The case of 40-year-old Vincent Li, an individual who stabbed and decapitated a young man named Tim McLean with a large bladed weapon on the Greyhound Bus in Manitoba. After taking the life of McLean, Li then ate parts of McLean lifeless body. Li was diagnosed with untreated schizophrenia. The court deemed him to be not criminally responsible for his murder. NCR for short, means that Vincent Li or anyone who is not of healthy mind are not responsible for his/her actions against the law. For one to be considered NCRMD, we must take a look at the psychological state of Li at the time of his crime. NCRMD is considered a sentence for those who stand on trial. It is section 16 of the criminal code stated one is not held criminal responsible if they were suffering from a mental disorder that cause them to be incapable of understanding the nature of their horrific act. They are not of the right mind to truly commit the act (actus reus), and they did not possess the guilty mind (mens rea) of a criminal. The process that led up this sentence is that Li’s lawyer had to convince the court that Li is suffering from a mental disorder. This is called the defense of insanity. The defense lawyer’s main point is to present fact to indicate that Li suffered from a mental disorder called schizophrenia. One of the symptoms of schizophrenia is delusions, and in Li’s case it was a delusions of grandeur, this meant that a person believed he was an important figure of the world. This is shown when Li stated that he was the second coming of Christ, and through his hallucination he believed he heard God’s voice who guided him into killing McLean (CBC, 2012). Li also had delusions of persecution which ties in with his hallucination as he believed that McLean was an alien and that McLean was out to get everyone and God commanded him to prevent innocent people from getting hurt. These symptoms are a clear sign of Li having schizophrenia, a mental disorder that can alter one’s perception of the world in a horrific manner. Li who is now of clearer mind knows what he did was wrong and that he should be killed. It is shown that people who suffer from schizophrenia is likely to commit a crime (Robertson, Swanson, Frishman, Lin & Swartz 2014). This indicated there are many others who is going through the same suffering that Li is going through. It is not the fault of
In the case of Wong Sun v United States, in consideration of the fruit of the poisonous tree doctrine the Court excluded the admission of evidence in the trial court due to the violation of defendant’s Fourth Amendment Rights when the derivative evidence was obtained. Therefore, in this essay, I am going to discuss if the exclusion of evidence contributes in an important way of supporting the guarantees of the Fourth Amendment or should the derivative evidence be admitted because police officers could not have anticipated the discovery of derivative evidence.
Frank Addante got his motivation to work from financing his college life in the first years. He worked on his own, sold and installed car alarms and automatic starters. From this time on he continued to earn money through ad-hoc jobs to make his way through college, but he was always conscious for good ideas, which he could transform into businesses. This chance was given when he installed some high-speed communication lines for an office where two mar-keting companies had their headquarters. When the owners of the two companies were argu-ing about any new ideas, they came up with a “search engine” for the internet. Addante was listening to them and came up with his own interpretation of the “search
On January 13th of 1999, a 17 year old Korean girl by the name of Hae Min Lee when missing after school in Baltimore, Maryland. Lee’s body was discovered in Leakin park; three weeks later in a shallow grave. The police arrested and charged Lee’s ex-boyfriend Adnan Syed with the murder six weeks later. The police alleged Syed because of phone records they obtained also their only witness Jay Wilds. In the murder case of Hae Min Lee, Adnan Syed should not have been convicted. Syed should not have been convicted on the account of Syed has no history of violence, the single witness in the case has major inconsistencies in his story about the events that occurred, and the lack of evidence that firmly connects Syed to the murder.
In the Spring of 1984, May 23rd, felling like San Antonio v. Rodriguez was an unacceptable decision, the Mexican American Legal Defense and Educational Fund filed a suit against William Kirby, the commissioner of education, in behalf of the Edgewood Independent School District. MALDEF’s main concern was the way Texas funds public school, they pointed out the fact that he poorest districts in the state, had $38,854 in property wealth per student, while the Alamo Heights ISD, which is in the same county, had $570,109 per student. (TSHA, 2017) Furthermore, property-poor districts had a higher set tax rate that would amount to an average 74.5 cents per $100 a valuation to generate $2,987 per pupil, while richer districts, with a tax rate of half
The man Vince Li, killed another man named Tim McLean however he was not convicted for this murder. He was found not criminal responsible for the crime. The reason for this is because they deemed him to have a mental illness. The symptoms Vince Li displayed was that he heard the voice of God, and that God told him that he is the second coming of Jesus. Also, he believed that he must prepare rescue himself from and upcoming alien invasion and that McLean was an alien. These are symptoms which lead to the mental disorder schizophrenia, this is what cause him to be found NCR for the murder. The key issue to this controversial case is the fact someone died and it would increase the negative perception of mental illness. Another issue is diagnosing
In 1996, Tony Van Carrutherswas convicted of three counts of first degree murder and continues to say he was framed. Charles Steines was a 9th grade high school student living in Kentucky while attending the Summit Country Day School in Cincinnati, Ohio because of specific diagnosed learning disabilities. Steines initiated a claim arguing against the determination by the athletic association of Ohio’s school district that Steines was not qualified to participate in soccer because of his non-residency status. Steines believed the school violated the Americans with Disabilities Act and the Rehabilitation Act. Steines had attended school in Cincinnati after getting diagnosed with Attention Deficit Hyperactivity Disorder in kindergarten. Shortly after getting diagnosed, Charles’ parents and natural guardians, Ann Munson Steines and Michael Steines found out about schools that facilitate learning for individuals with disabilities like Charles’ that are based in Cincinnati and he has been attending school there ever since.
Lionel was convicted of the murder of 6-year-old Tiffany Eunick. Lionel argued that Tiffany’s death was a mistake and that he was only repeating a move that he saw a professional wrestler perform. However, experts say that Lionel’s story did not answer for all of the injuries that Tiffany obtained the night that she died. “The defense’s own experts conceded that Tate’s story would not have accounted for all of Tiffany’s injuries, which one prosecution expert said were comparable to falling from a three-story building.” (““Wresting” Case Draws,” par. 20) It is obvious that Lionel did not tell everything that happened on the night that he killed Tiffany, and some could say that they would expect Lionel to hide the entire truth because he was young and scared, but then they are presented with details of his actions after being confronted with what happened to Tiffany. “Ms. Eunick- Paul testified that when she told Lionel that her daughter was dead, he shrugged and rolled his eyes. The next day, he asked Ms. Eunick- Paul if he could live with her and have Tiffany’s toys, she testified.” (Canedy, par. 11) 12 Year Old Lionel Tate was not able to sympathize the death of 6 year old Tiffany Eunick. How could life in prison without mental help, help Lionel Tate? How could life in prison help 13-year-old Eric Smith who committed murder on a spur- of- the- moment

Many people in society are unsure on what white collar crime actually is. There are different opinions on what white collar crime should be defined as. A strong definition would be any violation of criminal, civil or regulatory laws or unethical actions committed in the course of one’s occupation. These individuals are usually very respectable in society and have “high-status”. White collar crime is much larger than your traditional street crime: It harms a larger pool of people and can go on for many years under the radar
As a child Adam lanza had little contact with his father and was not properly nurtured by his mother and the school he attended. As a result, his mental issues were allowed to get out of control and he ended up committing a horrendous crime. Everyone remembers the events that occurred at Sandy Hook Elementary School on December 14, 2012. Before Adam Lanza decided to go to Sandy Hook with a gun, he attended there as a child. In 1998, Lanza began first grade and received speech and language services along with occupational therapy. When Lanza arrived in second grade he was removed from occupational therapy and in fourth grade was removed from all special education. This lead Mrs. Lanza, his mother, to write the school a letter voicing her concern.

This short paper will talk about James Liang’s action on helping Volkswagen create a software that when installed in a vehicle, would cheat on the emissions test. Mr. Liang knew that he and his coworkers could not design a diesel engine that would meet U.S. emission standards, so instead he helped create a program that would cut back on pollution during the emission test. In reality, these cars when driven emit around 40 times the allowable pollutants, but before anyone figured out, 500,000 cars with this software installed, were sold in the U.S. Once news spread out, a lot of the car owners were disappointed and started suing Volkswagen as this situation decreased the value of their car. Stakeholders were also angered that they weren’t informed about this earlier, since this could have impacted Volkswagen stock prices. For this topic, NBC and CNN News were used to get information on this topic, as they are considered reputable news sources. Also, rule utilitarianism and Kant’s duty ethics will be used to determine the actions a rule utilitarian and a Kantian would take if they were in the same scenario.
