The Purpose Of The Correctional System

The American Criminal Justice System are sets of agencies and process made by the government to control crime and to penalize those who commit it. The justice system is different based one’s jurisdiction, meaning city, state, federal or tribal government or military installation. The Criminal System is divided into two main parts, the state and the federal. The state portion handles crimes within its state boundaries. The federal portion handles crime committed on Federal property or in two or more states (“Criminal Justice” 1). The American Criminal Justice System needs reform because of its emphasizes on incarceration punishment rather than Rehabilitation. Our justice system especially enforces punishment on blacks and Latinos resulting of overpopulation of prisons like Rikers Island for petty crimes. Also, another reform needed the juvenile cases. For example, juveniles who commit petty crimes shouldn’t be sent to adult prison and shouldn’t be near more dangerous and serious inmates.

We can date the United States criminal justice policies all the way back to the 17th Century. Although it is nothing compared to what we have today, there have been improvements along the way. One of the major reform needed in our corrections system are the war on drugs and overcrowded prison. The history of corrections in the U.S. has been seen through four major eras known as the Penitentiary, Reformatory, Reintegration, and Retributive Era. Each era has tried to explore the best way to deal with people who have broken the law. Based on the ideas of each era, we’ll explore which reform needs to be implemented.

In, “The Caging of America”, by Adam Gopnik explains the problems in the in the American criminal justice system focusing more on the prison system. Some of the struggles that Gopnik states in his article are mass incarceration, crime rate, and judges giving long inappropriate sentencings to those with minor crimes. He demonstrates that inmates are getting treated poorly than helping them learn from their actions. Using facts and statistics, Gopnik makes his audience realize that there is an urgent need of change in the American prison system. The main idea of Gopnik’s article is that the prison system needs to improve its sentencing laws because prisons are getting over crowed. Gopnik’s argument is valid because there is a problem in the sentencing laws that has caused a malfunction in the prison system as a whole.

The correctional system has three main goals: punish, protect the community and rehabilitate the offender. However, it is unclear how well the modern U.S correctional system achieves these goals and whether the money invested in the correctional system might be better spent. These are some of the points I will cover regarding what I think about the correctional system.

Corrections have existed throughout society for many years and continued to change and evolve in the United States reflecting society’s values and ideals throughout the centuries. Part 1 of the book highlights chapter 1 and 2, which talks about politics and the consequences of incarceration while chapter 2 talks about the politics of being punished within the united states, some sub topics between chapter 1 and 2 include problem ownership, philosophies, historic changes with the corrections policy throughout time and the economic impact of being incarcerated. Chapter 2 talks about the process in which politics can affect the outcome on crime and punishment, throughout the 1960s the criminal justice system has changed a lot especially correctional professionals who have brought issues to crime and its political forefront.

When we think about prisons, jails, and courthouses, our minds are meant to draw a connection to cold, hard, justice and fair punishments for guilty and deserving parties. Yet, in our judicial and prison systems around the world, this idea is nowhere close to reality. From inhumane punishments, to mass incarceration, and “trapping” people in the system based on race or financial status, justice is far from being served.

I am going to focus on one of these subjects and the problems or issues that are within the corrections part of criminal justice usually refers to the events that occur after being sentenced in a court of law. We have one of the world’s largest prison population, but also a very high rate of recidivism. Recidivism is when the prisoners continuously return to prison without being reformed. They return for the same things that they were doing before. So, this leads us to ask what exactly are we doing wrong? When this happens, we as a nation must continuously pay to house and feed these inmates. The purpose of a prison needs to be examined so we can decide if we really are reforming our inmates, or just continuing a vicious cycle. With the population of the United States prisons growing every day we need to evaluate if they are doing any good. Personally, I believe that we need to keep our prison system, but we need to take steps in reforming them rather than abolish them altogether. The United States has the highest number of incarcerated people than any other country in the world. We must sit down and look at other countries and see what they are doing different than the United States. In this paper, we will first look at what the prison system in America is like and what we can do to improve upon our prison system. Then, we will also look at the Finland prison systems and see if we can learn anything from them, since they have one of the lowest incarceration and crime rate in the world. We will then look at reforming our prison system or abolishing it. Finally, we will investigate other punishment alternatives other than the prison system that we could use.

With the exception of probation, imprisonment has been the main form of punishment for serious offenders in the United States for over 200 years. Americans can be said to have invented modern incarceration as a means of criminal punishment. Although Europe provided precedents, theoretical justifications, and even architectural plans for imprisoning offenders, Americans developed the blueprints for the typical prisons of today and devised the disciplinary routines, types of sentences, and programs that prison systems of other countries subsequently adopted or modified (Rafter & Stanley 1999).

There many different criminal justice systems in the world today. Some that consists of many of the same policies and some that are considerably different. In the case of France and the U.S. there are a lot of similarities, but I will be focusing on the differences between each of their systems. The aspects that I will be comparing are police, courts, the legal profession, legal education, criminal procedural law, corrections, and juvenile justice and the advantages and disadvantages of each.
