Many young children in United States are imperiled by abuse, domestic and community violence, and poverty. Without help, these children suffer, struggle, and fall into despair and hopelessness. Usually minors cannot manage emotional, social, and psychological challenges of adolescence and eventually engage in destructive and violent behavior. Today, juveniles are lucky enough that death penalty was abolished and said to be and cruel and unusual punishment by the Supreme Court. However, juveniles who commit murder can be put in a prison for life without a possibility of a parole.
It is not right that today children can be tried as adults for the murder. Juveniles under the age of 18, who committed a murder should not be tried as adults simply because they are not. Minors are not fully physically and mentally developed, furthermore, very often the result of such causes is fault of parent who raised them and environment where they had to grow up. Merriam-Webster's Dictionary defines juvenile as physiologically immature or undeveloped. It is ridiculous to think that we can punish children who are not eighteen years old as adults. Just imagine putting 12 years old child in the jail with thirty-year-old man. We cannot talk about a minor as a formed personality.
Juveniles are not adults, that is why we have different age ranks and we treat them differently. They are considered too young to see an R rated films, restrained from things like alcohol, smoking, voting, pornography or
Other people argue that Juveniles may not have the mental capacity to know that this is wrong. This is, in fact, wrong in most cases. A child no matter what the age should know that killing or performing other atrocious acts on others is wrong. There are some exceptions such as mental illness and adverse effects from medications. According to https://flowpsychology.com/10-pros-and-cons-of-juveniles-being-tried-as-adults/, “because teenagers have full control over their thoughts and actions. If they do not have the moral compass instilled in them by that time, then they are very likely to commit more crimes.” This implies that, should teenagers not be tried as adults, they may never learn their lesson.Even if they don’t from harsher punishments; at least they will
Juveniles should be tried as adults when they commit serious crimes as opposed to rehabilitation or various forms of lesser sentencing. The rate of juveniles in prison has increased over the years. Many young adults and children often seek for attention which leads them to cause trouble out in the streets. There are risk levels that officers have to make in order to help the juveniles or if committing a serious crime, they should pay the consequences. Many may oppose and think that young adults and children are not adults, but they should be punished for the crimes they have done.
Juveniles should be tried as adults because they only serve a few years in prison for doing harsh things. Manuel Sanchez and John Duncan committed a bloody murder by shooting a man several times in the chest, and John and Manuel were only twelve years old at the time. For example, “ It was a brutal, callous, bloody murder. But what is even more shocking to people in the small Washington town of Wenatchee is that John Duncan and Manuel Sanchez are only twelve years old.” I found this information in the article “ Rethinking Juvenile Justice” ( John, 1). Instead of the boys
Around the whole world, children are committing crimes and thinking it is okay to do these sort of things, because they are learning from the people around them or family members having to commit crimes to keep the family well provided. Children wouldn’t be doing these crimes if they didn’t have such a bad environment around them. If a juvenile acts like an adult and does adult crimes, then they should be tried as adults. For example, stealing a car that wasn’t yours and starting a high speed chase. That’s an adult crime, but sometimes we shouldn’t just throw juveniles in jail.
Many people believe that kids are kids until they commit violent crimes. Juveniles who commit violent crimes were tried as adults and had equal punishment, the number of violent crimes committed by youths would decline. Individuals who commit a crime do not think about the consequences they have to face. They are well aware of their surroundings and the actions they chose. Nehemiah Griego a fifteen year old who killed his parent and three younger siblings was sentenced as a juveniles and released from state custody by the time he turns twenty one (Article, p.1).
It can often be forgotten in society that adults are not the only individuals who commit heinous crimes or sent to court and given sentences that include life in prison without the possibility of parole. Murder, armed robbery, sexual assault, these crimes being executed by not only adults, but juveniles under the age of 18. Throughout history, juvenile justice has remained an issue and the debate on whether juveniles should be tried as adults. In America, each state possesses their own laws in which they determine how a juvenile should be tried and whether they should be transferred into an adult court. During the 1990’s the rise of juvenile justice came into full swing, and the term “superpredators” was used to describe the youth as “dangerous”
Many have discussed and argued if Juveniles should be charged as adults. Then there's others that believe that they shouldn't be charged as adults. However, juveniles should be tried as adults because they committed a crime in which they must pay for which they also knew it is wrong. They should be tried should depend on what age they are and what fractions have they encountered like rape, abuse, etc. If a 5 year old were to be playing with another kid and perhaps that 5 year old kills the child they have absolutely no idea of what they have done they are far too young to understand what they are doing or have done. Most of the time you have to take care of children because they are putting items in their mouth that they don’t know what it
Finally, I believe that by being rehabilitated the juvenile will have a better chance at life because eventually they will be back in society.
Judging whether a juvenile criminal is an adult or not has always been a controversial issue. While the majority’s judgements are usually clouded by the terror of these crimes, it is still important to have an open mind when it comes to these cases. There’s one thing that these juvenile criminals always have in common: complicated background, which is an essential aspect in judging whether the offender is an adult yet. Needless to say, whatever way the juvenile offenders are being judged as, it is more effective to educate them instead of punishing.
Regardless of age, a killer is a killer. A killer can be the daily customer you have at your job or the child you’re babysitting. “The Supreme Court justices would be wise as well as compassionate to strike a balance: Make juvenile offenders responsible for their actions but don't completely rob them of hope. And this should apply not only to the inmates who were 14 at the time of their crimes but to the remaining 2,497 who were 15 to 18 years old,” (Ellison 19). Kids make mistakes all the time, that doesn’t mean we should take their life away from them. With overlooking the listed factors in court when sentencing a juvenile, this will improve the number of children in prisons. Not all of these children partake in the act because of evil, but merely because of
Many serious crimes are committed daily and some by juveniles under 18. When serious crimes are committed these juveniles get tried as adults and receive adult sentencings. Many people argue that such juveniles should not be tried as adults because they are just kids and are still developing. In my opinion, I agree that juveniles should not be tried as adults, however I also believe they should receive adult sentencings but to a lesser degree, because they are not yet fully developed, they have potential to change, and it is not fair that they are underage but are being tried as adults.
If a juvenile, over fourteen has the ability and willingness to commit a violent crime they should be tried and punished as an adult. A fourteen year old knows right from wrong. He (or she) is able to tell whether they are committing a crime. If a juvenile is mature enough to commit an adult crime, they should be treated as an adult, and punished justly according to the adult law. The difference in age in two people should not determine their punishment if they have committed the same crime under the same or similar pretenses.
Crimes are most associated with adults. Murder is especially most associated with adults. When a teenager commits such a crime such as murder they must be tried, and they should not be treated with leniency and coddling, but with the full force of the law as an adult.
Juveniles can be tried as adults for crimes ranging from kidnapping, murder, rape, arson, robbery, torture, assault, and more. Some of the cases that are sent to adult court are petty crimes, such as: underage drinking, possession of a controlled substance, and other minor crimes. The question is whether they should be tried as adults. These are all adult actions, on one hand, and may lead a person to wonder what brought a child to commit these crimes. One might further inspect that if a child or teenager is engaged in so-called “adult” activities, what kind of activities might a child choose to be involved in adulthood? What is the child’s background? Can you blame the child of a heroin addict for having access to drugs at a young age? Can you blame the child of a murderer for acting out? Yes, everyone has a choice even a child.
In my own opinion, I consider juveniles as immature because they lack the ability to recognize the long term impact of their actions as they have decreased levels of responsibility. Therefore, the justice system should not charge juveniles in adult legal system and sentence them as adults.Trying juveniles as adults exposes the young offenders to state penitentiaries up to life in prison without parole and even sentenced to death. This raises a question on how truly effective treating juveniles as adults are to the young offenders. As the crimes committed by juveniles increase, there has been an outcry from the public and affected to prosecute juveniles accused of serious crimes as adults. It is true that juveniles do
