Restorative Recovery In Jail

Parole and reentry are two terms from different ends of the spectrum when describing how prisoners find themselves back in their respective communities after serving a prison sentence behind bars. Reentry is a strategy in which offenders are prepared to return home from prison, and parole is simply a matter of supervision.

There are numerous programs available for inmates who are incarcerated, and the individuals who capitalize on these programs show subsequent improvement after being released. However, these programs only help those prisoners who are willing to change. While incarcerated in the Federal Bureau of Prisons, or BOP, there are numerous programs inmates can take advantage of that will help them in a variety of fields such as, “Education and Vocational Training, English-as-a-Second Language Program, Drug Abuse Education, Sex Offender Treatment Programs – Nonresidential, Skills Programs,” and more (Federal Bureau of Prisons, 2015). On the educational side, the BOP offers a program called the Bureau Literacy Program (Federal Bureau of Prisons, 2015).

Question 1. Both Thomas Mathiesen and Stanley Cohen argue that the alternative criminal justice responses that were presented after the 1970s were not real alternatives (Tabibi, 2015a). With this they are referring to community justice alternatives generally, and Restorative Justice specifically. The argument here is that Restorative Justice cannot be a real alternative because it is finished and is based on the premises of the old system (Mathiesen, 1974). Restorative Justice is not an alternative because it has not solved the issues surrounding the penal system (Tabibi, 2015a). Cohen (1985) supports this sentiment, and suggests that community based alternatives have actually led to a net widening and expansion of the retributive criminal

Is long-term incarceration working to resolve issues of criminal conduct? When considering the population of people incarcerated is rising at an alarming rate and crime statistics not dropping by much, it is hard to tell if incarceration is working in these modern times. The United States prison population is the largest in the world. In fact, the United States has 2.3 million persons in institutions which is more than the rest of the world combined (Wagner p. 2). Additionally, the inmates are being taught to redeem themselves in prison by earning a degree, becoming substance abuse counselors, working outside of the prisons on the highways and streets and they are training dogs for the community to adopt from shelters, but this is not always a sign of being rehabilitated. Prisoners can show a good side to them in the prison, but be a completely different person on the outside of those barbed wire fences. People truly who want to change will, but those that have been in and out of the system are not going to change their behavior or minds. Some parolees will reoffend just to get back into the prison, as it is the only life that they know. Restorative justice is a system of criminal justice that emphasizes the rehabilitation of offenders through mending ties with the victims and the community. A better explanation of restorative justice is a theory of justice that emphasizes repairing the harm caused by criminal behavior. It is best accomplished through cooperative processes that include everyone involved. This can lead to transformation of people, relationships and communities.

Historically mentally ill people would be housed for decades, locked away in a mental institution and often forgotten. This was the solution for what to do with people plagued with a mental disorder that could not mesh with cultural norms. It wasn’t until the failed deinstitutionalization movement that our prisons began to be the catch all for this growing problem. Once the prison system began to overpopulate there birthed the need for alternative solutions for the mentally ill. In fact, in order for there to be a decrease in a 40-year trend of overcrowded prisons there had to be an increase in mental institutions. Society holds expectations for its citizens, and non-citizens at a very high level. They expect everyone to abide by the law, and give back to the community. In a perfect world all citizens and non-citizens would be good Samaritans, sadly it is far from that in today’s society. Many individuals are deviant and stray from society’s expectations of them. We know them as criminals. Indeed some of them may be hardened criminals, yet some of them commit petty crimes that are still a burden on society. Whether, their crime is petty or severe, society expects them to pay for their actions. Most criminals at one time or another will spend time in prison or jail.

There are already existing restorative practices that are place within the conventional criminal justice system at present namely probation, restitution and community service (Zehr, 1990). Admittedly they are not readily termed restorative justice programs however they are grounded in its theory.

Cullen and Gendreau (2000). give us some history on the restorative incarceration. The original theory of restorative justice was based on simple human behavior regulated by incentive instead of punishment, which instituted the concept of parole as a means of reward for a prisoner for rehabilitation. Further studies in criminology proved that this idea was too simplistic and married it to the positivist theory of criminology and instituted individual assessment and treatment for each prisoner based on their specific needs for reformation.

With the rise of Civil Rights Movement in western countries, the circumstances of the criminal victims are getting more attention gradually. Due to this emphasis, it directly led to a first revolution in the criminal justice, the revival Restorative justice. For a criminal justice system, victim support and healing is a priority which might seem an obvious aim. "Restorative Justice" was first introduced by an American professor, Randy Barnett in 1977. Nowadays, restorative justice systems have been applied to criminal justice system in many countries (Tai Wan, Australia, the US and the UK etc). In spite of many researches of restorative justice composed by western scholars, however it has not yet been defined properly and cover over the cons of this system. Restorative Justice repairs the harm that caused by crime and reducing the future harm on victims, there are advantages yet there are also bad. In this essay, I will use the application of the principles of sociology, literature, ethics knowledge to demonstrate argumentation to restorative justice and to reflect the pros and cons. How many inmates were isolated from their communities when they had committed a crime or when they got released from the prisons? And how many effective programs can be helpful for them?Many posts-release prisoners have experienced recidivism and social stigmas due to lack of programs. In fact, restorative justice for people in prison has played a big role in our correctional systems in many different ways.Restorative justice in prison shapes our prisoner 's morals and abilities by providing a suitable technique. Although punishment may play a part in restorative justice techniques, the central focus remains on relationships between the affected parties, and healing reached through a deliberative process guided by those affected parties.( Tsui,2014). For instance, many inmates have attended into reentry programs and educational orientations when they finished their time in prison. These programs cost less money for the government, and inmates can be reintegrated into societies easily. Many post-release prisoners have avoided recidivism after these effective programs taught them the value of lives. This study will examine the importance of restorative justice in prison, which is essential for our correctional facilities. Numerous studies have been done recently which focused on this restorative justice.For example, restorative justice answers the justice question in a different way.(Toews,p.5,2006).

Rehabilitation is more of a therapeutic method to help the criminal ditch crime and become a constructive member in society. “Rehabilitation involves teaching inmates silks and trades that will, hopefully, give them a chance to become law-abiding citizens once they are released from prison” (Long). This method is looked at as more of a treatment than a punishment, to guide the criminal to make better choices and live a better life.
