Compromises Involved In Producing The Final Draft Of The Constitution

The Articles of Confederation, Adopted by Congress on November 15, 1777, for all practical purposes was the United States’ first Constitution. Created to establish a bond between the newly formed states, “...the Articles purposely established a "constitution" that vested the largest share of power to the individual states” (Early America). The Articles of Confederation established the first national government of the United States after it declared independence from England. The American Revolution heavily influenced this document, as the American people refused to have another tyrant rule their country. From 1781 to 1789 the Articles of Confederation provided the United States with an ineffective government because of its lack of power to tax, raise an army, or regulate trade; however, it redeemed itself with the creation of the land ordinances of 1785 and 1787, and keeping the states united after the American Revolution.

As our nation’s history has shown we have made mistakes in our past and been forced to learn from those mistakes. We have taken certain ideas and beaten them to death at times. The members of the constitutional convention of 1787 did the same thing as they were trying to decide what should be written in the constitution and how the government should be structured. Many plans were presented and rejected as the members argued until finally a great compromise was made and the structure our government for finally started to take shape.

In the period between the drafting of the Constitution and the start of the Civil War, compromise was a main part in the governing of the United States. The Constitution itself is often referred to as a “bundle of compromises” and because of the effectiveness of these compromises it has been able to withstand time and continue to be the main source of our government. Conflict arose even after the Constitution and compromises were made to try to keep the Union together and decrease tensions between the North and South. In this paper, I will discuss the compromises that made up the Constitution as well as the compromises that were implemented leading up until the Civil War.

The book, The Summer of 1787, by David O. Stewart, is a detailed work of historical, fact-based non-fiction with a biographical touch. The book has three hundred and forty-nine pages and was copyrighted in 2007 after being published by Simon & Schuster Paperbacks, which is a division of Simon & Schuster, Inc. David O. Stewart is qualified to write on the subject of the Constitutional Convention and all of the events surrounding it because of the extensive research that he has done, which is evidenced by his references to historical accounts in the text and his “Notes” section, which details many of the sources he used in his research. Also, David O. Stewart’s background qualifies him to write about this subject: He has practiced law in Washington D.C. for over 20 years and served as law clerk to several judges. The Summer of 1787 includes several features that add to the overall scope and quality of the book. First, it has illustrations of the delegates that are being described in the book along with other various illustrations added in. Second, it talks about, in more detail, one of the most important parts of government, the elector system. Next, it actually includes the Constitution that was written by these delegates in 1787 and amended so many times since.

In 1776, the Declaration of Independence, drafted by Thomas Jefferson, was formally adopted. The American Revolution had already been going on with the battles of Lexington and Concord over a year prior, but the first government of the United States is the Articles of Confederation, a constitution based on Republican ideas and democracy. The Continental Congress approved the Articles of Confederation in 1777. It was adopted, written by John Dickinson, but there was a delay in ratifying it by the states. States like Virginia and Massachusetts had claimed a bunch of land stretching from the East Coast all the way to the Pacific Ocean as part of their colonial charters. States like Maryland and Pennsylvania, who did not have these land claims, did not want to ratify this new national government until the land is relinquished. It was not until in 1781 when the states officially ratified the Articles of Confederation. From 1781 to 1789, the Articles of Confederation failed and had created problems in political, economic, and foreign policies, making this new national government an ineffective government.

The Articles of Confederation played a big role in the drafting of the United States’ new constitution. The articles were our United States’ first written governing document. The Articles of Confederation solved some problems by creating at least a minimal amount of government at the time, but it also created some problem for our country because we did not have enough government. As time went on, the Founding Fathers found the issues with the Articles of Confederation, sought ways to solve those issues, and created the Constitution as a lasting governing document.

Before the constitution became the law of the land there was the Articles of Confederation. The Articles of Confederation was the first constitution of the United States, and the first form of government established by the U.S. Under the Articles of Confederation the government consisted of a congress of delegates chosen by state legislatures. Congress was also unicameral, or a single house legislature. Each state had the same amount of power regardless of size or population. The powers to make, administer, and enforce laws were all placed with Congress. The government did not consist of a President or executive branch, instead the executive power was spread among several committees of congressmen. The articles granted certain limited powers to Congress. The Congress could not raise money through taxes, therefore it relied on contributions from the states, which was not reliable. Passing laws required approval of at least nine of the thirteen states, and amending a document required approval of all thirteen states. Congress had no power to regulate trade between the states or internationally. There was no national army, so the government relied on the individual states to establish a military.

During the American Revolution, the founding fathers wrote the Articles Confederation, a written set of laws that intended to provide a framework for government. The Articles of Confederation failed to create an effective form of government and could not promote stability for the nation. In 1787, 55 delegates met in Philadelphia to revise the Articles of Confederation. The result was an entirely new document, the United States Constitution. The United States Constitution addressed the weaknesses of the Articles of Confederation, promote unity through compromise, and established a framework for government that effectively promotes the ideals of American Government.

When the United States declared itself a sovereign nation, the Articles of Confederation were drafted to serve as the nations first Constitution.Under these Articles, the states held most of the power; but due to an almost absent centralized government, colonists were ill-equipped to deal with such practices as regulating trade both between states and internationally, levying taxes, solving inter-state disputes, negotiating with foreign nations, and most importantly enforcing laws under the current notion of "Congress". Realizing that there were several deficiencies in the current system of self-government, the states appointed delegates to ratify the situation and come up with a way to attain the aforementioned practices they needed to

The article of confederation is a document that the United States of America made in Philadelphia 1787. This document established the functions of the national government after it declared independence from Great Britain. This had a problem though, it did not help defend against tyranny. The need for a stronger Federal government, it soon became apparent and eventually led to the constitution. The constitution was written in 1787 by James Maddison. The Constitution guards against tyranny by having federalism, separation of powers, checks and balances and big states vs small states.

In the early years of the U.S.A, there was really no control or definite laws. After the Americans won the American Revolution, Britain was in no position to rule the Colonies any longer. This meant that Britain gave America the power to govern themselves. Perhaps that was a mistake, because the government the Congress created was weak and unhelpful. Benjamin Franklin was the one who submitted the first draft for a constitution, but John Dickinson, a delegate from Pennsylvania, wrote a constitution that later, after some editing, became the Articles of Confederation.

Developing a country and its principals comes with many debates, arguments, and many decisions to be made. In the end of the eighteenth century the Founding Fathers of the newly established America dealt with the difficulties of creating a country with strong political, social, and economic power. With the writing of the Articles of Confederation the country had now developed a national government, but was weak and ineffective. The top leaders of the country knew the flaws of the Articles and gathered together to rewrite the draft.
