Same Sex, Same Rights
The sexual preference of people should not determine their acceptance in society. People should be open to understand the union of two individuals of the same sex. The term of marriage has changed over time. What historically was conceived as a man and a woman union should not restrain people from adapting this concept. Many people believe that the marriage between two same-sex couples is not natural. Marriage should be based on love, regardless of sex, color or religion. Marriage is a civil and Constitutional right that grants anyone the right to be happy. Through the laws, they have the power to separate the church from the state. With these on their power, gays and lesbians have enough power to receive the same marriage and legal benefit as heterosexual couples.
Marriage is a constitutional right protected in the United States of America. The right of freedom, pursuit of happiness well defines the search of same sex couples of laws that will allow them to marry. Same sex couples should be able to benefit and be protected in the law equally as heterosexual couples. The fourteenth amendment brings equal rights and protections to all before the law. Same-sex marriage should be marriage because everyone is equal, love is always right, and people have a right to choose their own soulmates. First, equality is a basic right, which means everyone should get the same treatment. The restriction against same-sex marriage is an offense to the dignity of lesbians and gays, because it limits the range of relationship options open to them (Mello). The limit of same-sex marriage is against homosexuals to enjoy the same right as heterosexuals. It is not fair for homosexual to get the different treatment. Like freedom of religion, there should be freedom of marriage. Having the ability to practice whichever region best suits you without someone judging you or without the government saying you have to practice a certain religion is freedom. Not being able to marry someone you love because the government thinks it violates natural law is discrimination. Today’s society has many strong opinions on who people should marry, especially when the couple is same sex. Marriage is a commitment between two people, and overtime homosexuals have been denied their necessary rights as a human. Although gay marriage isn’t approved by many citizens, they have to consider the fact that these individuals are just human beings who yearn for love as well. According to, Bruce Peterson, the institution of marriage has traditionally been between a man and a woman. Also, with the marriage of a man and a woman, it will involve the procreation and rearing of children within a family. Despite the fact that same sex love may appear out of the norm, our world has tremendously evolved into a new era where many new beliefs exist. The “traditional marriage” from back then, does not accurately apply to today’s changes and others have to accept it whether they like or not. In addition, modern and ancient times of family arrangements based on polygamy, communal child rearing, & the use of concubines and mistress, heterosexual monogamy can be considered as unnatural in evolutionary terms (Douthat). This meant that back in the old days a man or woman could obtain multiple spouses at the same time. Love is love and it should be given to everyone. The government should not have to right to interfere with personal issues that involves one’s belief. Every human being is capable of having their own set of values that should never be taken away stated in the Constitution.
Same sex marriage has been widely looked down upon for ages. People say, “It’s not the traditional constitutional marriage”, or “Children need a mother and a father”. It honestly doesn’t matter. If two people love each other, they should be allowed to marry. It’s just as simple as that. What other reason do you need? Judge Sarah Zabel of Miami-Dade Circuit Court ruled the gay marriage ban of Florida unconstitutional. She stated that it, “serves only to hurt, to discriminate, to deprive same-sex couples and their families of equal dignity, to label and treat them as 2nd class citizens, and to deem them unworthy of participation in one of the fundamental institutions of our society.” In other words, you’re looking down upon same sex couples that want to get married as if they’re lower than you; that they don’t deserve the same rights as us. Same sex couples would be able to enjoy the same benefits as heterosexual couples if they were able to be married.Furthermore, the General Accounting Office made an assessment in 2004 about the benefits that heterosexual married couples have that same sex couples could not. Some of these benefits include hospital visitation during an illness and the option of filing a joint tax return to reduce a tax burden. As stated directly in the Constitution, “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof…” This means that one cannot be discriminated on the basis of religion. In recent years, religious rights and gay rights have become tied together due to the fact that some feel sexual orientation ties into religious beliefs. There are some people who are in agree with same-sex marriage, while there are some that oppose it. It is stated that in The Atlantic article that, “In certain cases, extending new rights to LBGT workers will necessarily lead to religious-freedom objections, and vice versa.” No matter what side you agree with in the controversy of same-sex marriages, it is important to remember that the Constitution states, “all men are created equal”, therefore we must handle this controversy in a way that everyone is treated equaled in the eyes of the law.
There is a constitutional right to life, liberty, and the pursuit of happiness. It would be unconstitutional to criminalize same-sex marriage, or any marriage, regardless of gender, or sexual orientation. Criminalizing same-sex marriage is unacceptable due to it being discriminatory. It violates the civil rights of homosexual people by not allowing them to pursue their happiness. The concept of marriage is in danger of being misunderstood due to same-sex couples wanting to be married and acquire the same benefits as heterosexual marriages. The fundamental purpose of marriage is uniting a man and a woman in a worthy cause to preserve human civilization. If everyone was homosexual, then how could our species be repeatedly produced? This problem could end human existence. Besides, even those who are not homosexual have restrictions on marriage so they can not assume they are being discriminated upon. Restrictions are created to keep the balance and concept of the idea from being muddled. Their sexual orientation has nothing to do with why these rules were put into place. As a result, homosexual individuals have the right to marry along with everyone else as long as the restrictions are not crossed. People are born homosexual. If you are homosexual you cannot get married. That idea is ridiculous. On June 26, 2015, the US Supreme Court ruled that the US Constitution guarantees the right for same-sex couples to marry. Marriage is defined as a sacred bond of love between two people. Gay people also feel love therefore, they should be allowed the same rights as everyone else in this country. Homosexuality is an accepted lifestyle nowadays with a proven biological causation. The only thing that should matter in marriage is love and denying them this is a violation of religious freedom.
