Question 2:
The Articles of Confederation and the Constitution had some important differences and each document approved at the time it was written based on the history of the country up to 1789. The Articles of Confederation was the original constitution of the US, ratified in 1781, which was then replaced by the US constitution in 1789. The US Constitution is a document that has the fundamental laws and principles that we use in the United States currently for our government.
Written in the Articles of Confederation, the states were sovereign, which meant that they were a state that has borders where people live, and where a government makes laws. The people must follow the laws that the government produces otherwise there could be some consequences if not followed. An example of a sovereign state is the United States, the United States is an independent nation, which is governed by the Americans, that control its own affairs. Another thing that was written in the Articles of Confederation was that no federal courts could enforce laws, all the laws will be enforced by state courts. The difference between a state court and a federal court are, that a state court case has an extensive jurisdiction, so that the cases individual citizens are most likely to be involved in are robberies, broken contracts, family disputes and traffic violations which are usually settled in state courts. In the federal court system, federal
The Articles of Confederation was the first federal foundational laws of the United States. It was composed due to the conflicting views of the politicians at the time and the need to unite the States during the war. Its development and resoluteness had a sluggish inception due to some Americans uncertainties of the government’s substantial central power and property demands by States. The Articles of Confederation was finally sanctioned on March 1, 1781. Under the Articles, each States stayed autonomous, with Congress having the final say over disputes. Congress was also given the ability to make accords and agreements, uphold armies and currencies. The Articles of Confederation did best with territorial expansion in the West, thanks to the Ordinances that were written for the Articles and the benefits they had. However, under the Articles, the central government had no power to impose taxes and manage commerce, because of this the government was consistently short of funds. Despite the lack of funding, money was still required for the war effort, and Congress' meantime solution was to print nearly $250 million paper currency, this led to major inflation in the States. This deficit urged legislators to find a solution; the Constitution of 1787. Both the Articles and the Constitution worked to preserve a free government, different from the tyrannical rule they have experienced from the British Parliament. Also, both documents allowed states the power to manage mercantilism,
The United States left the Articles of Confederation behind for a new more adapted constitution in 1788 due to more than one reason, however a main reason for the switch had to do with the power of the federal government. There would be some Libertarians that would hold the Articles to be the symbol of American freedom at its peak, however there were those that would later be known as Federalists that saw the Articles as a failure due to the lack of strong central government powers within the articles. The many differences between the two documents were each important in there own respect, the first one that come to mind would be the power to levy taxes, under the articles Congress could request that States pay taxes, but under the
The Articles of Confederation and the Constitution are two different types of Government. There are many differences between the two, for example, the Articles of Confederation were made for the original 13 colonies. The constitution was made for the United States of America.
The articles of confederation and the constitution have many things in common yet if one doesn't come to the agreement the other one can’t proceed to make a decision. There is where the conflict starts because if one of the decision is not what the other wants there is a cause of dilemma. As an example, voting in congress. In the articles of confederation there is only one vote per state vs in the constitution it is one vote per representative, or senator.
The Articles of Confederation was the first constitution of the United States. They were written during the revolutionary war to create a more unified government, and to establish what the national government could and could not do. The Articles let each state keep “sovereignty, freedom, and independence,” and created a very weak central government. For example, Congress could not regulate commerce or impose taxes. The impact that the Articles of Confederation had on federalism for the next few years was: the federal government had very few powers, and most of the authority remained in control of each individual state.
The Articles of Confederation and the U.S. Constitution are very different government documents. The Articles establishing a confederacy, which is where the states have all the and the federal government is more of a suggestion. Whereas the Constitution established a federalist government, which is where the federal government has most of the power and the states have a limited amount. Overall, there are more advantages to the federalist government. Almost every decision the government makes is by a trusted group of elected congressmen. With a confederacy you have all the states that have a chance to put the other states in danger. Like if Texas declared war on Canada that would put all the states above them
It all started after the Declaration of Independence during the time America was busy fighting the Revolutionary War, when Congress realized that they needed to form a plan to move forward and unite the thirteen states as a nation.
The Articles of Confederation were the United State’s first constitution that was drafted in 1776 and set in motion a year later. The Articles of Confederation also known as “The Aoc”, ran the US government successful through the time of the American Revolution. However, the Aoc didn’t permit the national government with the power to levy taxes or regulate commerce, as a result of that all efforts at national cohesion was disheartened. So during the summer of 1787 they decided to create the “Supreme law of the land”, The Constitution. The constitution did everything the Aoc couldn’t do, it established more laws and provided increased federal authority while protecting the basic rights of it’s citizens.
The Articles of Confederation, which was considered the first constitution of the United States of America, and the US Constitution, which acts as the supreme law in the United States today, both are poles apart. In fact, it was only because of the weaknesses of the Articles that the present-day US Constitution was drafted. The Articles of Confederation or Articles was a written agreement which laid the guidelines for the functioning of the national government. It was drafted by the Continental Congress and sent to the thirteen original states for ratification in November 1777. Within a few years of its ratification, the Articles was subjected to severe criticism by the Founding Fathers of the United States. Problems with the document existed in plenty; the biggest issue being the fact that it left the national government at the mercy of states. Eventually, it was decided that this agreement had to be revised to suit the needs of the nation as a whole. The delegates at the Philadelphia Convention came to the conclusion that it was better to draft an entirely new constitution instead of revising the existing agreement, and thus came into existence the new US Constitution.
The Article of Confederation was the building block that created our Constitution. It was prefect as well a lot of things our government creates. In addition here are differences between the two documents.
The simple difference between the Articles of Confederation and US Constitution is that the articles were not strong enough to hold our young nation together. The articles operated the US as separate states. Under the articles, it was very difficult to pass laws since the requirement of 9 out of the 13 states ' approval was needed for ratification. The Articles created a loose confederation of sovereign states and a weak central government, leaving most of the power with the state governments. The need for a stronger Federal government soon became apparent and eventually led to the Constitutional Convention in 1787. The members of the Constitutional Convention signed the United States Constitution on September 17, 1787 in
The articles of confederation were the first agreement and first constitution of the United States. The articles of confederation had many flaws which made it more weak than strong. The articles of confederation were a written document the defined the structure of the government from the years 1781 to 1788, under which the union was a confederation of equal states, with no executive leader or power, the articles of confederation were made to mainly to foster a common defense. Now, there were two political groups. There were the federalists who were supporters of the constitution of 1787, which would create a strong central government. them opposes were the anti-federalists, they felt that a powerful and distant central government would not
Compare and contrast the Articles of confederation and the Constitution, especially in regard to the specific powers granted to the national government. The formation and ideals of the Articles of Confederation and its successor, the Unites States Constitution, varied from each other in terms of a stronger or weaker federal government in dealing with issues. The Constitution gave more power to the federal government, while the Articles of Confederation involved a very weak government with primary rights interests of the individual states as the focus. Both gave Congress legislative power and set up departments that would eventually be incorporated into the president’s cabinet. The formation of the Articles of Confederation was of the
The Articles of Confederation created a federation government, which in actuality seem like thirteen countries with an alliance agreement in case of international problems like it was the Independence war or even any invasion in the territory as delineated in Article IV and IX. Also, Article V gave each state the right to be represented in Congress, making each state seemed as its own country with what today would be called a Secretary of State. At the same time, the Articles of Confederation give total power to each state to carry out most if not all of the political decisions, more specifically Article II. This evidence shows how the power was concentrated mainly in the states as they had many political freedoms and were also responsible
The idea of state government came from the Articles of Confederation. The Articles of Confederation were the first type of government the US had, and they were based on the state's powers. Soon, the Framers of the US saw that the Articles of Confederation were not working, and each state was like it’s own country. The Framers met at the Constitutional Convention, and there were two sides as to how the US Constitution should be written. The Federalists wanted a strong Central government, but the Anti-Federalists wanted a government that gave the power to the states. There was a compromise made, and a central government was created, but also the states were given their own government. There are many similarities between the two governments, but
