Hammurabi’s code is believed to be the first form of written law. It consists of a set of 282 laws written by Hammurabi, the king of Babylon circa 1792 BCE, that established a written social contract amongst the people of Babylonia. It was written on a stone stele that stands more than eight feet tall and weighs over 4 tons (doc A). According to the stele, Hammurabi was instructed to create the code by Shamash, the god of justice (doc B). However, it introduces conflicting ideas about justice that are arguable to this day. Were his rules unethical or his punishments too severe? Hammurabi’s code may be seen as unfair by today’s standards, but in solving matters that involve family, property, and health issues of his time, Hammurabi’s code was just because it utilizes negative reinforcement to implement positive results in society.

Drowning, cutting off hands, and hangings were all punishments in Hammurabi’s code. Given to him by Shamash, the god of justice, the code was carved on a stone stele and consisted of 282 laws. The laws were just for Hammurabi’s time period, but they would not be considered just by today’s standards. Compared to people today, Hammurabi and his subjects have a more impulsive mindset; their society is adverse to the works of society today. In that case it is expected that certain components, like laws, will be viewed differently over time.

One reason why Hammurabi’s code is unjust is that it doesn’t treat everyone the same. Law 196 states “If a man strikes the daughter of a free man, and causes her to lose the fruit of her womb, he shall pay ten shekels of silver”, while Law 199 states “If he has struck the slave-girl of a free man and causes her to lose the fruit of her womb, he shall pay two shekels of silver. This shows that the code thinks that free people are five times more valuable than slaves. In Document B, he says “that the strong may not injure the weak”. However, in truth, the strong (free men) are injuring the weak(slaves), because if someone wanted to hurt a pregnant women, they would have to pay one-fifth of the money that they would pay if they hurt a free pregnant woman if they hurt a slave-woman.

The Hammurabi Code of Laws is a set of rules enacted by the Babylonian King whose name was Hammurabi. The Babylonian King created a total of two-hundred eighty-two punishments that the citizens will receive if they do not abide by the laws that were given to them. The king ruled from 1792 BC to 1750 BC. The Hammurabi Code of Laws is very violent in terms of punishments. For example, one of the laws are “If anyone breaks into a house to steal, he will be put to death before that point of entry and be buried there (walled into the house)”. This is a clear example of how violent and inhumane the punishments of the Babylonians were, to us at least. This essay will be explaining a set of laws from the Hammurabi’s Code of Laws.

Hammurabi’s code included some gruesome punishments, some that might be believed as unruly, but is still just. Hammurabi’s code was just in many ways pertaining to their time. These laws are not the oldest set, but they were possibly the most strict from the ancient world. The punishments for breaking some laws are different for the multiple classes on the social structure and genders. Also, during his time, Hammurabi was known more as a builder and conqueror than a law-giver. All in all, the laws abiding in Hammurabi’s code are just because of its personal injury and family laws.

The Law code of Hammurabi is an inscription of laws on a well preserved stele artifact. The Babylonian King Hammurabi included not only new laws but law codes from the Sumerians and Akkadians. Since Hammurabi included these ideas from previous codes this can prove that these laws were not only written but also enforced. The laws of Hammurabi have a common theme of solving problems with getting even or unjustly consequences so that they don’t go against his laws, the topics such as domestic situations, work relations, and exchange all exemplify this theme within their law.

Around 4,000 years ago Hammurabi’s code was created by Hammurabi the king of Babylonia with the goal of bringing justice to his kingdom. He even claimed that Shamash the god of justice commanded him to make these laws. Then his laws were carved into large stone’s called steles, written in the ancient cuneiform written, and then put up throughout all major communities of Babylonia. However, these ancient laws were not fair for everyone in his kingdom. Hammurabi’s Code was unjust because the laws pertaining to family life, property law, and personal injury were unfair.

The “Code of Hammurabi” is considered to be one of the most valuable finds of human existence. In fact its very existence created the basis for the justice system we have come to rely on today. The creation of “the Code” was a tremendous achievement for not only Babylonian society but for the entire Mesopotamian region as King Hammurabi was ruler over all of that area. Its conception can be considered to be the first culmination of the laws of different regions into a single, logical text. Hammurabi wanted to be an efficient ruler and realized that this could be achieved through the use of a common set of laws which applied to all territories and all citizens who fell under his rule. (2) (3). First of all, the biggest different between Hammurabi’s Code and the Sharia Laws are difference in term of geography and the time when they were introduced and applied. The Hammurabi’s Code was applied in around 1760 BC for 46 years by the Babylonian (Iraq in the modern day), when knowledge and intellectuality of people in that period of time still were very limited. Unlike Hammurabi’s Code, even the Sharia Law was created a long time ago but it has still being used quite popularly in the modern day. The Sharia Law has been used in many Islamic countries in the modern life and time when people’s knowledge is extraordinary and unlimited. However, having read these two laws, we have realized that there are many of similarities between Hammurabi’s Code and the Sharia Law, which prove Hammurabi’s Code in a way can be considered as a model of the modern day laws against the fact that the gap of time is over 3000 years (1). One interesting point is that people lived in 3000 years ago share the same view with people nowadays. General violations like stealing, lying, prostitution and murdering are punished harshly. Therefore, even though Hammurabi’s Code did not exactly resemble the modern-day Sharia laws, however it shared the same basis, which was to keep justice and legal rights of everyone in place and both against women harshly (2)

The code of Hammurabi is the most remarkable and complete code of ancient law that we have. The code can be found on a stele, a stone slab usually to commemorate military victories in the ancient world. His code, a collection of 282 laws and standards, stipulated rules for commercial interactions and set fines and punishments to meet the requirements of justice. Most punishments resulting of death or loss of limb if a law was broken. The edicts ranged from family law to professional contracts and administrative law, often outlining different standards of justice for the three classes of Babylonian society. The Hammurabi Code was issued on the three classes of Babylonian Society, property owners, freemen and slaves. It was important as it organized the most civilized empire at that times , and Hammurabi made many copies of it and distributed them in the most important cities of the empire , so it represented a great progress to the human

The Code of Hammurabi was a strict, harsh, and unequal way of punishment that focused on current attainable penalties for Mesopotamian society. The society wasn’t religious, they did not have any affiliations with spiritual beings, which is why punishments were needed for the specific moment

The Law Code of Hammurabi is a native Babylonian text that served as the basic law code of society. The way of life was of the former Babylonians culture is totally different than what we are used to today. The text gives readers a vision of how ancient societies lived in these times. This law code gave society a diverse arrangement for citizens to follow. The social structure isn’t about wealth, they are judged by different standards (such as trial by ordeal). The husband is the dominant role of the house. The family structure is a patriarchal household and the power of the father is absolute. The Law Code of Hammurabi gives readers a clear thought of how unfair the earlier civilization of Babylonians existed through class structures, gender relations, and family structures.

Throughout time many civilizations and societies have come and gone. Every one of them was unique in their own way and had a different way of governing themselves. In this paper, I will be focusing on Hammurabi’s Code. Hammurabi’s Code is a series of laws that governed the Babylonian society back, when they were created, in 1780 BCE. The code was wrote by Hammurabi himself, back when he ruled the Empire of Babylon. The text itself explains why the code was created and why Hammurabi was chosen to write the code. The code then lists, in an organized fashion, all the rules that the society is to follow and what the punishments are if the rules are broken. Every rule is very specific about what is to happen if the rule has to be enforced. Hammurabi’s Code gives us an idea of how the justice system worked in the Babylonian society, how men and women in the society were treated, and how the religion was followed.

Throughout history, humanity has kept itself from barbarity and lawlessness by establishing rules and laws to bring order. The most primitive set of written laws historians have been able to discover is Hammurabi’s Code, which originated in 18th century BCE. Hammurabi, the author of said Code, was a king who ruled over the larger part of Mesopotamia for forty-two years. He claims these laws were handed to him by the gods and, as stated in Document B, meant to “let righteousness go forth in the land.” However, was Hammurabi’s Code really all that fair? In some areas, such as women’s rights, and property law, I’d say the law is more that fair. Nevertheless, other areas, such as the various punishments the law offered, were quite brutal.

The law codes of the United States are based on the Ten Commandments and various standards that humanity has conceived throughout history. However, before Moses climbed Mount Sinai and “the Lord descended upon it with fire”, the First Babylonian Empire in ancient Mesopotamia was ruled by Hammurabi, who developed the earliest known law code in world history (Exodus 19:2-25; class discussion, 08/29/17). Hammurabi’s Law Code, as it is known today, could be thought of as an early interpretation of morality. Despite the good moral intentions of the law code, these laws are strict, cruel, and, in some cases, unusual. With over two hundred laws, divine right, the act of revenge, and inequality of punishment between classes took up a large amount of this ancient Babylonian law code.
