In dealing largely with disorderly elements of the society, some people working in law enforcement may gradually develop an attitude or sense of authority over society, particularly under traditional reaction-based policing models; in some cases the police believe that they are above the law. In other cases, police corruption and misconduct may be explained by individuals and individual faults- behavioral, psychological, background factors, and so on.

Police work is a dangerous job, and police are more than likely to be put into situations when excessive force is needed. But, sometimes police use excessive force for their own personal reasons, such as, racism. The issue of police officers using excessive force may or may not be of great concern, but it should be looked into by both the police and the public. Because some officers use excessive force in situations when it is not needed, police brutality should be addressed.

Police have the uncontested right to use force when necessary to apprehend a suspect. If the force exceeds that which is necessary it is defined as excessive force and is illegal. An officer’s discretion on use of force is a based on judgment. They do not know if a judge will later rule an instance of use of force as excessive or not. The use of force is without a doubt an important aspect in policing. The decision to utilize any type of force comes from a multitude of recourses; department policies, training, situational variables and ethical systems. There are three major categories in which an officers use of force is categorized under; justifiable, excessive and deadly; with a thin line between justifiable and excessive. Cases where excessive force has been used, has lead to injuries, deaths, civil damages, officers convicted and sentenced to jail and police chiefs and elected officials being removed from office (Fyfe, 1988). It is an officer`s discretion in determining when the use of force is justifiable.

Sometimes police beatings can be racially based or can happen due to an argument between the officer and the person. The use of excessive force in the law enforcement industry is not tolerated in any form. If a police officer is found guilty in using unnecessary force on a person they will be terminated from their job. Using unnecessary force is one of the more know types of police misconduct being that when excessive force is used on a person there is normally charges pressed on the officer and the case is brought into court and therefore into the media.

The media coverage of excessive force has caused outrage among citizens across the nation. The cases in Ferguson and New York have stirred up major debates about excessive police force and the meaning of justice for all within our judicial system. Protests and riots have ensued in cities across the nation and the cases are affecting us all, whether it is protesters blocking major highways during rush hour, or citizens burning down local businesses out of anger and frustration. Police officers are often seen as a thin blue line of protection between criminals and law-abiding citizens, but when they use excessive force, they cross the line and become criminals. Police brutality damages the image of law enforcement as well as the justice system. It leads to loss of trust in the policemen, which then creates a gap between them and people in the community.

Law enforcement officers are faced with the challenges of using the appropriate amount of force during arrests or apprehensions and are criticized by the public on a daily basis. Not all excessive force is restricted to physical violence; this is where brutality fits in. The reasons for these actions might be explainable, or unacceptable. It may appear that the law enforcement officer is taking advantage of the situation, when in fact they may be following procedure, and in turn can articulate the reasons for taking the excessive actions. Additionally, the lack of proper training or experience in a specific situation may result in the decision to react improperly or against standard operating procedures. Furthermore, the amount of stress that a law enforcement officer is under during the split-second decision to use force may contribute to the actions taken. There may be several contributing factors that lead to an officer using excessive force. Regardless of the reason, the public figure of a law enforcement officer should never use their badge or power to instill fear or intimidation, or conduct themselves unprofessionally.

Although discretion is at all levels of the police department, law enforcement agencies can easily make unlawful decision. Researchers determined that police officers are prohibited from using offensive language or speaking discourteously, abusing their authority, and using unnecessary force (Carroll, Kovath, & Pereira, 2004). Law enforcement officers are expected to respect their community and ensure that all citizens are kept safe.
