Many heinous juvenile crimes have been made throughout all of America with the past two decades. Such as stealing, drugs, murder, etc. As soon as a juvenile commits a crime, society transforms the child into an adult. If an adult can not be charged as a child in court, then children shouldn’t be charged as adults. A child’s brain is not fully developed like an adult’s brain would be. An adult should already know their wrongs from rights. As for children, they see things totally different. A child should be punished for their actions but shouldn’t be sentenced to life because they aren’t ready. they do not know their full intentions to do something they weren’t thinking straight about. What kid what would want to spend their childhood in prison? …show more content…
Most parents believe their kids gain mischievous habits from violent television shows causing adolescents to mimic what they see into real life not knowing it’s all fiction. Adolescents don’t think of the effect of their actions once they have gone too far like play fighting and it turning into murder. For example, I saw on the news awhile back that chubby 10 year old boy was playing with his 4 year old neighbor and the boy fell on top of the little girl by accident and he killed her because she hit the pavement very hard causing a serious head injury leading to death. In the article “On Punishment and Teen Killers,” by Jennifer Jenkin, she argues that juveniles are exposed to dangerous items and dramatizing events like weapons, violent television shows, and bad habit friends. Children are so gullible when it comes to seeing something on television and try to do it on their own even though they say not to try at home. Jenkin’s says, “The inuit people of Northern Canada had no juvenile crime at all until 1980 and the introduction of the television into their culture.” (Jenkins 91). She explains how television had an impact into children’s habits which was good before their culture was introduced to television. Juveniles should not be tried as adults because if they commit a crime like murder they will be sent to maximum security state prisons which will place them with …show more content…
In the article “Kids Are Kids - Until They Commit Crimes,” by Marjie Lundstorm, she says that kids are kids until they commit a crime like murder which transforms them into adults in the eyes of the judge. Judges trial juveniles as adults because some children feel no remorse of their crime or the crime was too serious. For example if a child goes on a killing rampage throughout town and kills several people then the judge feels he has to trial the child as an adult for his actions. Lundstrom says, “Hey they’re only kids. That is until they foul up. Until they commit crimes. And the bigger the crime, the more eager we are to call them adults.” She explains how people are eager to trial juveniles as adults when they commit huge crimes. Overall juveniles should not be tried as adults because children aren’t capable of thinking of their actions and taking in such serious consequences. Kids are just kids and don’t deserve to grow up in prison full of criminals who do realize what they did. Juveniles can change their habits and morals with rehabilitation. Instead of sending a kid straight to jail for life, he/she should be helped to be a better person in the long run. It can turn their life upside down. Children are the future and we need to help them by leading them through the right path in
One side argues that regardless of the age, crimes are still crimes. Just because a child commits the crime doesn’t mean that the victim didn 't indeed suffer from it. Juveniles should be tried as adults because it will not only make
Juveniles should be tried as adults when they commit serious crimes as opposed to rehabilitation or various forms of lesser sentencing. The rate of juveniles in prison has increased over the years. Many young adults and children often seek for attention which leads them to cause trouble out in the streets. There are risk levels that officers have to make in order to help the juveniles or if committing a serious crime, they should pay the consequences. Many may oppose and think that young adults and children are not adults, but they should be punished for the crimes they have done.
In conclusion I feel that by not trying juveniles as adults it is a better outcome for the child and society. We are also giving the juvenile a second chance at the future that everyone
There are times juveniles should not be convicted as adults because sometimes the “crimes” may not harsh enough to be charged as an adult. For example, if a 8 year old saw a gun in their mother's purse and thought it was a toy and grabbed it and began to shoot who would be at fault ? Plus children in adult prisons are 10 times more likely to be taken advantage of in their time. Research shows that children prosecuted in the adult criminal justice system are more likely to reoffend than those held in the juvenile justice
Many have discussed and argued if Juveniles should be charged as adults. Then there's others that believe that they shouldn't be charged as adults. However, juveniles should be tried as adults because they committed a crime in which they must pay for which they also knew it is wrong. They should be tried should depend on what age they are and what fractions have they encountered like rape, abuse, etc. If a 5 year old were to be playing with another kid and perhaps that 5 year old kills the child they have absolutely no idea of what they have done they are far too young to understand what they are doing or have done. Most of the time you have to take care of children because they are putting items in their mouth that they don’t know what it
Other people argue that Juveniles may not have the mental capacity to know that this is wrong. This is, in fact, wrong in most cases. A child no matter what the age should know that killing or performing other atrocious acts on others is wrong. There are some exceptions such as mental illness and adverse effects from medications. According to https://flowpsychology.com/10-pros-and-cons-of-juveniles-being-tried-as-adults/, “because teenagers have full control over their thoughts and actions. If they do not have the moral compass instilled in them by that time, then they are very likely to commit more crimes.” This implies that, should teenagers not be tried as adults, they may never learn their lesson.Even if they don’t from harsher punishments; at least they will
Society views minors as immature and naïve. Until they reach adulthood, they are incapable of thinking through their decisions. This is certainly what Greg Krikorian believes as he makes his argument in his article, “Many Kids Called Unfit for Adult Trial…”, that minors are incapable of defending themselves during trial. Krikorian states, “The study… found that one-third of the eleven- to – thirteen year olds studied and 20 percent of those fourteen to fifteen years old had levels of reasoning comparable to those of mentally ill adults judged not competent to stand trial.” It is important to remember that these teens are not mentally ill, and it
Many serious crimes are committed daily and some by juveniles under 18. When serious crimes are committed these juveniles get tried as adults and receive adult sentencings. Many people argue that such juveniles should not be tried as adults because they are just kids and are still developing. In my opinion, I agree that juveniles should not be tried as adults, however I also believe they should receive adult sentencings but to a lesser degree, because they are not yet fully developed, they have potential to change, and it is not fair that they are underage but are being tried as adults.
The juvenile justice system exists to separate the youth from the adults that are imprisoned. The separation exists because of the different levels of maturity that are present between the two age groups. These young offenders are not arrested for the reason of punishment; they are arrested to be rehabilitated so they do not become habitual offenders later on in life. It gives them the opportunity to see what life will be like for them if they are to be adult offenders. With that being said, there are some instances where these young adults are to be tried as an adult offender with an adult punishment. Throughout most of history, young offenders were tried by the same courts as those that tried adults and were subject to the same sanction which does include execution and incarceration. (Masters, p 450, 2013) There are some places that truly believe that young criminals shouldn’t be treated like adults, such as in England. There is a law in affect called the “infancy defense” which says that children under the age of 7 are not to be tried as adults because they haven’t yet formed criminal intent. A child that was between the ages of 7 and 14 could be prosecuted but only if the prosecutor could prove that the child knew what they were doing was wrong. (Lectric Law Library, 2003) Lawmakers and social scientists found that those who were found guilty
The juvenile justice system is very similar to that of an adult justice system. Young criminals go through the same process an adult criminal would go through, including: arrest, detainment, petitions, hearings, probation and reentry. Many states have different standards as to when a person is considered to be an adult, bringing lots of controversy. As fourteen states do not even have a minimum age a child could be tried as an adult. Why is it that children are not capable of understanding life until the age of eighteen and cannot make decisions for themselves, but once a crime is committed the child surely knew what they were doing and could be tried as an adult? If under the age of sixteen children should not be tried as adults, as many times children do not understand the consequences of their actions.
Juveniles should not be tried as adults because it is proven that children are incapable of making a rational, mature decision on their own. Adolescents have a shorter experience in the world, their brains are still developing, they do not have the same responsibilities or rights as adults and they are easily influenced at this age. Let 's say a child around the age of twelve is playing with two other friends at his house. His mother and father both work constantly so these children are alone. They are snooping around in his dad 's room and find a gun. Not being old enough to understand or realize it 's not a good idea they begin to play with it. One of the children pulls the trigger not considering what could happen. He accidentally shoots on of the other children and he was instantly killed. They decide to call 911 and before they arrive the child that accidentally shot the other tells his friend to tell them that it was his fault because hed get in trouble by his mom. The boy agrees and tells the police it was his fault and he is sent to adult prison for the maximum sentence. Children are both easily influenced and not as intelligent compared to an adult. These children are so immature and underdeveloped they should not and cannot make rational decisions on their own.
Juveniles committing crimes is not a new issued being introduced to society; actually, it has been an issue for centuries. However, the big question is, should juveniles be tried in adult courts? Before answering, take into consideration every possible scenario that could have led them to commit the crime. For instance, were they the leader in the act? Did they participate in the crime? Was the juvenile even aware of what was taking place? Were they peer pressured? Did they have any other choice at the time? There are so many other questions we could consider when making a decision here.
Imagine sitting in a courtroom, hoping the the judge will not give a harsh sentence. Unfortunately, that’s the case for many juveniles, some as young as 13! A juvenile is subject to a more severe sentence with the limited sentencing available. It is estimated that 250,000 youth are prosecuted as adults, each year. This number should change, as juveniles are not adults, both mentally and physically. Juveniles need an environment surrounded with guiding adults, education and the resources to help them. A juvenile is not an adult, and should not be tried as one.
In my own opinion, I consider juveniles as immature because they lack the ability to recognize the long term impact of their actions as they have decreased levels of responsibility. Therefore, the justice system should not charge juveniles in adult legal system and sentence them as adults.Trying juveniles as adults exposes the young offenders to state penitentiaries up to life in prison without parole and even sentenced to death. This raises a question on how truly effective treating juveniles as adults are to the young offenders. As the crimes committed by juveniles increase, there has been an outcry from the public and affected to prosecute juveniles accused of serious crimes as adults. It is true that juveniles do
I do not think it is a good idea to lock juveniles up in prisons with adults. For a child to set down and plan a murder for instance, there would have to be some kind of deep emotional problem. On the other side of this, if the child knows right from wrong and he can sit down and plan a murder, then you could say if he is old enough to kill someone then he is old enough to die. The juvenile criminal is rooted much deeper than right from wrong. It starts back from when they are small children. Most of them are usually outsiders or outcasts. Who can you hold fault for that other than society? If juveniles don't fit in with the popular kids in school they are considered an
