How come we can go from Pennsylvania to New Jersey without paperwork but pay a different amount of state tax for purchases made in the different state? The answer is federalism, federalism is having or relating to a system of government in which several states form a unity but remain independent in internal affairs. These discissions were made in the Federalist Papers written by the Founders. The federalist papers were a collection of eighty-five essays written to the newspapers in the 1780’s to encourage the remaining states who had yet to ratify the constitution. The states have the power to change anything they want drinking age, tax, driving age, schooling but there are some things that they can’t do such as coining money, have external affairs, or declare war they are all powers that are left to the national government. The idea of a federalistic government is that there are levels of government there is national level, state then local and depending where you are in the United States you need to follow those rules. The power is not always divided equally though. Even though states have right given in the 10th amendment if the nation wants a state to change something they can refuse funding until they change what they want to be changed. This happened in 1980 when New Jersey changed their drinking age to 19 and the state was at an all time high with 18-20 year olds losing their lives 88 young people died while intoxicated on New Jersey roadways that year.
In 1995 the government withdrew highway funding due to the fact that people who drive motorcycles were not required by law to wear helmets while driving this was established and then reinstalled in 1991. President Clinton then passed a law that eliminated the speed limit and the helmet law now still three states have no rules against wearing helmets.

In the United States Constitution it is stated that “No single section of the constitution deals with federalism. Instead, the provisions dividing power between the states and the national government appear throughout the constitution. Most of the constitution is concerned with establishing the powers of the national government. National power is also based on the supremacy clause of article VI, which says that the constitution and laws made in accordance with it are “the supreme law of the land”. Some powers given to the central government are to regulate trade, to declare war, and etc. Powers given to the state government are to hold elections, establish schools, and etc. Both the state and central governments check each other to make sure one doesn’t get too much power.

James Madison in Federalist Paper #51 writes “Hence a double security arises to the rights of the people. The different governments will each control each other, at the same time that each will be controlled by itself.” This idea of Federalism allows the governments to be supervised by the others while having control over itself. The powers of the government are spilt between the central and state government so neither government could gain more power over the other. The powers that state governments have are more specific to the state then the powers given to the central government. For example, states were given the powers to pass marriage and divorce laws, establish schools, set up local governments among others because these issues differ largely from state to state. Hence, it would make it illogical to give the central government these types of rights because these issues vary from state to state making it an act of tyranny by the majority against the minority. Under the Articles of Confederation, all states are sovereign. Under the articles, a federal court system does not exist nor did independent executives. All laws set for the citizens of America are enforced and set by the state. Congress is composed of one body and is delegated specific authorities. The Articles state that congress is not allowed to participate in state or foreign commerce, nor are they allowed to tax citizens. In the case of having documents or laws amended, each state is allowed one vote. If a unanimous decision cannot be made, then the document or law could not be amended (Maier, 2010; Wood, 1998 .)

The purpose of federalism is to give the people a sense of power, and essentially more liberty. However, it also allows a balance of power by giving states the rights to make their own laws, all while still recognizing the national government as superior.

There are certain things that state governments can do that the federal government cannot do, and there are things that the federal government can do that the state governments cannot do.
