Why Are The Articles Of Confederation Effective

The Articles of Confederation was first written in 1777. It was passed by the Confederation of Congress. Congress decided that they needed a firm government to organize the states as a whole. At least that was their primary goal. Since each state had separates rules. The Articles of Confederation was later ratified by each state in 1781. It was “America’s first federal constitution” (Keene 138). The confederation had a few strengths but many weaknesses. The nation faced many economic and political issues that lead people to controversy.

The Articles of Confederation were ineffective because it lacked enough powers. It had the power to give orders to the states. The Articles could not enforce laws and each state had its own way of enforcing law, constitution, and monetary system. Regionalism eroded states against each other, which that decreased sense of unity. When Congress recommended duty on imported goods, Rhode Island went against because they felt it was against the constitution

The Articles of Confederation established the first national government of the United States after it declared independence from England. The American Revolution heavily influenced this document, as the American people refused to have another tyrant rule their country. From 1781 to 1789 the Articles of Confederation provided the United States with an ineffective government because of its lack of power to tax, raise an army, or regulate trade; however, it redeemed itself with the creation of the land ordinances of 1785 and 1787, and keeping the states united after the American Revolution.

One of the main disadvantages of the Articles of Confederation was that it encouraged a weak central government. Because nine out of thirteen states had to agree upon a law in order for it to be established, very few laws were passed. Amendments of the Articles of Confederation were never passed because the vote had to be unanimous. Not many decisions were made and the Congress generally only had the power to make treaties, deal with foreign affairs, and declare war. The Articles of Confederation read, “Each state shall contain its sovereignty, freedom and independence, and every power, jurisdiction, and right…” (Article II) The states had the most power and the Congress very rarely made decisions that affected the internal affairs of the states or country. There was only one house of Congress where each state only had one vote. This did not allow the bigger states with a greater population to have an advantage over the smaller states, which one could perceive as unfair in certain circumstances. Also, there was no judicial branch, which meant that if a case was not solved on a state level, it had nowhere to go. Fundamentally, the states held the most power. The lack of power within the Congress led to economic crisis.

The feebleness of Congress was a major weakness of the Articles of Confederation. When the Articles of Confederation were adopted in 1777, they created a “loose confederation” of states (Pageant, 181). This meant that each state was independent and sovereign, linked by Congress only to deal with common problems and foreign affairs. Congress was meant to be part of a united central power of the government, but due to the abuse suffered from the king, the states so limited the powers of the central government to the point of powerlessness.

During the time in which the Articles of Confederation were still in place; there were problems arising like: the Continental Army not being paid for their services, the struggling economy, and the people wanting to overthrow the government. The elites during the convention had scrapped the Articles and wrote a new document; which was the Constitution. The Articles of Confederation had a lot of weakness, and this pushed the leaders to hold the Constitutional Convention, also the leaders had to make sure that the people didn't as much power over the government as they did.

The Articles of Confederation solved some problems by creating at least a minimal amount of government at the time, but it also created some problem for our country because we did not have enough government. As time went on, the Founding Fathers found the issues with the Articles of Confederation, sought ways to solve those issues, and created the Constitution as a lasting governing document.

The Articles of Confederation, although a big first step, had more weaknesses than strengths. In fact, the major downfall of the Articles of Confederation was its weakness. Under the Articles, the federal government had little power and was too weak to enforce any laws. The Articles gave Congress the power to pass new laws but they did not have any power to enforce them. If a state decided that they did not want to follow a law then they could just ignore it. Congress also had no power to regulate trade or levy taxes and without an executive leader or federal court system there was no way to enforce anything. Another large downfall of the Articles of Confederation is that to Amend it required a unanimous decision which in most cases is extremely difficult. Because the Articles of Confederation are often considered a failure, it’s easy to look past the achievements of the American government under those Articles. The most important piece of legislation passed under the Articles of Confederation is the Northwest Ordinance of 1787. This Ordinance provided the guidelines by which new states would use to be admitted into the Union. Judges and Governors appointed by Congress would oversee a territory until there was five-thousand free male citizens of voting age. The citizens would then elect a territorial legislature, which sent a non-voting delegate to Congress. When the population hit sixty-thousand, the territorial legislature would be eligible to submit a state constitution,

The weaknesses of the Article of Confederation included the fact that every state was in a position to follow whatever laws it desired, as the government was not strong enough to force it to enforce any laws. Moreover, the government could not tax its citizens and had to borrow money from the state. The country also lacked an army or any form of protective institution. Each state had there own money, this caused problems if states needed money help, some of the states couldn’t help each other. According to Document One the Articles of Confederation had no power to collect tax, and no power to enforce. That makes the government weaker and poorer. If they couldn’t tax how were they supposed to make money? Well they could not, this would hurt them a lot.

The colonists did win the war and used the Articles of confederation as their constitution for 10 years even though it was only meant to be temporary. The Articles of Confederation were effective in controlling foreign relations with other countries. However the articles of confederation were ineffective in improving the country's economy and in controlling western borders in a reasonable way. Therefore we had no stable way of improving our economy or efficient way for the federal government to control the western settlement of the colonists and the indians they angered.

In order for the Articles to become official, they had to be approved by all thirteen colonies. Although Congress sent the Articles of Confederation to the states around the end of 1777 to become ratified, they were not officially adopted until March 1, 1781. Under these Articles, the states remained sovereign and independent, with Congress serving as the last resort on appeal of disputes. The American people feared a strong national government and as a result of this, the Articles of Confederation were specifically designed to be weak in the sense that each state maintains its own sovereignty and all rights to govern themselves, with the except of the rights exclusively granted to Congress. Since the Articles lacked many necessary components to keep a nation properly structured, they were eventually revised into the constitution we recognize today. Although, the Articles of Confederation seemed as though it only contained weaknesses, within the document, many strengths and accomplishments were made. Overall, the Articles of Confederation were proven to be both efficient and non-efficient during the time period they were in effect.

The Articles of Confederation was weak because it had the inability to regulate trade and levy taxes. And due to that, the states refused to give the money to the government that they needed so they engaged in tariff wars. With in fact, "stopping interstate commerce.” Due to all of this conflict, the government can not pay off the debt due to the revolution, includes, paying off the soldiers and citizens. In the end, the states ignored congress and therefore, they are powerless to make any further actions which meant they really couldn’t carry out their duties.

The national government of the United States had many challenges under the Articles of Confederation. The Articles caused money problems and the most essential detail, a weak government. This also caused America conflicts among each of the 13 states. These problems greatly impacted the United States and it’s government as well.
