Freedom Of Speech: Human Rights In The United States

Freedom of Speech is expressing oneself without anyone stopping you, since it is a right we have. For example, we have the right to give an opinion and say what we want to say. We use this every day it’s part of our way we express ourselves about a situation in our daily life.

Free speech is both a universal and national liberty. The United Nations and the United States of America believe that free speech is something that humans should be allowed to exercise. However, each respective group has their own limitations. These limitation, although broad, protect against free speech being taken too far. Like any liberty or privilege there must be a line in the sand to keep extremists from aggressively using and abusing this right. The United Nations formed "The Universal Declaration of Human Rights." With in this declaration are 40 articles with a preamble examining the rights which they believe are basic and necessary. Free speech is the backbone that holds democracy together.  Without a free speech, ideas would not be challenged, governments would not be kept in check, and citizens would not be free.  John Stuart Mill said once that, “If all mankind minus one were of one opinion, and only one person were of the contrary opinion, mankind would be no more justified in silencing that one person then he, if he had the power, would be justified in silencing mankind.”( Roleff, 21). The right to free speech is essential to “egalitarian democracy,”(Tsesis) however, this right is not absolute and must be limited in certain situations.

There are several examples that show that freedom of speech is not equally free. In the Ward Churchill case, Ward was fired from the University of Colorado after writing that the U.S. foreign policy abuses were a partial cause of 9/11. He was fired for research misconduct. The American Council of Trustees and Alumni enlisted the government to put pressure on the university to fire him. This proves that the government still feels that freedom of speech should be restrained during war times, even though the law that was enacted for this was abolished. This type of suppression is not right. The opinions of people who are not hurting anyone directly should not be punished. Therefore, freedom of speech is not absolute.

The right to freedom of expression is recognized as a human right under article 19 of the Universal Declaration of Human Rights. The amount of power that one gives a government if it is allowed to restrict freedom of speech according to its will and its political needs should not be underestimated. If you look at history, the cases of societies that suffer because of dictatorial governments, will greatly overpower the cases where societies went down a bad path because people were having too much of freedom of speech.

As American citizens individuals are granted the right of speech through the first amendment. Living in a America allows people to express their thoughts beliefs, and opinions as a part of living in freedom. In America you are told you are equal to the next citizen whether it was your neighbor, colleague, or classmate. With belief in the government you are assured you are encountered to indispensable rights sheltered by law to assure your first amendment right cannot be seize. The government gives this mind setting of America being the land of the free to express your individuality and freedom of speech is given equally to everyone. But imagine this ; suddenly after a long day of work you turn on the world news and see people protesting or being criticized by the government because they are practicing their right to speak and it suddenly hits you that expressing your right can cause confusion in the nation .The first amendment of the freedom of speech differs in views of gender, religious, and race conversations which challenge every American opinion creating confusion.

Everybody has rights to freedom of speech, but when there is freedom of speech without limits or restrictions, there is no doubt that this will lead to disaster. People will surely benefit if we are able balance between freedom of speech and restrictions to ensure that society can communicate and prosper without anarchy.

Although freedom of speech is protected under the First Amendment of the Constitution of the United States the issue has been contested throughout our nation's history.

Out of all the rights given to we Americans in the Bill of Rights, the first amendment includes the most cherished one: the freedom of speech. Freedom of speech gives citizens the right to express their own opinions publicly without government interference, violating laws, or inciting any kind of violence or rebellion. However, the first amendment does not mean anyone can simply say whatever they want. There are several topics that are strictly scrutinized by law and there are even some situations in which freedom of speech is lawfully restricted. Freedom of speech is an extremely important part of the constitution that we value highly, but there are obvious things that are allowed and not allowed that go with it.

The right to freedom of speech, is a cornerstone of what this country was built on. In the original 13 colonies, colonists were prohibited from voicing their opinions against the king in England. Since then, our nation has fought to secure these liberties; however, what exactly is freedom of speech? Our constitution is not completely clear on this, for instance, our first amendment reads that, “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.” This effectively translates to mean that the government cannot conjure up a law to ban free speech, but it still does not address what it even is. It might not sound like an issue now, but the difference in perceptions on what it does mean not only changes the foundation of the country but, it also dictates who can do what and who can say what. In the recent news there have been two types of speech that have plagued the headlines, symbolic and offensive speech.

However, it does not protect slander or threats to people, like yelling fire in a crowded theater. The earliest Concepts of freedom of speech can be found in early human rights documents. England's Bill of rights legally established the constitutional right of 'freedom of speech in Parliament' which is still in effect. The Declaration of the Rights of Man and of the Citizen (a bill passed by France in August of 1789) further specified that Speech was an unalienable right of man. Now, it is a right recognized almost all over the world (only countries under dictatorships or under rule banning any basic freedom like North Korea, Turkmenistan, and Iran do not have this right).

In the western civilizations, especially in the United States, people pay a lot of attention to the freedom of speech and expression. We see americans refer to the freedom of speech in TV series, news media, courts and many other places. Such a freedom has been strongly protected from government restrictions by the First Amendment to the United States Constitution since 1791. And the idea of the free speech has been interiorized into the broader liberal and individualistic western ideology for a long time.

Freedom of speech is the right to articulate one's ideas and opinions without fearing government sanction,retaliation or censorship. The phrase 'freedom of speech' is to include any act of receiving, seeking and conveying ideas, or information regardless the medium that people are using. Freedom of speech and expression has a long history is predated current international and regional law of human rights with freedom, but shall be responsible for such abuse of this freedom as shall be defined by law. Everyone has the right includes freedom to hold opinion without interference and to seek, receive and ideas through any media and regardless of frontiers. Today freedom of speech or the freedom of expression, is recognized in international and regional human rights law.
