Staff, I just wanted to close the loop on our conversation yesterday and have finished my investigation into this complaint having spoken to James and Wendy this morning. Investigation: There were four sound clips to review. 1. Complainant to James 2. Complainant to Wendy 3. Wendy to Tim Jotham 4. Complainant to Tim Jotham. Investigative synopsis: 1. Loss prevention from WALMART come into Communications (James) who explains that Robert SEVIGNY is in the store “throwing clothes into his backpack” and was arrested for same in March at the store. The call taker asks if he has apprehended and tells the complainant that we have no officers in that end of town and asks him to call us when he “got him” and hangs up. Caller calls back 26 minutes later and tells a different call taker (Wendy) that he was asked to call back. He advised that Robert SEVIGNY has just left the store, he didn’t apprehend him, but suspects that he has a stolen watch and jeans. The complainant advises that he observed SEVIGNY ripping open a watch case and jeans and saw him put something in his backpack. Caller unsure of his grounds for apprehension. Incident should have been made and male should have been run, We had enough grounds based on call to attend and stop male –DP 3. Caller then transferred to front desk and speaks with Special Constable (Tim Jotham). Complainant advises that he saw the male with jeans and saw him conceals something in his back pack. He is questioned and again tells S/Cst that he observed the male conceal something in his back pack, clothing but not sure what type. Complainant gives and spells suspects name and DOB, again advising that he was arrested in the store in March. Dispatch advised me that Walmart loss prevention was currently observing a male subject attempting to pry open a necklace while in the jewelry department of the store. Loss prevention described the subject as a white male, wearing a green tee-shirt, and black baseball cap.
The Georgia Shopkeeper’s Defense statute bars the Plaintiff’s suit. The statute bars recovery for false imprisonment by merchants or their agents when all of its elements are met. The Shopkeeper’s Defense statute provides in order to preclude recover the following three elements must be present: (1) reasonable suspicion of shoplifting, (2) reasonable time of detention, and (3) reasonable manner of detention. Ga. Code Ann. § 51-7-60 (2015). The Plaintiff and Defendant have agreed that the Plaintiff’s behavior on September 29, 2015, was sufficient to cause a reasonable person to suspect her of shoplifting, and that the length of the Plaintiff’s detention was reasonable. Therefore, the only element in dispute is the reasonableness of the manner in which the Plaintiff was detained. As such, R-Mart should be protected under the statute and the Plaintiff could only recover for false imprisonment if the facts alleged in the complaint demonstrates the manner was unreasonable.
I spoke with Marlon about additional items in the vehicle the victims said should be in there. I asked if the items would still be in the vehicle. Marlon said “Probably not, but I didn’t take them” he said there was seven other persons in the vehicle at some point. Marlon was asked what time “he” parked the car on Copperstone Circle. He said between 10pm and midnight.
This case involves a male and female Hispanic, entering TJ Maxx during business hours, and concealing various items in their bags. The suspects attempted to leave the store without paying for the items. Loss Prevention Agent Sergio Castro made contact with the suspects at the front entrance and retrieved all of the loss except for a black Michael Kors purse, valued at $159.99.
‘If I suspect abuse through noticing a sign of physical abuse or change in the behaviour of an individual, I will make sure that I ask the individual what has happened telling the individual the changes that I have noticed. If it is in my place of work and the name of the person that abused the individual is known, whether staff or another service user, I must also record and report this. I will listen to the individual carefully; it is up to them to tell me, I would not ask them any questions about this as this is not part of my job role and would stay calm.I will make sure that I record what the individual tells me using the individual’s own words. I will make sure that I reassure the individual and explain that their safety is the most important and that it is my duty of care to tell the manager. On Friday, August 12, 2016 at approximately 1000 hours, I assisted the patrol division in locating a burglary suspect that entered the residence of 1023 Barn Oak Court. The complainant/victim Nicole Smith stated to the Conyers Commutation that when she entered the front door of the residence, she heard an unidentified noise in the back bedroom. As she entered the rear bedroom the subject exited the residence through the rear window.
K-9 officer told Mr. Solomon to stop and he continues to run. Mr. Solomon heard the officer say he was going to release the dog and Mr. Solomon gave up. Mr. Solomon was then taken into police custody. When the victim came home, Detective Gibbs went into the home and found a black backpack at the top of the stairs. The victims stated that the backpack was not theirs. Detective Gibbs opened the backpack and the victim’s stolen laptop was inside and Daniel Solomon’s homework was also inside. Mr. Solomon and Mr. Powell were brought to 311 County Street and they both confessed to breaking the window and going inside of the home. They both blamed each other for taking items.”
Brandon advised the store has had several incidents of receiving counterfeit money recently, so he checked the bill with a marker to see if it was real. He advised the marker revealed the bill to be counterfeit. Brandon advised he told the W/M the bill was a counterfeit and the W/M advised he had just been paid by his boss. Brandon stated the W/M requested the counterfeit bill back and he told the W/M he was going to call the police. Brandon advised the W/M then fled the store without the counterfeit bill.
Approximately one hour after petitioner’s arrest, Detective Clark returned to the apartment and informed Rojas that petitioner had been arrested. Detective Clark requested and received both oral and written consent from Rojas to search the premises. During the search the police found Drifters gang paraphernalia, a butterfly knife, clothing worn by the robbery suspect, and ammunition and a shotgun.
At 5:30 SA Lyn Brumaire received another call from Officer Tabiri that another resident named Marielle Fisher may know the whereabouts of Ms. Lee. Upon knocking on the door of suite 805, no one answered so officer Tabiri asked me to key into the room. Ms. Fisher was not present but her suite mate, Ms. Neali Rogers was. Ms. Rogers communicated that Ms. Fisher had gone home for the weekend.
On 26 June 2017 at 1516 hours, Officers were dispatched to the area of 305 East Penn Street for a theft of a vehicle. Officer were advised the actor was a Rhiannon Meyer and that she had stolen her dad Dodge truck green in color with a plow on the front. and was last seen heading towards Main Street. Officer began to check the area of Main Street, when Unit 191 called out with the vehicle at 100 Pennsylvania Ave, in Shenandoah Heights. Your Affiant (Patrolman William Moyer) along with Patrolman Tyler Dissinger responded to Unit 191 (Chief Livergood) location. At arrival Chief Livergood had MEYER in custody along with the stolen vehicle. MEYER'S was still yelling about someone having a gun in the window of the residence and was not making sense
On 11-25-16 at 1235 hours, Officer Calderon #2037 and I were dispatched to 1604 N Arroyo Boulevard regarding an attempt petty theft investigation. Upon our arrival, we met with Witness Michael Robert Trujillo, who is the resident at the above location. Trujillo told me the following information in summary:
