Affirmative Action in the Private and Public Sector Introduction Affirmative Action is constantly seen as an unfair intentional treatment to classes not protected by anti-discrimination laws. This paper will describe the elements of affirmative action and how it applies to employees in the private and public sector. The plan code was created with the intention to help employers manage their responsibilities under the executive order and for them to embrace it as a form to conduct business. Affirmative action plans outline how the employer plans to ensure an anti-discrimination workplace, which can include a number of ways of how to do it. With the changes to the regulations of affirmative action plans in 2000, it made plans more balanced, by allowing plans “contain a diagnostic component to include an analysis that evaluates the composition of the workforce and compare it to the composition of the relevant labor pools.” (Bennett-Alexander, & Hartman, 2007 , Pg 11 para 2). This means that the plans will be developed to include a study of their labor pool and their current workforce to understand and determine if there are underutilization of minorities within their geographic population. In addition the plans are also designed to include internal auditing and reporting systems to measure any progress toward achieving a balance in workforce, as described in their plan of action. Also the plans contain the procedures and actions the employers will take to ensure that qualified applicants and employees receive fair treatment in employment terms. The plans must show quantities and qualitative aspects, meaning the plan must show analysis of the workplace as it is, to identify if the minorities that exist are
There are many supporters and opponents of Affirmative Action. The focus of Affirmative action is meant to be an attempt at equality throughout society. Every sector in America would be equal and unprejudiced. On the other hand, adopting affirmative action would force many employers to replace hard-working employees with those possibly less qualified simply due to their gender or ethnicity. Throughout history, people have been categorized into different groups. These groupings were based on certain characteristics people shared, whether it was their ethnicity, race, gender, or religion. Society is notorious for distinguishing among different groups and favoring one or two of them. Undoubtedly, this separation of peoples, led to increased tension between various groups. As time progressed, the conflicts intensified, and it became apparent that a change was necessary. So I intend to educate the reader on the origin of Affirmative Action; how it impacted the American society; is it still needed in today’s environment; what are some of the drawbacks or issues that came from implementing Affirmative Action, and finally what is the most beneficial aspect from Affirmative Action. In the controversial realms of affirmative action, the largest issue staunchly fought over is whether minorities should be given preferential treatment in the workplace and in the schools. One side declares that those in the minority group need and deserve governmental aid so that they will be on equal footing with the majority group. The purpose of affirmative action is to ensure equal opportunity for minorities. But it has strayed from its original intent and has become largely a program to achieve not equal opportunity but equal results. It is a system of quotas forced upon American businesses and working class by the federal government. A law which forces people to look at race before looking at the individual cannot promote equal opportunity. Affirmative action continues the judgement of minorities by race; it causes reverse discrimination, and contradicts its purpose.
Affirmative action has had a number of results. In terms of positive outcome, affirmative action policies have helped to shape the climate of discussion about issues of equity in pay and opportunity. This has helped to share the way that companies have approach the issue. Opportunities for women and minorities have increased, especially at lower levels of management. There are seemingly still barriers to advancement into senior management ranks for many groups.
The affirmative action program is important because it gives job opportunities for many people regardless of their race, color, religion, gender, and national origin. The work force should be well represented by the different ethnic backgrounds of our society. Some people look at affirmative action as reverse discrimination, but this program doesn’t guarantee employment based on race, ethnicity, or gender. The affirmative action program gives equal consideration to individuals from a different race, ethnicity, or gender, but not one of these factors may be the only factor used to determine an individual’s qualifications for any job.
Affirmative action has been the topic of debate for many years. It has been controversial because it has been said to be a form of reverse discrimination. Affirmative Action has been an issue of contention since its inception during the Civil Rights struggles of mid 20th century America. Discrimination could no longer be tolerated and the Unites States government had an obligation to encourage equality at all levels of the social infrastructure. The main type of discrimination being addressed by Affirmative Action programs was racial discrimination. There are three applicants for the job offering. One applicant is a white male age 35 who has six years of on the job experience. The other three are an Asian female, black male, and white female. Two of these minority applicants have no practical experience and the other only a few years. In order for the company to meet the quota, the company must automatically reject the white male and only look at the other three applicants. The company now is no longer looking for good experienced employees; instead, they are trying to appear fair. This so called ?equal opportunity? is not what it says. This means that they provide ?equal opportunity for minorities.? They are now discriminating against majorities, which goes against the original initiative for civil rights.
