The Individuals with Disabilities Education Act (IDEA) identifies students with emotional disturbance by using a specified set of criteria. The five characteristics that define children as eligible to receive special education services as emotionally disturbed include problems that occur over an extended period of time, to a marked degree, and have an adverse effect on the student’s educational performance. The primary goal of IDEA is to improve the outcomes for students with disabilities. The special needs of a child need to be identified early and accurately in order for the student to receive maximum benefits in school. After a student is identified as special needs, intervention needs to be used in order to provide the student with the best educational plan possible. Once the special need is identified, an individualized education program must be designed for that student. This program will help students with disabilities reach their educational goals easier than they otherwise would. The IEP is customized to the student’s needs. This program then helps the general education teacher better understand the disability and how it will influence the student’s learning process. While all children can be referred for evaluation for special education, not all are found to be eligible. The student will be tested in all areas related to the child’s assumed disability by the multidisciplinary educational team. In order to be eligible for special education services, the child’s assume disability has to impact the child’s ability to learn. Parents represent the child’s interests. They need to stay informed and involved in their child’s education. IDEA of 2004 strengthened the role, as well as the responsibility, of parents and ensures that they and their families have opportunities to participate in their child’s education. IDEA also protects the rights of parents by ensuring that they can be members of the IEP teams. Parents can be involved in the evaluations and placements of their children and have a say in what happens.

There are many different enforced laws towards people who have disabilities. Many of these laws benefit the people who need them. One of the biggest deaf laws is IDEA, but there are many others including, The Americans with Disabilities Act and Section 504 of the Rehabilitation Act of 1973. Without these laws the deaf community wouldn’t grow and have become what it is today. These acts have been in place for years and help indulge the deaf in their magnificent world.

IDEA also requires all students to get their education in the least restrictive environment. This means that all students, even those with disabilities, must be taught in general education classrooms as long as the special education department determines that is the best placement for them given their disability. This ensures the best possible education for all students.

ADA has substantially closed the gaps between those with and without disabilities, however, it has not been enough. The provisions of the Individuals with Disabilities Education Act will help me know how to properly incorporate students with disabilities into my general education classroom in multiple ways. In 2013, “more than 60 percent of students ages 6 through 21 served under IDEA were educated inside the regular class 80% or more of the day;” therefore it is essential that I understand how to positively and effectively include students with disabilities in my classroom (US Department of Education, 2015).
