I missed it by 3 months and was unable to file suit against the manufacturer (Day, 2014). Another import issues are the contracts. There are 5 basic elements to a contract: Offer, acceptance, Consideration, Legality and Capacity (Rogers, 2012). Other retailers stated to the owner of Acme Fireworks that they wanted a certain amount of orders filled on a regular bases for an undisclosed time frame and a price was agreed upon, this is the acceptance and offer portion of the contract. The offeror, which in this case are the large retailers, makes an offer which once accepted by Acme Fireworks, creates a binding contract. Acceptance must be in some way agreed by all participants; it may be verbal, symbolical, oral or written. The came from the retailers, they had a want from Acme to manufacture a product for them at a certain cost (Stim, 2010). Consideration is another element of a contract and what consideration brings to the table ask the whys and what’s: Why are we entering the contract and are you receiving? In this case Acme gets more money by being able to produce its products and grow their brand and the other retailers receive fireworks from Acme. However in this instance the owner of Acme may have taken on a task bigger than himself. Among the various types of forensic/criminalist disciplines, this research intends to convey knowledge on one of the many varied specialties of forensic analysis known as arson, fire and explosives. The forensic investigation of arson, fire and explosives is a very collaborated approach. “Arson investigators have two immediate objectives: (1) to determine exactly where, at the scene, the fire began and (2) what caused the fire to ignite. Explosives investigators need to know the same fundamental information as they probe the destruction of buildings, airplanes, and cars” (Harmon, 2008:6). First, each forensic application must be defined to gain a greater understanding of the discipline as a whole. “Arson is the willful and malicious burning of any property for an improper or illegal purpose. By definition, it’s intentional” (J. Ford, 2014:7). In order to produce a fire three ingredients must be present at the same times, which are oxygen, fuel and heat. According to the Haynes (2015:1) “U.S. fire departments responded to an estimated 1,298,000 fires in 2014. Also, “during 2007-2011, an estimated 282,600 intentional fires were reported to U.S. fire departments each year, with associated annual losses of 420 civilian deaths, 1,360 civilian injuries, and $1.3 billion in direct property damage”. In the addition to arson and fire, explosives, have recently became one of the most tragic and alarming events.
In order to determine the best direction for Acme Fireworks going forward, we must look into the contracts to properly choose the path of this company. We must first establish that the contractual agreements already made are legally binding. Once the revision of the contract is complete, Acme Fireworks will need to reassess its staffing needs to make certain that it can fulfill its end of the contract and avoid any breaches. After all this is analyzed, Acme Fireworks will need to review its current business model as a sole proprietor and evaluate what steps it should take to ensure the growth of the company.
As the owner of Acme Fireworks you have asked me, you manager, to review and explain some ideas to you. In the following pages I have explained the potential personal liability for injuries to consumers and what must be on our labels for safety. I would not want to be in too close vicinity to a company that sells the same products, as we would be diluting our customer base. Also, some areas have restrictions on the proximity of companies that sell same or similar products, so it would be important to research those restrictions through the municipality in the area. Every 4th of July, many people go out at night and spend hours watching firework shows. Most of us are content to simply enjoy the pretty colors and sparks, without questioning the chemistry behind the spectacle, but have you ever really thought about how fireworks produce such vibrant colors? The colors emitted when a firework explodes come from an aerial shell inside the firework that contains explosive chemicals and metallic salts. These colors appear to us because of luminescence. Luminescence occurs as a result of the valence electrons in the metal salt atoms moving and changing positions. The explosion of fireworks is not a miracle; it’s simply chemistry at work.
I will start the lesson by showing two images on the interactive whiteboard (one image will be a wildfire and the other one will be a prescribed fire.) I will ask my students to determine which image shows wildfire and which shows prescribed fire. Which one is human-caused or natural. This will serve as a class discussion starter because the students will be asked to justify their choices. By doing this, I can evaluate students’ prior knowledge about the topic. Hence, the purpose of this paper will be to provide advice to Acme Fireworks’ owner as the manager on different issues ranging from common law and UCC requirements of business contracts, the essential elements of a contract, personal potential liability in case of injury, the different types of employment and the most appropriate business structure for the company.

In order to gain consumers and sell their products they must put out ground display’s of their fireworks as well as a variety of aerial fireworks, especially their larger products. This company started out as a small family owned business in the back of a man’s garage and as he grew and drew in more consumers he is now a managing fifteen employees that help him operate his business. The company has been a sole proprietorship and the owner has never changed his entity, meaning no partnerships or shareholders. The owner has received numerous inquiries from surrounding businesses if his company would be able to create more personalized fireworks for them on a more regular basis.
Of the quality strategies and tools considered by smaller entrepreneurial firms, the most used and most useful strategies and tools will include ones that promote flexibility in product, process, and volume in order to facilitate competition with strategies that focus on product and service scope.
