The employee Davey Jones that works as a midnight dispatcher for the Ottawa county Sheriff Department, has the right to see his personal file not more than twice a year. Mr. Jones can only see his personal file during normal business hours. Mr. Jones have to put a request in writing and give it to his employer. Then the employer and Mr. Jones has to set up an appropriate time that works with both of their schedule’s. Mr. Jones if he can’t work out a schedule he can ask his employer to mail him a copy of his files. Mr. Jones can get a copy of his file, but employer will charge a fee for him to receive a copy of his file. Officer Tate must work for a covered employer and he had to at least worked 1,250 hours the prior year. Officer Tate has to be employed with his company for one year to be eligible for FMLA. Mr. Tate has to give his employer 30 day in advance notice. His employer must provide and explain his rights and responsibilities about FMLA. Mr. Tate’s has to give his physician his FM LA papers to fill and return to the employer by a certain time. The FMLA only requires unpaid leaves but. The law states that employers can elect to make the employee use their vacation and sick days. if the employer wants Mr. Tate to use his sick days and vacations day he has to abide their rules. They are not considered Act 312 eligible because, 911 Dispatchers are private Emergency Medical Service. The 911 emergency telephone operators they provide assistance by dispatching and relaying Emergency calls to Police, Fire Department or Emergency Medical Service personals. The 911 dispatchers are not public employees they are in separate bargaining units. The Corrections Officers that are employed by Ottawa County Sheriff Department are not considered to be eligible for Act 312. Correction Officers were excluded because their job is not posing danger or risk. They don’t work for the county; city or township they work for the government. The Paramedics and EMT’s employed by the City of Detroit Fire Department are not eligible for Act 312. The Emergency Medical Technician’s they have separate bargaining units and they are not employed by the police or fire department. They are not considered as public employees.
