Chloe somuah Block 1 Ms.Smallwood April 5,2018 Checks and balances is a method used to balance government power and individual rights .This way leaders do not gain too much power,which could take societies liberties .This was very important to the founding fathers,so they then seperated government into three branches,which are the Legislative,executive and Judical .This way they all check each other , to have independent powers and areas of responsibility. .The system of checks and balance does work because each branch can prevent another branch from overstepping its bounds and abusing its power. In document 1 it shows how each branch is checking one another by the use of arrows,this better explains how each branch works each other.Each branch
he principle of checks and balances creates a limited form of government because the constitution sets up the branches of the government and how they can only do certain things and can watch over the other branches. Also being a democracy the government cannot have all the power. Some of these checks and balances are the President appointing an official and the Congress rejected/ confirmed the official; the President vetoes a bill and the Congress overrides the veto with a vote: and lastly the judicial branch can review and say an act or order that Congress or President have put in order.
The American government has many powers that are given to, and checked by each branch. This is done by a system of Checks and Balances. The system of Checks and Balances states that the different branches have powers but the other branches have methods to stop each branches powers. But there are many argument that the system is broken or it isn’t. The system is broken because of many reasons involving the President, Congress and the Supreme Court.
Constitution DBQ After the revolutionary war, the Articles of Confederation were written and in effect for 6 years. Then they realized that they needed to be revised. During the constitutional convention, they were just supposed to revise the Articles of Confederation. Instead they went away with the Articles and started to write a new constitution. Many people didn’t think the new constitution would guard against tyranny, but it did.
The system of checks and balances is a procedure in which systems allows each branch of government to limit the powers of the other two branches. These checks allow each branch to block the actions of another branch. When Congress has the power to pass laws, the president can check this power by vetoing a bill before it becomes an actual law. Congress also has the same power and can check the president’s power by overriding the veto if two-thirds of the majority in Congress vote in each house. The Judicial Branch can also check these actions of the other two branches. The Supreme Court can declare that a law, treaty, or an executive action is unconstitutional. Basically, the system of Checks and Balances is to balance out each branch and limiting each branch’s power. (Page 162 9.2)
According to James Madison, “…the constant aim is to divide and arrange the several offices in such a manner as that they may be a check on the other … the three branches should not be so far separated as to have no constitutional control over each other.” (Doc. C). This means that the three branches can check on each other and keep each other balanced and that the powers among each branch is equal. In the constitution it states, “that court can declare laws unconstitutional.” (Doc. C). This is an example of how the judicial branch can check the legislative branch so each branch has a way to check the other branches. Checks and balances is the ability of each branch of government to exercise checks or controls over other branches. In Document C the diagram shows the branches have checks on each other. If the president tries to take the power of another branch, than the legislative branch can impeach the President. This is one of the checks of the legislative branch on the executive branch. Each branch has a check of every other branch, so if one branch is doing something wrong, another branch can check the wronged branch, and fix the problem.
Some examples of checks and balances in the Constitution occur in situations; such as when Congress has the authority to provide justice to the federal courts. The president has a discussion with federal judges about the information gathered from the Senate and their recommendation. Therefore, the three branches of government all have an opportunity to provide their viewpoint on how justice should be served in each federal court case. Checks and balances occur when the executive branch is in charge of foreign affairs, but treaties that deal with foreign governments need to be discussed with the Senate. Thus, the executive branch and the legislative branch have to communicate about decisions that relate to foreign treaties and come to an agreement.
To prevent from one branch of government having all power, and therefore having tyranny, (Madison FP # 47) Checks and Balances was added to the defenses of the constitution. There are three branches of government: Legislative Branch (Congress), Executive Branch (President), and Judicial Branch (The Courts). These three branches work together to check one another to make sure the power is evenly distributed and balanced, hence the name Checks and Balances. The way it works is that the Legislative Branch (Congress) can check the Executive Branch (President) by approving Presidential nominations, being able to override a President’s veto, and can impeach the President, him or her, from office. The Legislative Branch can check the Judicial Branch by having Senate confirm Presidential nominations and by being able to impeach judges and remove them from office. The President can check the Legislative Branch by vetoing Congressional legislation, and can check the Judicial Branch by nominating judges. The Judicial Branch can check the Legislative Branch by declaring laws unconstitutional, and can check the Executive Branch by declaring presidential acts unconstitutional. Tyranny is cruelty to the people. In 1787 the Constitution was written to replace the Articles of Confederation because it just wasn’t working for the people. How will a piece of paper get rid of tyranny? Well, the constitution will create a new beginning for the government. Consisting of Federalism, Separation of Powers, Checks and Balances, and large and small states.

However, only thing that prevented our government from becoming a tyranny was the Constitution. In 1787, the Founding Fathers met and established the Constitution, because the Articles of Confederation wasn’t working out. The Constitution was created and used to prevent tyranny throughout the government by trying many solutions, which worked well.
Checks and balances help prevent tyranny. Each branch checks each other to make sure each one doesn’t get too much power. The separation of powers and checks and balances is a system that was created in America by the founding fathers in the constitution of the United States. The separation of power plays an important role of keeping the three branches which are legislative, executive, and judicial in the government systems equal to one another and that neither branches becomes too powerful. Each branch has its very own power and duties to serve to the people and government. All three branches play a significant role in checks and balances and separation of powers, in our government and rely on each other to make sure that all of the power is equally distributed.
Checks and balances does not separate the powers, rather it expands off of it. Checks and balances gives each entity of government a different advantage over the other.
