We have all sat through multiple history classes and learned about slavery, segregation, and the Civil War. We have all seen brutal movies and presentations based on racial injustices and the lack of equality. So often, we forget that these issues are still so present in our community. Slavery is illegal in the United States but other forms of racial profiling, insensitivity, and racism continue to be a recurring social barrier. Racism is still very much alive. In these cases a lot of people were mistreated and judged. They were discriminated because of the color of their skin. Only because they wanted things to be fair, right, and equal. In the Plessy v. Ferguson case there was discrimination. They ignored and discriminated colored people because they were colored. They wanted to seem like they really cared and let them be able to go the same place they go but the colored people

A lawsuit was filed on March 21, 2016 by Fresno Police Sergeant Cervantes who is suing Fresno Police Department and three other detectives. He states workplace harassment and discrimination due to his Hispanic ethnicity. Further details state, “Sgt. Paul Cervantes accuses Sgt. Tim Tietjen and Detectives Brad Alcorn and Cary Phelps of smearing his reputation with false accusations and spreading rumors that he’s a dirty cop. Tietjen, Alcorn and Phelps are white.”(Lopez, para.2) Such accusations can lead to further tensions, costly legal battles, and government investigations. Sergeant Cervantes seeks unspecified damages, attorney fees for discrimination, retaliation, defamation and malicious prosecution. He also states he has been subjected to such discrimination and harassment since January 2008 to the present. Furthermore, it is not the first time Fresno Police Department has been sued for similar incidences. There is an ongoing problem in the department that needs to be resolve.

Next a case relating to employment difficulties during the Black Civil rights movement was Griggs v. Duke Power Company in the year 1971. The ruling on this case by the Supreme Court was that Duke Power Company was « discriminating against black employees, » because their qualification for employment did « not pertain to applicants ' ability to perform the job,» but rather was influenced by other factors such as race, and therefore they were not hiring people in certain racial

Workplace discrimination takes place when an employee is hostilely discriminated against for one or more reasons, including gender, religion, age, sexual orientation, ethnicity or race. Per the Equal Employment Opportunity Commission, racial discrimination comprises of treating a job candidate or employee negatively because they are of a certain ethnicity or because of particular features linked with their race, such as hair texture, facial features or skin color. On June 29, 2009, the last day of the United States Supreme Court’s 2008–09 term, the Court rendered the much anticipated decision in Ricci v. DeStefano, 129 S. Ct. 2658, 174 L. Ed. 2d 490 (2009). Ricci was quickly dubbed the “white firefighter’s case” by many, however, the case involved much more than the firefighters’ asserted right to a promotion.

The Outcome: The Supreme Court states that segregated schools could never be equal to each other. The Court decided that laws requiring separate schools violated the Fourteenth Amendment. This decision supports that all people are equal. As a student, I am affected because people of different race are welcome to go to school where I go to school.

Further insight into this matter can be obtained through Rosenow’s (2014) research on disparate impact. Disparate impact results when a protected class — race, color, religion, sex or national origin — is impacted in a way that creates a disproportionate effect among the protected group. In addition, liability does not require malicious intent from the employer or knowledge of the occurrence of disparate impact. Therefore, the plaintiff must provide evidence of an employment policy that has an impact on the protected class. After the plaintiff shows prima facie, the employer must provide evidence that the employment policy is a necessary requirement for the business. In Dothard’s case, if the fire department proves the weight lifting requirement is indeed a business necessity then she must prove that the fire department refused an alternative strategy that would have met the business necessity.

Abstract- Racial discrimination happens all the time and most of us are unaware of it. The most common place for this to happen is in the workplace. Now people can be discriminated against because of their race, religion, or any other numerous things. Also, discrimination can occur during the job interview or even after you got the job. This paper will shoe the effects of racial discrimination and how it can be prevented. In addition there are some very important laws that deal specifically with discrimination, like the NAACP or Affirmative Action. These both will be discussed.

Along with this ruling, the Supreme Court appealed this case. It was believed that the plaintiffs in the case needed more proof. The court wanted the plaintiff to show more reasoning why that individual was denied a job based on race, creed, color, or other factors. The Supreme Court also wanted the employer to show the reasoning behind the testing or the requirements of the job. As a result, the case moved closer to disparate treatment. However, in these types of emotional cases proving the case can be tedious.
