The facts in this case are regarding the petitioner, Joshua DeShaney and the respondent, the county department of social services. In 1979, Joshua DeShaney was born and in 1980, a Wyoming court granted his parents a divorce and awarded custody to his father, Randy DeShaney. In January of 1982, Randy DeShaney’s second wife complained that he had previously “hit the boy, causing marks, and was a prime case for child abuse” (DeShaney v. Winnebago County). This would turn out to be the first of many complaints against Randy DeShaney regarding the abuse of Joshua DeShaney. Winnebago County Department of Social Services interviewed the father, and when asked if he abused his son, he denied such accusations and they did not pursue him any further. In January 1983, one year later, Joshua was admitted to a local hospital with bruises and abrasions, because of which, the physician suspected child abuse and notified the DSS. The DSS subsequently placed Joshua in temporary custody of the hospital but decided there was insufficient evidence of child abuse. In this case, a young girl named Olivia Y was abused by her mother and the foster home. While taking her out the home at the age of three, the system continually neglected her. The reporting party (RP) visited foster family on 7/6/15 and found foster father exhibiting mental health behaviors. The RP stated the foster father disclosed he suffers from epilepsy and doesn't take his medication since he doesn't need it. The RP also stated the foster father is prescribe medication due to anxiety and refuses to take the medication. The foster father believes the medication will cause him to "pass out." On March 4, 2015, the subpoena sent to the address at 3412½ 7th Street, Tuscaloosa, Alabama 35401 was returned stating, moved; unable to forward. The subpoena sent to the address at 3758 8th Street, Tuscaloosa, Alabama 35401 has not returned. The agency has no notice of where that subpoena went. On May 5, 2015, the CP showed for the court hearing and was tested. A court hearing was scheduled for June 2, 2015. A court notice was mailed to the address at 3412½ 7th Street. The CP did not appear for the June 2, 2015 hearing. Therefore, a sanction was sent. According to Child Support Policy and Procedure Manual 5.10.1 which states, each person receiving child support services, regardless of whether (s)he is TANF or non-TANF, is required to cooperate with DHR. That includes activities such as, which is listed in Policy 5.10.1.B.2, appearing as a witness at judicial or other hearings or proceedings. On this date worker visited Mr. Robert Thomas at Cherry Hill Health and Rehab, for the purpose of monitoring Mr. Thomas's health and environment. When worker arrived, Mr. Thomas was receiving assistance from nursing staff. Mr. Thomas recently went to the dermatologist and discovered he had skin cancer on his nose and surgery scheduled in three weeks. According to Mr. Thomas, his insurance coverage cancelled and he had trouble with getting an appointment with the dermatologist and he was receiving bills wanting him to pay the 20% owed after Medicare paid. Various methods of abuse from her family members led Robin’s psychical health to a few disorders, like dependency on alcohol and bulimia nervosa.
