P2P File Sharing of Copyrighted Material
Introduction
Anyone who owns a computer that has a reliable internet connection can potentially download a torrent client and participate in peer-to-peer file sharing. Using a web browser to download files from websites is a lot different than downloading files from peers because instead of obtaining the files from a web server you are obtaining the files directly from ordinary computers like your own, hence the name peer-to-peer (P2P). Often times popular television shows will be shared less than 24 hours after airing and this availability plays a crucial role in the amount of people who are actively downloading and sharing. As of May 4th, 2016 approximately 35,000 people are actively sharing Season 2 Episode 20 of The Flash television series which aired the previous day on May 3rd. On top of that another 10,000+ people are downloading the same episode, and that’s just a single torrent.

All of these people are sharing/downloading a single episode of a television series. There are thousands upon thousands of people sharing and downloading copyrighted material every second. This includes movies, music, television shows, e-books, computer software, video games, etc. From 2008 to 2014 file sharing in North America increased a substantial 44% (Steele) and since 98.8 percent of all P2P file sharing data is copyrighted, this implies that the illegal sharing of intellectual property using torrents and P2P file sharing has been climbing steadily. For the past decade, if you wanted to download copyrighted material and didn 't want to pay for it, it 's likely you turned to “The Pirate Bay”. Up until a police raid it was the most popular place to grab Sunday 's episode of “MSNBC or Power” months before the Blu-ray hits stores (Seppala, 2014). You didn 't have to log in to some arcane message board or know someone to get an invite. The anonymous file-sharing site was open to everybody and made piracy as simple as a Google search. Facts: Grokster, Ltd. and another company, StreamCast Networks Inc, created software that allowed users to share electronic files through a series of peer-to-peer networks on computers without using a central server. This software allowed users to share any type of digital file, but most people used the software to share and distribute copyright music and video files without permission of the copyright holders, which was encouraged by the software companies. As a response a group of movie studies and other copyright holders sued Grokster and StreamCast for the infringement on their copyrights, arguing that the software companies were knowingly and intentionally using their software
With technology so readily available there are many people and companies who have participated in similar illegal activities. The original copyright law did not take into consideration the digital area. By implementing Digital Millennium Copyright Act (DMCA) it has tightened up the protection of things online and in the digital arena.
In the late 1990s, most homes and organizations began to receive Internet access. In correlation, many features became available to Web including the fact that files of any type could be downloaded with ease from any source quickly and often for free. The film and music industries felt that the availability of the Internet was posing a large threat to their business model. It was so easy to obtain a song or even an entire movie clip with a click of a mouse. Software and books could be had for “free” as well. P2P: P2P (Peer-to-peer) is a networking application that partitions tasks or workloads. P2P works once opening its application/app, once opened it will form a peer-to-peer network of modes. P2P violates copyright laws to reproduce and distribute copyrighted music, pictures, software, etc.
First, Online Piracy hurts many people but the most important are the downloaders. People tend to not talk about the fact that not only does it hurt others, it also opens the downloader's computer and sensitive documents to threat. Individuals who engage in this type of piracy can often conduct their entire operation on the Internet, including advertising and sales. Internet piracy has been around for many years now, but seems to be becoming more common with the availability of, and access to, the Internet. It is unclear to many individuals as to whether or not piracy on the Internet is wrong, and the question is a challenging one to answer. In the digitalized the age, people have the ability to easily spread and share knowledge. With this great ability people are also given the tools to infringe upon the intellectual property of others. Whether this be through intentional copyright infringement, plagiarism or any other action that infringes upon the rights of others intellectual property. With so many cases of copyright infringement being brought before the legal system of the United States and other countries the problem of copyright infringement has grown out of control. Legally copyright infringement is a "strict liability" tort, which means that intentions don 't matter, if infringement occurred, then the infringer is liable. Copyright laws being as complex as they are have multiple ways to interpret it, with the United States having “Fair Use” as a vague way of being able to use this content. This ability to use also can lead to the infringement upon others works, whether this is by willfully violating a copyright, just plain ignorance the copyright or not understanding how to comply with a copyright.
In recent years, internet piracy or "file sharing" of copyrighted material has gained much popularity. It is a topic that has incessantly sparked debate and has even received global attention. Although on the surface the act of file sharing may seem harmless, it is far from it.
