This paper will look at the importance of Preventing Juvenile Delinquency and what different ideas, concepts and methods are available to those adolescents that are either at-risk already or those that can be in the future. Early prevention is the best method of slowing down the statistics of crimes among adolescents, by keeping them off of the streets and out of the justice system by providing the means to teach them to be productive rather than destructive.
Studies suggest that there is a divide between the government and public response to juvenile incarceration. Bullis & Yovas (2005) state that support is given to correctional facilities to house juvenile offenders as a form of punishment (as cited in Shannon, 2013, p. 17). Individuals who support this perspective are often more likely to support the construction of more prisons and stern penalties on crime based upon the presumptions that youthful offenders are aware of the consequences of their actions (Drakeford, 2002 as cited in Shannon, 2013, p. 17). The Juvenile Justice and Delinquency Prevention Act (JJDPA) is the principal federal program through which the federal government sets standards for juvenile justice systems at the state and local levels. It provides direct funding for states, research, training, and technical assistance, and evaluation. The JJDPA was originally enacted in 1974 and even though the JJDPA has been revised several times over the past 30 years, its basic composition has remained the same. Since the act was passed in 1974, the JJDPA focused solitary on preventing juvenile delinquency and on rehabilitating juvenile offenders.
Juvenile Delinquency is the participation of illegal behavior by a minor who falls under a statutory age limit. A delinquent is a minor who commits a crime or a status offense. A status offense is conduct that is illegal only because the child is under age i.e. smoking cigarettes (Senna 10, 20). As mentioned within the paper, there are benefits to having services provided by both public and private entities; however, there are also concerns. The public sector, which was portrayed by services offered by TJJD, are required to provide yearly reports. In many ways these reports keep the system accountable for the money they are spending and the services they provide or require for juvenile offenders. The reports are open to the public and are easily accessible. As it relates to research, these reports allow people to critically assess juvenile programs, while challenging the government to refine or create programs superior to the ones offered in the past. Reports like these are harder to find regarding services offered by private entities and is a concern. Programs in which juvenile offenders are required to successfully complete, should never be determined by trial and error; however, this is often the case. On a positive note, private entities and community resources typically target the specific needs of a juvenile and include mental health components. Programs which do not offer mental health services should be critically assessed, as they are less likely to succeed. Juvenile delinquency has become a controversial issue within the Criminal Justice system. In the United States, juvenile delinquency refers to disruptive and criminal behavior committed by an individual under the age of 18. In many states, a minor at the age of 16 to 17 ½ can be tried as an adult. Once the individual reaches adulthood, the disruptive and criminal behavior is recognized as a crime. However, the criminal justice system has divided juvenile delinquency into two general types of categories that has brought upon controversial issues of inequality and corruption. Yet, putting young individuals in juvenile detentions facilities seems to open the door for them to commit more crimes in the future. Juvenile offending is a concern in society today. Juveniles account for approximately 19% of the population but are responsible for 29% of criminal arrests (Cottle, Lee, & Heilbrun, 2001). Crime overall has been found to be decreasing throughout the last two decades. The issue is that the rate in which adult crime is decreasing is significantly greater than the rate in which juvenile crime is decreasing. Since the rate of juvenile crime is so high, juvenile delinquents are seen as predators and many believe they lack morals. The way in which media of today’s society constructs juvenile delinquency impacts the views of a community towards their youth and youth offenders. Media presents an inaccurate image of youth offenders as violent predators (Rhineberger-Dunn, 2013). This inaccurate image significantly promotes the myths that juvenile crime is rising, juveniles commit crimes that are primarily violent, and that juveniles are highly effected by recidivism and continue committing crimes into adulthood (Bohm, & Walker, 2013). It has already been stated though that crime rates have been decreasing over the last two decades so the first myth is refuted. The myth that juveniles primarily commit violent crimes is also very off. In most cases, juveniles are involved in property crimes and although there are some violent crime cases, they are very rare. Finally, literature on the juvenile justice system often focuses on program implementation and effectiveness at addressing rehabilitation, as well as diversion techniques within the system (Greenwood, 2008). This review audits these problems in detail and establishes them within the bigger struggle in the juvenile justice system to rehabilitate youth offenders.
