Solitary confinement is a mandated arrangement set up by courts or prisons which seek to punish inmates by the use of isolated confinement. Specifically, solitary confinement can be defined as confinement in which inmates that are held in a single cell for up to twenty-three hours a day without any contact with the exception of prison staff (Shalev, 2011). There are several other terms which refer to solitary confinement such as, administrative segregation, supermax facilities (this is due to the fact that supermax facilities only have solitary confinement), the hotbox, the hole, and the security housing unit (SHU). Solitary confinement is a place where most inmates would prefer not to go.

Throughout the years, the use of imprisonment has varied, along with its influences of society. It is thought that although prisons have been around since the thirteenth century, prisons as we know them now to be have only been around for the last three centuries. The first uses of prisons were not seen as a form of punishment instead they were used as a way of making people do something. People would be held in prison until they paid their debts, or awaiting trial and then leading up to their sentence. McGowen (1995) suggests that from the early 1700s ‘bridewells’ a house of correction have existed, however at that time being used merely for vagrants and drunks. At the end of the sixteenth century there was a shift in punishment to imprisonment, along with this came a new, more humane idea of reform. Criminals would spend their days of prison carrying out hard labour. However after the American Revolution, imprisonment took a step back and there was another change. There was mass overcrowding within the prison service and although the death penalty was still being used it was a symbol of the power of the state. Therefore, an everyday way of dealing with offenders would be transportation to the colonies, being either Australia or America.

Prisons hide prisoners from society. “If an inmate population is shut in, the free community is shut out, and the vision of men held in custody is, in part, prevented from arising to prick the conscience of those who abide by the social rules” (Sykes, 1958, 8). Prison is an important place, because it takes away the power from individuals. This means that the criminal is no longer acting upon his will, but that of the officers, judge, guards, etc. “They are the foundation of society, and an element in its equilibrium.” (215) All the techniques, when created, they “attained a level at which formation of knowledge and the increase of power regularly reinforce the other.” (216)

This report card bring up the issue on prenatal care, shackling, prison nurseries, and family based treatment as an alternative to incarceration however in this paper I will focus on the restraints on these pregnant inmates. New Jersey received a grade of D for shackling policies. Besides New Jersey thirty-seven other states obtain a D/F for their failure to comprehensively limit, or limit at all, the use of restraints on pregnant women transportation, labor, delivery, and postpartum recuperation (National Women’s Law Center, 2010). The use of restraints can compromise the health and safety of the women and the unborn child. Shackling pregnant women is dangerous and inhumane; women prisoners are still routinely shackled during pregnancy and childbirth. The reason these women are shackled is for safety and security, despite the fact that shackling pregnant women is degrading, unnecessary and a violation of human rights some state still condone this practice.

In prisons today, rehabilitation, deterrence, incapacitation, and retribution are all elements that provide a justice to society. Prisons effectively do their part in seeing that one if not more of these elements are met and successfully done. If it were not for these elements, than what would a prison be good for? It is highly debated upon whether or not these elements are done properly. It is a fact that these are and a fact that throughout the remainder of time these will be a successful part of prison life.

Solitary Confinement has been used as a punishment, to keep the prisons secure. However, with the changing of opinions from a few decades ago, to present time, more people want less solitary confinement used. With also corrections policies changing over time has also changed the dynamic of how a younger person could be charged and sentenced, compared to an older person who is not a juvenile could be put into solitary confinement. These punishments or correctional aspects have done a great deal to the effects upon the prisoners. For the punishment of solitary confinement, this can go both ways. In one way if you put an individual in confinement they have time to think about the crime that they have committed and can give a good hard look at their life. Then on the other hand if you put someone in confinement where there is no noise, no light, and nothing to do this person can go mentally insane. When it began it was for the hardest criminals it has changed now a days to you get confinement for doing another crime in prison, being a disturbance, and/or refusing to do a request for the guards such as take a sheet off you window so they are able to see in on what you are doing, that way they can tell if you are okay or trying to do something illegal in prison. This would include drugs, wine, shanks, etc. also they are able to tell your mental state, if you are in imminent danger from yourself.

American prison system incarceration was not officially used as the main form of punishment in United States (U.S.) until around the 1800’s. Before that time criminals were mainly punished by public shaming, which involved punishments such as being whipped, or branded (HL, 2015). In fact, President Lincoln codified the prison incarceration system in the Emancipation Proclamation that indicated no slavery would take place in America unless a person was duly convicted of a crime (paraphrased) (White, 2015). In this era prisons were used more as a place where criminals could be detained until their trial date if afforded such an opportunity. However, one of the main problems with this idea was the fact that the prisons were badly maintained, which resulted in many people contracting fatal diseases. Yet, according to White (2015) unethical and immoral medical experiments were also conducted on inmates’ leading to health failures. Moreover, because everyone was detained in the same prisons, adolescent offenders would have to share the same living space with adult felons, which became another serious problem in that adolescent were less mature and could not protect themselves in such environments

Does solitary confinement cause severe mental issues? Are the mentally ill allowed to be put in solitary confinement? How bad can the mental issues possibly get if you don’t have a mental issue before being put in solitary confinement? All of these are questions some people ask, but really don’t care enough to dig deeper. What if your loved one or even you were to be put in solitary confinement? Wouldn’t you want to know what it was, wouldn’t you want to know what the affects of this punishment are?

Since the early 1800s, the United States has relied on a method of punishment barely known to any other country, solitary confinement (Cole). Despite this method once being thought of as the breakthrough in the prison system, history has proved differently. Solitary confinement was once used in a short period of time to fix a prisoners behavior, but is now used as a long term method that shows to prove absolutely nothing. Spending 22-24 hours a day in a small room containing practically nothing has proved to fix nothing in a person except further insanity. One cannot rid himself of insanity in a room that causes them to go insane. Solitary confinement is a flawed and unnecessary method of punishment that should be prohibited in the prison

It was in a brainstorming situation that I discovered the topic of discussion I wanted to hear a convincing opposition against. I knew that choosing something more controversial would garner a greater opposition, but at the same time, I wanted to avoid topics that seemed almost too commonplace in assignments like this. With that in mind, I decided to hear out the opposition against my view of the inhumanity of solitary confinement. The person with whom I discussed, who will be referred to as Person X for the purposes of this write-up, believed that in certain situations, solitary confinement was a just punishment. We had this discussion waiting for our Microbiology class to begin. Bringing up random topics of discussion is not something unusual within the scope of my character, and so rather than wait for an opportunity that would not present itself, I simply asked Person X for his/her opinion on solitary confinement as a justified punishment for convicted criminals. To give the discussion some direction and so that I could better understand Person X’s point of view I asked some questions. The two most important I found being: “Why do you feel that it’s okay to punish people like that in some cases but not in others?” and “How long is too long?”.
