1. The measure of a great society is the ability of its citizens to tolerate the viewpoints of those with whom they disagree. As Voltaire once said, “I may disagree with what you have to say, but I will defend to the death your right to say it” (Columbia). This right to express one's opinion can be characterized as “freedom of speech.” The concept of “freedom of speech” is a Constitutional right in the United States, guaranteed under the First Amendment to the Constitution:

America’s first president George Washington once argued at the [whenever he said this] that “If the freedom of speech is taken away then dumb and silent we may be led, like sheep to the slaughter.” It is an essential component to the daily life of any constitutional republic, such as that of the United States even though it is a right granted to all American citizens, in the past, freedom of speech has been abridged to accommodate political correctness, to prevent disruptive behavior that could negatively affect others, and to protect confidential military information.

When the Framers of the Constitution met in Philadelphia, they came together with one common purpose in mind. They needed to form a fair and solid system of government that would stand the test of time; one that was both fair for the people and would not involve a monarchy. Each of these men had their own ideas on what would constitute this system, however, so many compromises had to be made. The creation of the US constitution was prompted my many different things going on. What established America’s national government and fundamental laws is the U.S constitution. It also guarantees basic rights for its citizens. The U.S constitution was signed on September 17, 1787 in Philadelphia, Pa. The first document before the U.S constitution was the Articles of Confederation, with that the government wasn’t very strong and the states didn’t act like they do today. In 1787, at the 1787 convention, delegates made a decision to make a stronger federal government that consisted of the executive, legislative, and the judicial branches. That wasn’t it either, it also had a system of checks and balances because they did not want one branch to be able to overpower another branch. The ten amendments of the Bill of Rights guarantees protections for people like religion and freedom of speech. In total, there are twenty-seven constitutional amendments.

In the United States of America, the First Amendment of the Constitution assures individuals such civil liberties as the freedom of religion, speech, press, assembly, and petition. Freedom of speech preserves not only an individual’s right to vocally express themselves unabridged, it also allows them the right to burn the American flag, engage in silent protest, and more recently (2016), get a tattoo. In some respects, freedom of speech has come to mean the freedom of communication.

Federalism is a system of government in which entities such as states or provinces share power with a national government. During the creation of the constitution the Framers questioned where powers should lie in these separate entities; The Framers however didn’t want to make the mistake of centralized power so they used the system that utilized checks and balances. They created a that system Charles de Montesquieu called the idea of dividing government power into three branches the "separation of powers." He believed it was most important to create separate branches of government with equal but different powers. In the framework, it became clear that they framers wanted preserve liberty with usage of dividing power among state and government.

In order to understand the motivation of the Framers of the U.S. Constitution one must review the event leading up to it. When the war with Great Britain finally came to a close, the Colonialist of America became weary of what was to come. Many who were well versed in Tomas Hobbes and John Locke feared, without proper action and if not too long delayed, the that states would find themselves in a State of Nature.

When the Framers were writing the constitution which they knew would govern the United States of America to the country it is today, they were pretty clear that they didn’t want any of the three branches of government to become corrupted or overpowered. To keep the balance of power uncorrupted, the Framers decided to give each branch of government, Executive, Legislative, and Judicial, power to keep each other in check, with a system of checks and balances. Each branch of government has many of these powers, but within the vast writings of the constitution, each branch has one which is key to keeping the United States a stable nation. It has been our desire since the infancy of our nation to create the most uniquely successful geographical brotherhood that had ever been witnessed. This began with the “city on a hill”, was fueled by the American Revolution, but was culminated by the United States Constitution. Certain interests do not change over time in our society. Over 200 years ago, the prominent concern that led to the framing of the Constitution regarded the establishment of a government that was “for the people and by the people.” The framers of the Constitution, with concern of an over powering central government in mind, provided a basis for the structure of the federal government of the United States. The powers of the legislative, executive, and judicial branches of government are laid out strategically in a way that no one branch can have more power than the other. The national concern of maintaining a legitimate government has not shifted since the initial days of the framers. Although the capacity of the government has grown over time, the system of checks and balances that was adapted in the framing of the Constitution allows for the structure and powers of the federal government to remain in order today. Other than providing a structural map for how the government will operate, however, the additional aspects of the Constitution fail to administer practical framework for addressing 21st century interests. This document was written over 200 years ago and it has not been altered substantially since then (Lazare). While certain Amendments have been added to assist the Constitution in staying relevant, such as the abolishment of slavery and the addition of women’s right to vote, there has been practically nothing added to help in applying the framers’ intentions
