The reporting party (RP) stated her husband Vernon Ferguson DOB: 11/29/29 was sent to the emergency room due to a frozen shoulder on 3/29/16. The resident was released to return to the facility 3/30/16, however the facility refuse to allow the resident to return. The facility notified the family on 3/30/16 the resident was at the hospital and he would not be allowed back in the facility. The RP stated the resident was abandoned and forced to spend two nights in the emergency room prior to finding an alternative placement (Mountianview Care Home). The RP stated she paid the facility $6500 for the month of April and due to the facility eviction she is entitled to receive a refund. According to the RP the administrator stated the check went out
Hello Dr. Ullom, majority of the long term care facilities are under staffed. There is usually one registered nurse in charge to manage a 240 bed facility, with LPN's and nursing assistance. I feel that these patients would benefit from having one RN to every six -eight patients with a nursing assistance. Not only would this benefit the patient but the nurse as well. Patient are placed in long term care facility with a certain problem, but ends up with additional condition such as UTI, MRSA, pressure ulcers, and etc. These issues are related to poor care they receive because of unstaffing. I'm not placing blame on the LPN or nursing assistance, but with a RN and low nurse to patient ratio, they will receive better care.

Howard Terry Newman is 67 year old retired printer who suffered from Parkinson’s disease as well as arthritis, voice impairment, hiatal hernia, and heart trouble. Mr. Newman, the appellee, is contesting his stay between September 19, 1968 and November 11, 1968 at the appellant’s facility, Big Town Nursing Home. The plaintiff was admitted voluntarily by his nephew to the facility with the ability to leave as he pleased. However, on September 22nd, when Mr. Newman attempted to leave the facility, he was told that he could not use the phone or entertain visitors without the administrator’s permission. He proceeded to walk out; he was brought back and restrained on Wing 3 with “senile patients, drug addicts, alcoholics, mentally disturbed, incorrigibles and uncontrollables” according to the administrator testimony.

After the resident was admitted, licensee requested a deposit of an additional $500.00 from RP for incidentals (for outings) which RP paid. RP was then verbally notified by licensee that the rent would be increasing to $2000.00 per month. RP told licensee that they could not afford this amount and that she would be taking him out. The facility informed the RP that due to the resident's behavior he required one on one care. The hospice was provided by Kaiser Permanente who provided all the care for the resident. The RP stated after 5 days in the facility her father passed away. The RP paid $4200 for rent and request to have the pro-rate amount of the rent refunded. The administrator Susan Kendakur informed the RP that she would not refund any portion of the rent due to her father being a hospice resident. The RP disclosed that the facility did not provide the hospice care for the resident and should be entitled to a refund. The reporting party (RP) stated that former administrator/owner Edwin Ingan is driving resident#1 car. The resident's former neighbor inquired about purchasing the vehicle and resident #1 refused. A while later Edwin cajoled resident #1 into signing Department of Motor Vehicle paperwork. The resident has mild cognitive impairment and memory loss. Edwin has been having resident #1 to sign checks to pay the facility fee. According to the RP each month Edwin would come into the facility and bring a check for resident #1 to sign. Approximately 1 year ago Edwin asked the caregiver to check resident #1 belongings for additional checks for the resident checking account. Fortunately no additional checks were located. The RP stated the eviction notice was not served to the resident but sent to the payee. Resident was not made aware of the eviction from the facility.
