In 2010, the Arizona Senate introduced a bill that would become one of the strictest and anti-illegal immigration bills ever to be debated, and eventually implemented in the United States. The bill, usually referred to as Arizona Bill 1070, requires all aliens to carry their registration documents at all times. 1070 makes it a state misdemeanor for an alien to be in Arizona without carrying the required documents and bars state or local officials or agencies from restricting enforcement of federal immigration laws. It also cracks down on those sheltering, hiring and transporting illegal aliens. The United States government should implement this bill at the federal level. The proposal of the law was brought to light after a large …show more content…
Law enforcement agencies in Arizona are now legally allowed to question the immigration status of anyone stopped or arrested for a usual offense such as traffic violations or criminal charges. According to an article by Fox News, there were 566 kidnappings committed in 2008 and 2009 and 1,097 attacks on border patrol agents. (“Fox News”) These crimes are usually attributed to smuggling groups and drug traffickers. (“Fox News”) Also in 2004, 11.1 percent of the Arizona prison population consisted of undocumented people. (“Fox News”) Although SB 1070 is a new law and has not been tested for long, some law enforcement officials have stated that they have been questioning the immigration status of those arrested or stopped for a long time now. Sheriff Joe Arpaio, a sheriff in Maricopa County in Arizona, said, “We've been doing it for a long time, but this gives us just a little more authority.” (Castillo) Arpaio later stated that procedures followed by himself and his officers have created a “steady decline” in criminal activities among illegal immigrants. (Castillo) This fact is a strong supporting argument for SB 1070 and the deterrence it has on undocumented immigrants in Arizona. As of March 2011, the current unemployment rate in the United States is 8.8%. (US Dept of labor) With the US Census Bureau estimating that 8.7 million illegal immigrants reside within
1070 which made it illegal for immigrants not to carry their documents and authorized police to detain people they ‘reasonably’ suspect are unauthorized.” (Renwick). Unfortunately, much of this policy was found to violate or infringe upon the immigrant’s rights. “Last year, the Supreme Court struck down most of Arizona’s immigration legislation, siding with the Obama administration and immigrant right’s activists who argued that Arizona’s law intruded on the federal government’s well-established authority over immigration” (Lane). Although this state law was argued in the Supreme Court, the controversial “papers, please” clause was allowed to remain in effect.
The Arizona state legislature passed into law S.B 1070, which was intended to address issues related to illegal aliens in the state. The law made it a crime for illegal aliens to be in Arizona, without legal documents, it also authorized local and state law enforcement to enforce federal laws and prohibited the hiring, sheltering and transportation of illegal aliens. The legislation initiated constitutional concerns over violation of civil rights and was considered as encouraging racial profiling. There were also demonstrations against the legalization. The department of justice sough to stop
The state of Arizona has issued a new state law which enables police officers to act as immigration officers. With this underestimated powers given to the police, it will cause a lot of problems, and sensitivities to all the legal and illegal immigrants (Cnn.com). Undocumented students residing Arizona will be in a constant fear of being deported since any minor issue such as calling the police for help in any case given can put their lives in the danger of deportation. It’s only a matter of time if the government doesn’t stop this act, Arizona will impose unfair laws for education toward undocumented students. This will only cause chaos, and taking away the validity of the American Dream.
According to the author of this law, Mr. Russell Pearce, the state senator of Arizona’s 18th legislative district and the author of the new Arizona law SB 1070, argues that the United States Federal Government has not been doing their job correctly. The new law gives police officers the power to enforce immigration law. Pearce stated that police officers will not abuse of their powers given by the SB 1070 law because the SB 1070 clearly states the law provisions and how to enforce it. Therefore, he took the lead and implemented this law on his state to eliminate undocumented people at least in Arizona. Through this law police officers will have the power of prosecute anyone who is suspicious of being an illegal alien.
It is clear that illegal immigration has gotten out of control and constringent measures need to be taken to protect the United States borders. The local Government of Arizona recently decided to take control of the situation, by passing the “Support our Law Enforcement and Safe Neighborhoods Act” {House Bill 2162}. This bill gives law enforcement officers and agencies the authority, to lawfully stop, detain and arrest anyone who appears to look like an illegal alien. The bill out-right condones racial profiling and it violates civil rights, as well!
Immigration is an issue that some sought to resolve in both violant and nonviolent manners. most of the time people think the government does not take the measures to tackle the problem at hand. “The responsibility that the state has toward the rights of its citizens. Illegal immigration directly violates some of these rights.” (The Police Should...) In order to enforce the law, police and other law enforcement groups must push to protect the right of the citizens. Also illegal immigrants take advantage of the system by being “granted privileges such as jobs, and moreover they are being given security, schooling, healthcare and other services financed by american tax dollars.” (The Police Should...) Not only that; over 7.7 million jobs
The Arizona SB 1070 is a law that requires all aliens over the age of 14 who remain in the united states for longer than 30 days to register with the US government, and to have registration documents in their possession at all times. The Arizona law also made it illegal to be in the state of Arizona without the required documents. Some people don't agree with law they say that there is too many people that can't get the legal documents they need. Then there are some people that say the Arizona law is a good law to follow. Such as the law provides more security to the surrounding environment. In my opinion the Arizona state law is a good law to live and follow by for many different reasons.
Senate Bill 1070, also known as the “Support our Law Enforcement and Safe Neighborhoods Act”, is a piece of legislation that originated in early 2010 which gives the police the permission to check immigration status when enforcing other laws. The intentions of SB1070 is to cut down on the illegal immigrants in Arizona by having immigrants carry immigration papers, or will be held until proven their status in the USA. However, this senate bill has caused a lot of controversies on the issues on racial profiling and unconstitutional acts have put the federal law into question of their actions. The issues of SB1070 have also gained my interest into learning about the both sides of SB1070 and does it affect our views of the American government
Case Summary: Many states wanted to adopt policies that would limit the lives of illegal immigrants. Arizona being the primary state vying for laws to punish unauthorized immigrants. On April 23, 2010 the governor of Arizona signed a law designed to “ ... identify, prosecute and deport illegal immigrants.” The United States seeking to stop the law before it was in effect, argued that the law was in conflict with the federal laws on illegal immigration. In the law signed by Arizona, given was four provisions, a condition in an agreement or law. The four provisions were (1) that being in Arizona without the proper legal documentation
In the article titled "Dying to Work" there is an excellent quote given by Rep. Kolbe says, “There are no two countries in the world that share a border where the economic disparities are greater than between the U.S. and Mexico.” (AZ Republic, 2002) My paper draws on the information from the “Worldwide Refugee Information: Country Report: Mexico” written in 2000 and the article titled “Dying to Work: The Arizona Republic” written in 2001. Both of these articles give numerous information about the Mexican Immigrants and refugees. I am focusing on the illegal Mexican immigrants as well as refugees that enter the U.S. through refugee status, because living in Arizona, there are
Arizona made it tougher for undocumented citizen by making a federal law called the Arizona Senate Bill 1070. “The controversial bill gives Arizona law enforcement the authority to stop people whom officers have "reasonable suspicion" of being in the country illegally, detain these individuals while verifying immigration status, and arrest undocumented immigrants for transfer to ICE custody.” (McFadyen) The article also states “The bill, also known as the "Support Our Law Enforcement and Safe Neighborhoods Act" also makes it a crime to be in the state illegally and to provide transportation to someone you know is undocumented.” (McFadyen) With that said, it seems to me, it gives the police in Arizona authority to stop anyone they feel like. It also touches on the subject of racial profiling and discrimination just by the way a person looks making it ok to stop them. Furthermore, by making this bill it says that it is ok to look at someone and judge them for what they look like.
A.Thesis statement: The enactment of Arizona immigration laws is the result of long-standing structural racism effects, and the practice of these laws leads to unconstitutional racial profiling concerns that target the Latino community on the basis of ethnicity.
Despite the increase in funding over the last decade, the number of illegal aliens entering our country continues to grow. Every year, we allow 750,000 immigrants to enter the country legally and make them eligible for citizenship within five years yet it is estimated that 10 million people reside in our country without legal documentation. Illegal immigration is not just Arizona’s problem, or any of the other bordering states, it is a national problem that is costing United States citizens billions each year. “Political Correctness” forbid certain politicians from calling illegal immigrants what they are at face value: Criminals. They commit an
Illegal immigrants help boost the United States economy by paying some taxes. Like American citizens, illegal immigrants may pay local, state, and federal taxes including sales tax that helps support government services that they may not be able to access (Ewing 9). Since more American citizens are becoming aware of the benefits of an education, openings are being created for illegal immigrants in low paying jobs (Nadadur 1037-1052). Americans, unlike illegal immigrants, have more diverse careers. Aliens are more concentrated in specific job areas, resulting in a decrease in immigrant labor cost. This helps boost the United States’ economy (Carter 777-795). Of the approximate eleven million illegal immigrants in the U.S., most work in labor intensive jobs. Careers such as construction and agriculture tend to attract illegal aliens and they account for about twenty-five percent of the work force in these areas (Ewing 9). Ben Bernanke, chairman of the Federal Reserve admits that illegal immigrants help improve the United States economy and does not suggest turning them away (qtd. in Quindlen 90). Anna Quindlen, in her article “Newcomers By Numbers,” agrees with Bernanke and believes that immigrants are the factor that helps keep prices low. She also adds that immigrants are not causing American citizens unemployment, but are simply taking the low wage jobs that citizens are not willing to do and even boosting the economy (90).
Arizona passed a bill called SB 1070, this bill was work on Anti-immigrant sentiment and the borders of belonging and not belonging. Lots of people from Mexico across the border come to Arizona illegally, and this situation cause lots of social phenomenon. For example, the crime on the board is very significant, and cartel
