a horse. People tend to forget where they come from, but those whose lives were saved because of a healer’s knowledge about nature and plants will forever thank and never forget the person who blessed them with a second chance at life. Ultima, a curandera of the llano, is well-known to be effective with her remedies so everybody turns to her when they become ill. Back then the practice of Curanderismo played

Is a person ever fully content with his or her life? Do humans simply remain in that constant state of hope, wishing that the time later on in their life will be better than today? In the books Of Mice and Men and Bless Me, Ultima, both Antonio’s mother and Candy, have dreams for a better future. For Candy it involves buying his own land to live on with George and Lennie, rather on the other hand for Tony’s mother it involves Tony becoming a priest and following the ways of the Luna’s. Both characters are constantly convincing others to allow for their dreams to come true and are optimistic that one day their dreams will develop. In both books Tony’s mother and Candy strive to turn the present into a better future, they are desperately willing

Topcat’s “My Trip with Tripper violates Woody’s right of publicity and the Lanham Act, because Topcat is using Tripper’s plaintiff’s character and likeness for Topcat’s purely commercial purposes without consent, and he is using Tripper’s trademark in ways that imply Tripper’s endorsement of Topcat’s poster. Oh my Atlanta, after thinking about it the character Florence from “Bless Me, Ultima” and I have quite a few similarities. At a deep and human level Florence and I connect as we both have suffered pain from religion. My boy Florence once said, “My mother died when I was three, my old man drank himself to death, and my sisters are whores, working at Rosie’s place”(194). At times myself I can partially relate with that though I may not have it as bad as Florence, fortunately. I have gone all my life with really no true role model with a father who has abused drugs, and a mom that was always too busy. I understand though as we all have our own faults. Life has been a tough course for me, few people can actually understand how it feels when you
In the novel Bless Me, Ultima, the Márez family came to be through two very different people. María Luna, a soft-spoken, devoutly Catholic woman from a farming family married Gabriel Márez, a rowdy, boisterous, cowboy. As one would imagine, their views are often times conflicting and vastly different. Like Tony’s parents, my parents came from very different backgrounds. My father was raised in the small town of Staples, Minnesota. He was brought up as a member of Church of Christ, and his family was quiet and reserved, never uttering profanities or consuming alcohol. Their weekends were spent at the family dairy farm or on a baseball field. My mother, however, was raised to be a strict Catholic in Stillwater, Minnesota. Her aunts and uncles
Universal expressed concerns over the intensive investigation and subjective results of determining whether a potentially infringing use falls under the general fair use doctrine. On February 25, 2010, Judge Fogel issued a ruling rejecting several of Universal's affirmative defenses, though the court did suggest that at that stage in the proceedings, Lenz's damages seemed minimal. In January 2013, Judge Fogel denied both parties' motions for immediate
