Court Case: The Detective Kenefick Case

When a child is suspected of being abused, neglected or placed at imminent risk of serious harm by a member of the staff of a private or public school or an institution that cares for the child, the person in charge of the school or facility must notify the child’s parent or other person responsible for the child’s care that a report has been made. The state’s department of child abuse responsibility is to notify the head of a facility, school or establishment that a report has been made.

Lucius Isaiah Gibson IV, age 16, was arrested Tuesday, July 12, 2016, on the allegation that he committed sexual assault on a 3 year old girl at the home day care center known as “Jacque's Teddy Bear Child Care,” ran by his mother (Alani, 2016). The home day care facility is located at 1538 Amaryllis Court in the Thousand Oaks East Subdivision (Alani, 2016). On June 9th detectives first interviewed the 3-year-old victim, who name is not mentioned (Alani, 2016). According to the police report, the girl stated to the officers that, Gibson went into the “nap room” and assaulted her several times (Alani, 2016). According to the National Children’s Alliance, one in four girls and one in six boys under the age of eighteen are at risk of being sexually abused but only according to what is reported. In the State of Texas, a professional has forty-eight hours to report any cause to believe a child been abused as stated in Sec. 261.101. As a foster parent and principal, Angela Sugarek and Carol Jeffery had a major moral responsibility and legal duty to report what her three year old foster son was displaying: behaving strangely and an anal injury.

Reporter (Charlesetta) stated the following: He has been talking about the abuse and has been going back and forth since October 20th/ He said he was sexually assaulted by a 12 year old girl (unknown). Ms. Katina allowed the girl to come over. No one was responsible for their care. Ms. Katina was not there.

3:20pm- IRTC spoke with assigned CPS, Oneeka Peters, who reported that the subject child was interviewed at the Brooklyn CAS on 3/21/17 and there was substantial disclosure of possible sex abuse. CPS expressed that Detective Ruby was present and he reported that he does not think the alleged subject is the foster parent’s ex-husband, but there was a brother (foster parent’s relative) who frequented the home during the timeframe the child was referring to. CPS expressed that the subject child stated that the alleged subject was the foster parent’s husband, but there were questions as to who she was actually identifying. Reporter stated she went to the family home today. She spoke with Jonnie and asked if anyone every touched her. Jonnie said that two of mom (Andria) boyfriends have touched her. Trimel and Jermaine. Trimel touched her vagina twice. He did it while mom was sleep. Mom called the police on him each time. Jermaine touch her vagina once. It is unknown if mom know about the incident. Jonnie said that Jermaine was killed by his brother for touching another child. Jonnie did not disclosed if she was penetrated. It is unknown if there were any past allegations made against Trimel and Jermaine. Jonnie is showing signs and behaviors to sexual abuse. Her foster parent/aunt Erica checked her iPad while monitor it and noticed she was watching

REPORTER: The reporter/anonymous called with concerns for the victims, Annaclaire and Tanner. The reporter said Annaclaire is being sexually abused by Chris Mathis (mom’s boyfriend). The reporter said Annaclaire said “her pee-pee was red”, and she asked the victim “was anyone touching her” and she didn’t say anything. The reporter said the child “turned her head” and began “tapping her leg with her fingers”. The reporter said she asked the victim “did Chris touch you or Josh (unknown neighbor), and she didn’t say anything. The reporter said Chris is sexually abusing the victim (Annaclaire), and she calls him a “child molester”. It is unknown when the reporter asked the child about the incident. The reporter said she spoke with Leannah (mother) about the child’s “pee-pee” being red, and she said “she was taking care of her pee-pee and had a doctor’s

In 2011 an officer by the name of Jason Stockley was involved in the death of an african american who had fled police for about 3 miles before he had been caught and sadly shot. The trial on if he was guilty for murder or not went on for five years and the verdict finally came out that he was found innocent on the murder charge.

On January 5th, 2017, the Muskogee Police Department began an investigation into the possession and distribution of child pornography, by the suspect, Zackery Perry (“Perry”)(MPD Case #2017-557). Through the investigation and the analysis of electronic evidence that Perry possessed and was collected during a search warrant of his residence, a local juvenile victim was identified as Brooklyn Skelton (“Brooklyn”)(age 7).

REPORTER: The reporter/ FPS (Stephen) called to report physical abuse for the victim, Vantonio. According to the reporter, around 1: am this morning (01/26/2016), it was reported by the D’Iberville Police Department (Sergeant Crawford) that the victim was in a physical altercation (no details given) with an older adult. The child refused to go home. Sergeant Crawford called the reporter for assistance. The child wanted to go home with an older adult that he knew, but it was reported that she was under the influence of marijuana. His mother (Robin) was unable to pick him up, due to not having any transportation. The children told their aunt (Felisha) that their uncle (Eutique) has been fondling and touching them inappropriately. No details were known. Felisha contacted Law Enforcement, and they contacted DHS. A safety plan was set up, and the children were placed with Felisha. The reporter went to Felisha’s home on 6-9-16, around 6:00pm. 3:40pm- IRTC spoke with CPS, Shanika Brown, who reported that this case is no longer assigned to Detective Henry, because Detective Flex actually received this investigation yesterday (8/7/17). CPS voiced that this case might have been submitted to NYPD as a LER, but it is unknown if NYCACS was alerted of that investigation. CPS uttered that she spoke with Detective Felix who reported that she already spoke with the subject child yesterday who confirmed the narrative and identified the perpetrator. CPS voiced that the incident occurred at the listed address; the perpetrator was working at the facility and the subject child was volunteering. CPS stated that both parties met, began conversing, which ultimately led to them engaging in sexual intercourse

The reporter stated on 08/09/16, Tynia disclosed to her physician that at the age of 2 her 30 (+) adoptive brother raped her; it's unknown if the adoptive brother was 30 when the incident occurred or if he's 30 now. The reporter stated it's unknown if the child was in MI or LA when the abuse occurred, if she still has contact with the perpetrator, or if the abuse occurred more than once. Defendants base their Section 2-619 motion to dismiss on Section 2-201 and 2-109 of the Tort Immunity Act, which immunizes public employees from liability where the injury claimed is the result of a "discretionary policy determination."Hascall v. Williams, 2013 IL App (4th) 121131, ¶ 23. A "determination of policy" are those decisions that require the governmental entity or employee to balance competing interests and to make a judgment call as to what solutions will best serve each of those interests. Reporter noted Kaleb and the other children were left in the care of the boyfriend (Markquis) on yesterday (03/23/16) while the mother was at work.
