I believe that there are some people who are “Not Criminally Responsible” however I also believe that it is almost impossible to know whether someone really is NCR or not. There were a few different situations we saw in the documentaries; some in detail and others not so much; the man who stabbed the young woman outside of Walmart I believe deserved that sentence but the man who shot the guy and to this day says, “he was in the wrong place at the wrong time” I feel should have been imprisoned. For that man you do not see any remorse; whether he was criminally responsible or not at the time you would think a person would have guilt about their actions in the future. He does not take any medication and feels that he is better; this case disgusts
The two topics that piqued my interest were found in Chapter 3 and 4. I chose these topics because it was discussed briefly and I wanted to know more about it. I find these topics interesting. The two topics should be addressed more within the concept of correction.
House capture: This includes the guilty party being bound to his or her home. The wrongdoer for the most part can't leave unless making a trip to and from court, albeit going on particular errands or going to work or school might here and there be permitted.
Individuals in life or death situations should not be held accountable for their action. They are obviously going to want to be alive and happy, and not die or live in misery, so victims would most likely do whatever it takes to survive. Whoever made the decisions weren’t fully thinking it through because we all develop mentally at a different age for children and adults. Individuals who are in life or death situations don’t put themselves in that positions purposely to where they know they can die. In situations like these, everyone feels stress to the point where they have no other option until it is too late when they make their final choice like what happened in “The Seventh Man”
Strict liability offences are offences which do not require proof of mens rea. This means that the prosecution only needs to prove that the defendant voluntarily committed a forbidden act without considering if the defendant had the intention. Strict liability is contained in statutes or statutory instruments, and occasionally found in common law. Common law offences of strict liability include criminal libel and blasphemous libel. Also liability is rarely absolute. Most strict liability offences are regulatory and are involved in environmental protection laws, food, health and safety, the sale of alcohol and many more.
Brandon, I enjoyed reading your post as you had some interesting ideas. I disagree with you on the first point. In a correctional setting, most decisions on what to do in different situations should already be set in stone to prevent disorder in the closed in setting. If a corrections officer has an idea to make things better, it should be sent up the chain of command for review. This strong type of accountability is needed in corrections because 113 corrections officers were fatally injured between 1999 and 2008 (Konda et al, 2013). I do agree that when employees become disconnected from administration, they lose focus and only do minimal work. An easy way to prevent this is to hold periodic employee meetings that are attended
According to examiner.com, “research shows that the human brain goes through a slow maturation process between ages 10 through 25.The emotional make-up of a child is generally fully developed by age five (Examiner).” So, when it comes to this study it shows that Cameron Kocher’s brain wasn’t even in the start of its process. Therefore, Cameron showed the signs he was showing because he most likely didn’t fully understand what was going on, or what he did. During this time, when juveniles have no responsibilities, and maturity it is not expected of them, they most likely do not understand the consequences. Therefore, it is considered unjust to convict them in the manner as adults. Also, in CNN according to Jessica Reaves, “The juvenile prison system can help kids turn their
The word accountability is toss around so much latterly it is hard to ignore it. What exactly is accountability? Everyone claims they are doing it yet so many leaders and employees lack the concept of accountability. Accountability is a subject that ranges through every spectrum of life. Accountability is hold each person responsible his or her own actions in the given situation, especially when we know the circumstances. If we are not to hold each other responsible for each of our own actions and choices then we will never be able to correct problems and concerns, which will make us fail as a whole because the smallest individual action can account for the gravest of consequence.
Bill C-54 will make NCR accused remain hospitalized for three years minimum, this change will cost the government a large amount of money that could instead be appropriately used on the health care system to help avert the mental illness in the beginning stages. In a recent study, three-quarters of those found NCR had at least one psychiatric hospitalization before being NCRMD. The author of the study also found that the mental health services are so hard to get that families have to report criminal acts to the police in order for their family members to get the care they need (Ross). This is because the mental health care is mainly left to the prison system instead of the health care system where it would be more beneficial to both the Government and the NCR. The criminal justice system is flooded with people who plead NCR because it is merely due to all the pleading that there are a series of psychiatric examinations that the individual undergoes through to even be considered NCR. In a study done by Stats Canada, all the cases where someone had blamed their mental or physical act as NCR were reviewed, and the study concluded that out of 149,701 only 147 cases were found to be NCRMD(Canada). This puts a burden on the courts and the taxpayers who have to
One common element I have learned is that across the country, our jails and prison systems are grossly suffering from overcrowding. This places the staff and the inmates inside these facilities at considerable risk, especially when you factor in the amount of mentally ill folks that are mixed into these populations. It appears that your state is implementing a plan, which will save them a considerable amount of money. I hope this new accountability act is thoughtfully put in place and the inmates that will be released are intensely evaluated to determine suitability for reintegration to society.
Bystanders should never be responsible for a crime that they did not attempt to stop. This rule should not be flexible either, as flexibility creates loopholes. Within the past few years reports police brutality and cases of wrongful deaths have taken over the news. Those stories involve highly trained individuals who were in positions of authority. Imagine if bystanders, having no training or knowledge, decided to take matters into their own hands. As triggerhappy Americans continue to roam, recommending that members of the community should try to stop crime is preposterous*.
Vicarious Liability assigns the liability to the accomplice, This makes the young kid who is with someone that hurts another kid at fault to. As teenagers people do stupid stuff, and they never think of the consequences. Teens have to be careful because they can be charged for being an accomplice for what someone else wrong. do not know if this is always fair because the teen may not know their friends intention. The felony murder rule say the accomplice is at fault if the offender murder someone, and the accomplice is with them even if they did not know they intended to commit murder. Altercations start all the time between teens how can they know if their friend will pull out a gun or not. Even the best of people have pulled out guns. Teens
Culpability is based on the implication that one performs an act in which they are aware that the conduct is wrong but, lacks malice intent by the person performing said act. One’s culpability is based in two sectors of their lives morality(ethics) and legal responsibility. Morals are what one is taught to believe in or value these values dictate what actions or behaviors can and will be accepted and what is deemed a violation of those standards. A strong moral fiber is what helps maintain stability within one’s self and acceptable both morally and legally. Culpability from a legal stand point deals with a person who committed a crime and is legally at fault. This admission of fault is deals with instances in which the “guilty” party was not acting maliciously but, instead with reckless abandon.
Regardless, did you ever hear the crying from the relatives and partners of losses? In case the juvenile wrongdoers don't have the benefit of opportunity, the all-inclusive communities who are butchered by these convicts even don't have the benefit to life! The fault as genuine as
The parents, George and Lydia are to blame for their own deaths because they let their kids get too addicted to there technology. According to http://www.bbc.com it states that “Children aged five to 16 spend an average of six and a half hours a day in front of a screen,” which is really bad and can lead to people getting obese cause if there on there screen half the day they won't go do exercise and they will just keep eating, and keep eating and won't eat healthy meals, and they won't go up or downstairs which means there getting too addicted to the nursery. The parents should of interacted or taken control of this action a lot sooner.
The main job or responsibility of the justice systems is to enforce the laws that are put in place to protect our country and the people who live in it. The head justices try their hardest to set certain consequences that is fit to the crime, the more malicious the crime the larger the consequence. America more specifically tries to keep its justice system fair with prosecuting and fulfilling its sentences. Sometimes the justice system goes too far. By no means is any justice system perfect, but a large controversial punishment that has been enforced in this country is capital punishment. Capital punishment is also known as the death penalty and is mostly used for those who are convicted with multiple murder and rape counts. Enforcing
