The FTC Needs To Increases Their Search on False Advertisement
The FTC needs to increase their inspections on advertising and help other countries crack down on their own. For many years people have been suing companies for misleading them with false advertising.
One way reason the FTC need to increase inspection on advertising is consumers are exposed to incorrect information. In the lawsuit against Kashi, they were being sued for calling their products all natural or no artificial. Yet after inspection of their products, they were filled with nothing but “bio-engineered, artificial, and synthetic ingredients” (Kashi). There is also a case against Nutella for doing the same thing. After Nutella advertisement stated that Nutella spread was part of a healthy breakfast, a consumer was shocked to find out that Nutella contained twenty-one grams of sugar, 200 calories, and eleven grams of fat, of which three-point-five are saturated, per serving. After comparing the nutritional values to a candy bar, she concluded Nutella is far from a “healthy ' 'nutritious food but instead was the next best thing to a candy bar” (Nutella). In 2008 and 2009, Kellogg’s claimed that Mini-Wheats could a improve childs’ attentiveness, memory, and other cognitive functions, but the sugary cereal doesn’t really have any of those positive effects. In 2009, the food corporation claimed that Mini-Wheats were “clinically shown to improve kids’ attentiveness by eleven percent” (Kellogg). Because of that
Most people desire to consume only what satisfies their taste buds, which is mainly foods and beverages that contain high levels of unhealthy ingredients, but they do not realize the harm it causes to their health. General Mills conducted an experiment in order to see how consumers would react when they had the option to buy healthy products or foods that tasted good: “General Mills, he said, acted responsibly to both the public and shareholders by offering products to satisfy dieters and other concerned shoppers, from low sugar to added whole grains. But most often, he said, people bought what they liked, and they liked what tasted good” (Moss 476). Companies of course need to keep their businesses running and in order to do that, they must manufacture
With having true genuine intentions in eating healthy people fall into the ideas advertised by cooperation’s that their products are healthy. Food corporations protect themselves through ingredient secrecy and even through the FDA because they are not required by law to disclose their ingredients; however, the chemicals used need to be considered by the FDA to be Generally Regarded As Safe (Schlosser 25). People should take responsibility in the research of the food products they consume; therefore, allowing an individual to be wise and informed of what their really consuming. Maybe, instead of cutting corners in trying to eat healthy with false idealistic advertisement consumers should consider eating fresh fruits, vegetables, and cooking ingredients. Consumers should like the author Pollan suggested in his rules of thumb: avoid food products unfamiliar, unpronounceable ingredients, and products containing more than five ingredients (Pollan
The Federal Trade Commission(FTC) was created in 1914. It was created to ensure that there were no businesses that were anticompetitive; meaning that there wasn’t one company or business that was creating a monopoly. The FTC has three main goals; they are to protect consumers, maintain competition, and advance performance. They protect the consumers by preventing fraud and making sure businesses are fair in the marketplace. They maintain competition by preventing companies from merging together and creating a monopoly. Finally, they advance performance by advancing the FTC’s performance through organizational, personal, and management excellence. The FTC is very beneficial, and although not everybody knows about it, as a consumer it helps with the economy of every American. Throughout the years since it was created, there has been more laws added that help keep businesses
The Federal Trade Commission enforces these truth-in-advertising laws, and it applies the same standards no matter where an advertisement appears – in newspapers and magazines, online, in the mail, or on billboards or buses.” The Federal Trade Commission does not have one clear definition, but it does explain that companies and services are not allowed to exaggerate their content or images in order to advertise to their consumers to purchase a specific product or service. Again, these advertisements can be seen throughout the media as well as in the public.
The paper will serve as a historical background overview of how the Federal Trade Commission Act (FTC) came into existence. The paper will also break down the key components for which the FTC covers, such as deceptive advertising, baiting and switching and consumer fraud. There will be examples
In the United States, The FTC (federal Trade Commission) has the authority to impose penalty against advertisers whom violate Federal Standards for truthful advertising. The FTC considers a message to be deceptive, if they include statements that are likely to mislead reasonable customers and the statements that are likely to mislead reasonable customers and the statements are an important part of purchasing decision. A failure to include important information are also considered deceptive. Also, the FTC also looks at so-called “implied claims,?” Claims that you don’t explicitly make but that can be inferred from what you do or don’t say.
What is the FTC? The FTC stands for Federal Trade Commission. The Federal Trade Commission is an independent federal agency created by Congress in 1914 to help prevent unfair business practices, deception, fair trade practices, and unfair competition. The FTC’s mission is to protect the consumers by enacting laws to ensure that businesses cannot cheat people out of money and keep businesses from being unethical and immoral. The FTC takes complaints about businesses and investigates them for fraud or unfair labor practices every year (Silbersack, 2013).
But companies don’t care to show it, as long as there is still people paying for their products, so they keep on making us believe that what we eat is not so bad for our health. This takes very strategic marketing and we need to learn how to analyze labels and really think if what we eat straight out of a package is better than a fruit or a salad.
The Federal Trade Commission (FTC) was created in 1914 primarily as a way for the government to “trust bust” or apply regulations ensuring a free marketplace for U.S. consumers and business enterprises. In this regard, the FTC enforces antitrust viola- tions that could hamper consumer interests, as well as federal consumer protection laws against fraud, deception, and unfair business practices. The commission’s primary enforcement mechanism is the Bureau of Consumer Protection, which is divided into seven divisions: (1) enforcement, (2) advertising practices, (3) financial practices, (4) marketing practices, (5) planning and information, (6) consumer and business educa- tion programs, and (7) privacy and identity protection.21 As the federal
However believe it or not that’s not always true. Most big name companies try to portray the positives of the product in the advertisement, and in marketing perspective that’s the whole major point. But the public deserves to know the negative part of the product also. For example Gatorade, a hydration drinks which is meant for activities and sports. But declared by science, any hydration drinks are not meant to be taken alone, should be taken with water mainly. Why isn’t the public notified about this information? It’s only because Corporations want investment. They are all looking for profits no matter what the advertisement says. Stated by Naomi Klein in her No Logo, “…with the Kraft purchase, a huge dollar value had been assigned to something that had previously been abstract and unquantifiable — a brand name. This was spectacular news for the ad world, which was now able to make the claim that advertising spending was more than just a sales strategy: it was an investment in cold hard equity. The more you spend, the more your company is worth”. (8) And this idea has grown so much during our generation that we don’t stop and think how much it really is taking over our lives.
Foods that are genetically engineered should not be falsely advertised as natural because they are anything but. According to Anahad O’Connor, some food companies are telling the public that their food is natural, but the term natural is loosely defined in the food industry. Those food companies wrongly advertising that their product is all natural however, those who think that natural food is that without pesticides, hormones, artificial ingredients, and GMO are sadly mistaken. And even though many lawsuits have been filed and the courts have requested the F.D.A. define and set regulations for what the word natural means, they have declined saying it would cause too many issues and take too much time to pass. I believe the F.D.A. should include
Coca-cola was previously being sued by individuals along with Pepsi and Dr. Pepper. These companies are being sued for their “diet” soda products. People are claiming that drinking these diet products aren’t aiding their diets and that the companies are unlawfully claiming that they should be a healthy option. Attorneys in this case say that the “diet” beverage is one of the biggest consumer scams ever. However according to the FDA, labeling that the soda is diet is different than making a health claim that it would help with your diet. The companies didn’t make a health claim because they knew they would have to prove that the drink actually is a low calorie drink that meets the standards of the FDA. The companies label it a “diet” drink
The food industry has cleverly manipulated millions of people's minds for the simple reason, money. They persuade you to purchase their products which benefits for them since they derive more money. An article from the Business Insider “This One Statistic Shows Just How Much McDonald's Tries To Entrench Itself In Everybody's Minds” written by Kim Bhasin, he writes how “McDonald's is the brand that spends the most on ads, racking up $963 million in ad spend last year.” This shows that this major industry would endeavor to that extent into spending that much money per year. According to the article “How Much do Companies Spend Marketing Junk Food to Children?” by Andrea Canada, she writes about how “Companies spend $1.79 billion annually to market food to children with only $280 million for healthy foods.” With this it shows that it’s not only McDonald’s that spend so much money to advertise unhealthy foods but other companies as well. Lastly, even if there are advertisements for healthier food, they aren’t promoted as much
Throughout the years, there has been an incredible amount of speculation as to what ingredients are being put into the food we consume. The same food manufactured by major food corporations that can only be approved by the FDA. There are many techniques that these food corporations can use in order to gain consumer loyalty, but the main focus is the way their advertising works. Along with these advertisements, comes a target market as well. The food industry is constantly in speculation because there are always new foods that corporations want approved to sell. Some of these businesses are part of the fast food industry and others are international food companies that sell their products around the world. As adults and parents, we need to
When one turns on the television, food commercials will always appear trying to convince the consumers that their products are incredibly tasty and cheap, but why is it that all food companies do this to persuade consumers ? Throughout the last decade, the food industry has increased at a speed never seen before however, at the same time obesity rate has gone up. Now, this problem has gotten out of proportion and yet instead of trying to fix it, there is others that only point fingers without them realizing that there is three fingers pointing back at them. With this said, Americans and the food industry should work together for them not to permit any
