In May of 1787, representatives from all the states, excluding Rhode Island, gathered together in Philadelphia for a Constitutional Convention. They were faced with the task of writing a new constitution, since the Articles of Confederation weren’t working. They had to create a government that protected against tyranny, when too much power is in an individual or groups hands, and that would work for everyone in the states. So they came up with a constitution that guarded against tyranny by separating power between the federal and states governments, separating the federal government into three different branches, creating checks and balances for the branches, and having a bicameral legislature.

They felt the Articles were too weak and went into this meeting with the intention of only changing a couple of things on the regarding America’s protection against a dictatorship. What keeps the U.S. government from becoming a tyranny? The things that keep the government from becoming a tyranny are the use of federalism, separation of powers, and a system of checks and balances. Federalism is where the national or central government is stronger than the state and local government, The separation of powers is where the power is split between three branches, and the system of checks and balances limits the one of the three branches from becoming too powerful.

Legislative: Our Legislative branch will be bicameral with two houses, the House of Representatives and the house of Senate. We are keeping both houses, that way we can separate the workload. We will have a total of 400 people in both houses. The people would be represented by direct election. People will also be allowed to give the government ideas about laws. In order for a law to be passed both houses have to agree on it as well as the President. Having more opinions on the laws should help determine if the law should be passed or not. The President from the executive branch can request for the law to be denied if both houses agree.The executive and judicial branches also have the power to change a law in a way that seems better for them and the country.

Representation in the House would be based on population which was called proportional representation, and each state had two seats in the Senate, which was equal representation. The office of the president would constitute the executive authority and was to be chosen by the Electoral College. Because of checks and balances, none of the branches become more powerful than another. Each branch “checks” the other branches to regulate the power and make sure it is balanced.
