To dig deeper into this overrepresentation of black criminality, we have to look at the loophole in the Thirteenth Amendment, which allowed slavery as a form of punishment in the prison system. The policymakers recognized the opportunities to acquire forced labor through mass incarceration and made use of the perpetuating cycle of racial formation, where representations and the actions of the institution often reinforce each other. The structural institution, or the policymakers in this case, used overrepresentation of black criminality to racialize crime. The overrepresentation of racialized crime then validates the need of criminal laws and their unequal application across racial groups. In the end, the institution created the false representation that justifies its actions which further feed the representation. The vicious cycle introduced racial discrimination into the justice system and guided the process of mass incarceration.

This essay will outline how crime theories are able to assist in recognizing the causes of criminal activity, as well as demonstrating two criminological theories to two particular crimes. Overviews of trends, dimensions and victim/offenders characteristics of both crime groups will be specified. Alexander uses this quote to criticize politicians who purport that they want to reinstall “law and order” but vote against bills that fight the antecedents of crimes. This may spark a series of questions in the reader, such as “if their motive is really to reinstall “law and order,” why aren’t trying to eliminate the origin of crimes? Why are they ignoring them instead? Alexander is insinuating that these politicians want minorities in prison, where they can control them, supporting her argument that the government always tries to control minorities. This also supports her argument that the “war on drug” and “law and order” movements represent the new form control system in the United States.

However, it has not always been this way; as only three decades ago our prison population was one eighth of its current size. This unparalleled growth of the prison system has forced America to create a vast prison industry that has become increasingly reliant on private capital. This prison industrial complex has not only turned imprisonment into a profitable business but also reinforced racial disparities in America. The argument that capitalism in this context undermines our democratic values rests of three key points: Firstly, that drug enforcement is racially biased, secondly that private capital has become enmeshed in incarceration industry and thirdly that prison labor is becoming increasingly connected to the United States Economy.

For my analysis, I decided to read the 2006 book Punishment and Inequality in America by author Bruce Western. The book takes a look into the relationship among crime, incarceration, and inequality and what really connects them together. Western shows that although there was a decrease in crime rates about 20 years ago, the reason behind this decrease is not what it may seem and that the decrease may of even come at a significant cost to those effected by the prison boom. Through my analysis, I hope to explore and convey what Western has claimed and examine if his arguments hold truth or not in dealing with our prison systems. On top of this, I will attempt to connect a few theories we as a class have learned about throughout the semester to what Western has has claimed in his book.

Sociological theories of crime contain a great deal of useful information in the understanding of criminal behavior. Sociological theories are very useful in the study of criminal behavior because unlike psychological and biological theories they are mostly macro level theories which attempt to explain rates of crime for a group or an area rather than explaining why an individual committed a crime. The U.S. prison system is one of many great controversies when compared to other correctional systems. America’s prison population has increased by 700% (2.4 million current inmates) since the start of the war on drugs in 1971. As a result of this “war”, people that fall into the racial minority have suffered as a direct consequence of unjust legislation. Our prison system is known for its overrepresentation of minorities such as Blacks and Hispanics. This unfortunately gives these groups of people a perennial negative stigma as a result. I argue that the U.S. prison industrial-complex emphatically displays signs of prejudice and racism and disproportionately incarcerates people of color at a rate higher than whites. Yes, there are skeptics who think “the left’s prison-complex” is wrong about their theory of mass incarceration but the statistical data and concrete facts in support of my argument are very compelling.

Clear (2007) posits that "these policy choices have had well-defined implications for the way prison populations have come to replicate a concentrated occurrence among specified subgroups in the United States population in particular young black men from deprived communities" (p. 49).

The Classical School of criminology is a theory about evolving from a capital punishment type of view to more humane ways of punishing people. Positivist criminology is maintaining the control of human behavior and criminal behavior. They did this through three different categories of Biological studies, which are five methodologies of crime that were mainly focused on biological theories, Psychological theories, which contains four separate theories, and the Sociological theories, which also includes four different methods of explaining why crime exists. Many people have different theories as to why crime exists. Some believe crime happens because of the individual’s culture, education (or lack there of), or even their race. Others believe crime is associated with whom we surround ourselves with. There are three sociological theories that suggest why crime happens in society; they are social learning theory, social control theory, and social reaction (labeling) theory.
