Hello my dear judge, I'm here on the behalf of David “Tsotsi” Madondo for the accusations made by the prosecutor. I believe the prosecutor's sentencing is cruel and insensitive based on my clients past. He should serve jail time but not life, my client has been a victim of apartheid he's also been a victim of abuse, he's been abandoned which took a toll on him at only 10 years old. He was left to feed himself take care of himself. Which led him no other option but to join a gang. This gang gave him the security he needed. They fed him and put a roof over his head but also influenced his negative ways. This is where he learned to be heartless. Prison is not an effective way to create civilized citizens. 60% of inmates have mental issues and 77% within 5 years return to prison for additional charges (whitehouse.gov). Tsotsi stated one point in his life that what he did was wrong and that he doesn't feel the need to kill anymore that killing was a choose after sparing Morris life Morris was a man that was handicapped and because of apartheid he was unable to attain fair working conditions in which his only option was to go into the mining field. The mining was hazardous place this is where he lost his legs. He lost his job and was more poor than ever before. Tsotsi bumped into Morris on the street followed him, Ttosi asked him how he goes everyday living like he does Morris said he felt like he was born again, what he held on too is sunshine the feeling of waking up everyday to experience the sun on his hands and on his face, Totsi was moved by what Morris said it was an eye opener this is why he spared his life. David “Tsotsi” Madondo is a cold-blooded killer who deserves to be put in jail for the rest of his life for the heinous crimes he’s committed. Despite losing his mother to apartheid at a young age, Tsotsi is an extremely violent young man now with very little self-control who's also killed innocent people. Tsotsi has planned the killing of Gumboot Dhlamini, brutally assaulted his fellow gang member Boston, threatened Miriam, a woman who helped him take care of the baby forced on to him, he murdered a person on the train, and ran a street gang with Die Aap, Butcher, and as mentioned before Boston. Tsotsi absolutely cannot be allowed to go free for all of these crimes. It would be a massive injustice especially to the families of Tsotsi’s victims.
Upon arrest the defendant struck police officer T. Chur. Officer Chur sustained a broken nose and bruises on his face. We would like to ask the court for the maximum sentence on the charge of assault on a police officer. Officer Chur could have sustained more injuries that could have put him out on disability and lessened his income to support his family. The prosecution hopes that the judge will take these recommendations into consideration when sentencing the defendant. The people feel that the crimes committed will best be sentenced at the maximum sentence of the death penalty because it appears that the defendant had no regard for the life of Ms. Opee and being that he is a repeat offender, this may not be his last murder. We do not want him out on the street where he is likely to hurt or kill someone else.
In the 1930’s it was rare for a black South African to attend college. However, in the criminal case of R v Loveridge, it is evident that the justice system fails to apply the law to equally balance the needs of the victims and the community. An untold number of innocent people have been executed. As it is, many relatives of victims have said that they do not wish for their relative’s killer to be put to death. Circling back to Tutu’s quote, the government is not providing these families with justice – but with revenge.

To begin this case, I should tell that my accused Tsotsi is guilty, but I believe that he deserve sometime in prison. He had been through alot in his life and had to learn thing his own. Therefore I also believe that he deserve counseling for at least month if he show that he is recovering and improve. Also is government's fault because of the apartheid laws that was made to divide south africa from others cities,and that separate families that are in the city and go there to find jobs just because they didn't had pass so they can be identified.

The central issues stem from 50 years of apartheid include poverty, income inequality, land ownership rates and many other long term affects that still plague the brunt of the South African population while the small white minority still enjoy much of the wealth, most of the land and opportunities
The man that was serving the crackling to the black children "did it in leisurely fashion, with long pauses for a smoke' and he "occasionally turned his back'. From this we can see the affects of apartheid and what it does to people. The "young man' that was serving them was taking his time, and being facetious, flippant and dismissive. Not only that, but he was doing this towards young children. We can see that apartheid has made this young man think that he is greater than black children. This, therefore in his mind has justified his actions in believing he had the right to behave in such a manner. Apartheid, being part of South Africa's legislation did give him the right to act in this manner by law.

I have always thought that Nelson Mandela has been one of the most important people in history. I find it very fascinating that one man could end the Apartheid and that is why I want to find out more about this. South Africa is a country with a past of enforced racism and separation of its multi-racial community. The White Europeans invaded South Africa and started a political system known as 'Apartheid' (meaning 'apartness'). This system severely restricted the rights and lifestyle of the non-White inhabitants of the country forcing them to live separately from the White Europeans. I have chosen to investigate how the Apartheid affected people’s lives, and also how and why the Apartheid system rose and fell in South Africa.
Winnie Mandela founded the Mandela United Football Club, which later turned into a vigilante group that tormented Soweto in the 1980’s. The boys she selected to be part of her club were desperate and homeless young men. She fed and provided shelter for the boys as well as education for the boys. Winnie manipulated these young men into committing gruesome crimes for her, as a form of rebellion against the Apartheid government. Before 1994 South Africa was a country based on Apartheid rules and regulations. The Parliament was the highest legislative body and it interpreted laws as it pleased, mostly in favour of ‘white Christians’. Any other race or religion was treated in an unfair and sometimes inhumane way. These laws were mainly based on Roman-Dutch law and influenced by English law.
