Arguing Against Capital Punishment

In the debate over capital punishment, the opponents argue that capital punishment should not be practiced because it has a civilizing effect and practicing capital punishment has do deterrent effect. On the other side of the debate, the supporters argue that capital punishment should not be abolished because it is just retribution and has a deterrent effect. In this paper, I will argue that capital punishment should not be practiced. In the article titled, “The Folly of Capital Punishment,” Jeffrey Reiman concludes that capital punishment is less just. The victim did not do anything to deserve death, the criminal did. To counter the argument that capital punishment is uncivilized, Van Den Haag points out that most civilizations have had the death penalty at some point in their history. He also addresses the argument that the death sentence is degrading by showing that philosophers, such as Immanuel Kant, have said that execution affirms the criminal’s humanity by affirming their ability to make decisions and rationalize. After analyzing and evaluating both arguments, I believe that the most reasonable conclusion is that Reiman’s argument is stronger; therefore, I also conclude that Van Den Haag’s argument is weaker. The first argument that both Van Den Haag and Reiman argue is the deterrent effect and, for lack of evidence, both admit that this argument is only speculation. Van Den Haag’s argument on this subject is only lacking in that he didn’t consider the possibility of practicing capital punishment cancelling out the deterrent effect of not practicing capital punishment. Reiman acknowledges this effect and then shows that, if you choose not to execute, you cause less pain by saving one life. Reiman’s argument on this point is improved when you take into consideration Van Den Haag’s argument about miscarriages of justice.
