There has been many topics of things that are controversial, one of those being “Trying minors as adults”. When it comes to the topic of trying minors as adults it has many pros but as with everything else it comes with its cons. Many people have their own opinions as to what side of the spectrum they are on as to whether its right or wrong to incarcerate a minor. In the following paragraphs below, I will discuss the pros and cons of “Trying Minors as Adults” and if it may or may not influence a minor’s physically and mental development.
When an adult has committed a crime, they must pay the consequences that come with committing a crime. An adult is sentenced for a crime they have committed they must serve their time in a cell that is within a prison or jail. With adults we often say that they are old enough to know the difference between right and wrong when it comes to committed crimes. So, we often find ourselves asking the same questions when it comes to a minor who has committed a crime should the same rules apply to a minor, should they receive the same punishment as an adult because as a society we tend to think that if you are over the age of fourteen you should know right from wrong as well. Juveniles should be tried as adults when they commit serious crimes as opposed to rehabilitation or various forms of lesser sentencing. The rate of juveniles in prison has increased over the years. Many young adults and children often seek for attention which leads them to cause trouble out in the streets. There are risk levels that officers have to make in order to help the juveniles or if committing a serious crime, they should pay the consequences. Many may oppose and think that young adults and children are not adults, but they should be punished for the crimes they have done.
In conclusion I feel that by not trying juveniles as adults it is a better outcome for the child and society. We are also giving the juvenile a second chance at the future that everyone
This seems to be the whole fuss in the criminal justice system when juveniles commit an adult crime. Do they get off and get sent to Juvie? Or are they tried as an adult? How serious was the crime? Did they know what they were doing or how bad the consequences will be? In order to be charged as an adult for a serious crime, I think, they would have to fully understand what they did. They might not have understood fully, or at all, what the consequences of their crime was, but they knew what they were doing. Some say morals are learned, others say we inherit morals at birth, either way, a criminal is a criminal and must be punished as such. Should we punish all juveniles as adults? When it comes to trying juveniles as adults, it is a strong issue to follow through, but it has been a controversial topic to the public. This topic is a controversial topic even considering that there are numerous arguments to put forth on both sides. There will be stated pros and cons of each side and articles to back up the arguments. Juveniles are defined as children who fall under the age of 18, depending on the state. Even though, some juveniles are tried as adults despite their under age.
Throughout the history of the United States more and more teenagers and children have been put in situations where they have been tried as adults.All of these teenagers and children made a mistake which may have been because of their lack of knowledge or their curiosity as a child.
In today's society, there are many crimes going on. Adults are not the only ones that commit crimes. One issue today is that juvenile offenses and whether juvenile offenders should be tried as adults in criminal court. A common phrase that is often used in this case of young juveniles committing crimes is "Old enough to do the crime, old enough to do the time." This phrase should be cleared to people that juveniles are not adults, and with this being said it will not make them one. "It has redefined juvenile offenses by treating most of them as delinquent acts to be adjudicated within a separate juvenile justice system that is theoretically designed to recognize the special needs and immature status of young people and emphasize rehabilitation over punishment" (Steinberg). While juveniles should be responsible for their actions, and should be held accountable for the crime, then the juvenile justice system is design to determine the consequences. Youths are still minors and are less mature. They often face a lot of negative peer pressure. Therefore, juveniles should not be tried in courts as adults.
When a person is charged with a crime, many people don't think that the age of said person is important because in their minds a criminal should be charged according to the law and not according to his or age. I believe that juveniles should not be tried as adults because trying them as adults affects them in ways that it does more harm than good for them and their community. It is being argued if youths should be charged as adults throughout a heinous crime. It is said that kids brain development hasn’t fully grown to it’s full potential such as adults and by that they don’t know from right and wrong. Also, another argument brought up was the age of teens being prosecuted in adult courts. But if you do the crime, shouldn’t you do the time? From my point of view, teens should be prosecuted in the adult justice system.
Court systems are left with difficult decisions. A controversial decision courts are faced with today is whether or not juveniles are to be tried as adults. The increasing number of incarcerated children in adult jails raises questions as to why. Adolescents sentenced to prison are more likely to be abused, commit suicide, or reoffend, thus committing more serious offenses. The statutes requiring juveniles to enter adult prisons are inhumane and in-just. Nevertheless, sentencing children to adult prisons continues regularly today. When adolescents commit crimes, they should be tried as juveniles rather than adults.
Over the last few decades there have been more and more violent crimes committed by children and young adults. Some of these children are under the age of 15, committing violent crimes such as robbery, rape, murder, gang violence. Some of these children are being tried as adults while others are tried and punished as juveniles. A juvenile offender may receive a slap on the wrist being sentenced to house arrest or parole while others are being sent to adult prisons without the possibility of parole. An adult committing these same crimes would receive a more sever sentenced.
One juvenile justice author, Gail Garinger agrees that minors don't deserve on life sentences,cannot be treated in an adult- Justice system, and their minds aren't fully developed compared to an adult’s. Garinger importantly states that “Young people are biologically different from adults. Brain imaging studies reveal that the regions of the adolescent brain responsible for controlling thoughts, actions and emotions are not fully developed.” I agree on Garinger’s statement on comparing a minor’s brain to an adult’s. Due to a minor’s immaturity and lack of irresponsibility are one of the major factors that lead minors to commit terrible mistakes. Thier brain is still in process of development until they reach adulthood which also proven by science. As more minors are committing violent crimes, the question of whether they should be tried as adults has arisen. Children as young as 13 or 14 are committing violent crimes such as murder, rape, and armed robbery. Some of these children are being tried as adults while others are being tried as juveniles and receiving milder punishments. A juvenile offender may receive a few years in a juvenile detention facility and possibly probation following his release at age eighteen.
