As a result of the foregoing, an actual controversy has arisen and now exists between plaintiffs and defendants DPR concerning their respective rights and duties. Plaintiffs contend that their security interests in the collateral described in the security agreements continued notwithstanding the sale or disposition to defendants DPR of the collateral, and continue to this day or, alternatively, defendants DPR should be estopped from asserting any right, title, or interest in the collateral senior or adverse to the security interests of plaintiffs in that recognition of any priority interest by defendants DPR would sanction fraud and promote injustice because recognition would effectively render plaintiffs’ security interest illusory, thus allowing
Ethical dilemmas occur when there is a disagreement about a situation and all parties involved question how they should behave based on their individual ethical morals. (Newman & Pollnitz, 2005). The dilemma that I will be addressing in this essay involves Michael, recently employed male educator working in the nursery, and parents of a baby enrolled at the centre. The parents have raised concerns about male educators changing their child’s nappy as they have cultural practices that do not allow this practice to take place. This situation is classed as an ethical dilemma as there is a dispute between cultural beliefs and legal requirements within the workplace. There are four parties involved (parents, child, educator and director), all
In my research project I am going to use discourse analysis so there may not cause any ethical issues. Even there are any ethical considerations, may be I need to be careful of my wording while discourses the journals, avoid to write in a bias way. Moreover, I will interview with at least five University Lecturers who are experts in Child Trafficking. However, it may cause bias or gender race discrimination during the interview section while the interviewee sharing their opinion and analysing trafficking. Although interview of expert will cause ethical issue, I believe that they are professional in this area and usual to talk about child trafficking, so this is just a minor issue.
Ethical implications arise when a situation deals with principles of morality and resolution is neither right nor wrong. Because of the stress and emotion ethical dilemmas present us with; steps have been recognized to help work through determination. Although each and every situation is unique, a framework for problem resolution along with laws for ethical situations has taken effect.
Pertaining to or dealing with morals or the principles of morality; pertaining to right and wrong in conduct (Dictionary.com).
My coaching philosophy will be based on athlete safety regardless off or on the field, player development not just in sport, but in themselves as a person and through education, and well-being of the athlete such as their responsibility if you were to play sport.
Business ethicist Kirk Hanson says that “ethical dilemmas are inevitable,” occurring more in the first year as a professional than in succeeding years (Markkula Center for Applied Ethics at Santa Clara University, 2011, 0:55). As a business professional, it’s very likely that I will face an ethical dilemma, or even multiple ethical situations throughout my career. This is why, as Hanson explains, “you need to be aware of what your own values are” when confronting ethical dilemmas (Markkula Center for Applied Ethics at Santa Clara University, 2011, 1:15). It’s important for me to know my own values because they will provide a foundation for my decision making when involved in an ethical conflict.
On controversial ethical issues, I am a universalist believing in my viewpoints of ethical issues such as abortion, euthanasia are non-negotiables. For controversial ethical issues I would not waiver against the ethical issues however, I realize not everyone has the same viewpoint. I believe it is important to create laws and regulations for society to comply to provide guidelines to contend with controversial issues which disrupt the humans and society. The viewpoint of the universalist and relativists are clearly different on the ethical issues of abortion and euthanasia. It is extremely important to maintain a balance between these two strong factions which often collide on their viewpoints trying to change the laws to suit their morals
An ethical dilemma is an incident that causes us to question how we should react based on our beliefs. A decision needs to be made between right and wrong. I have experienced many ethical dilemmas in my lifetime, so I know that there is no such thing as an ethical dilemma that only affects one person. I also know that some ethical dilemmas are easier to resolve than others are. The easy ones are the ones in which we can make decisions on the spot. For example, if a cashier gives me too much change, I can immediately make a decision to either return the money or keep it. Based on Kant’s, categorical imperative there are two criteria for determining moral right and wrong. First, there is universalizability, which states, “the person’s
Many perspectives can be taken when considering what fair is. As with most things, this too applies with the pay as you earn(PAYE) plan. The multiple angles and directions to view this plan lead to much conflict and controversy that keep this a trending topic, but even so, many people disagree on the degree of forgiveness this plan should permit.
The men of Macon county who were from a line of lower educated people and farmers were mistreated, lied, and used as experiments is one of the most shocking things I have learned in the class so far. It really hits home for me because I come from a small town in rural America where you wake up earlier work all day, get home when it?s dark just to survive in this world. I could not even begin to imagine doing this while being subjected to the treatment these men where by the government. I don?t feel as if informed consent would have even mattered in this experiment and make it ethical, there are multiple reason why I say this. The nation was at a place where blacks were viewed as less than humans and only white folk mattered. The scientific
When faced with ethical dilemmas, medical practitioners should be guided by the ethical precepts of autonomy, beneficence, nonmaleficence and justice. These ethical precepts are of absolute importance in which ethical problems, faced in medicine, are taught to professionals and medical students alike (Christen, Ineichen & Tanner, 2014). Where conflicting obligations and responsibilities are faced, these codes will also provide some sort of framework in making informed choices (Turner, 2012). The purpose of this paper is to briefly explain what these four precepts are, and to apply them to the disciplines of psychotherapy, public health and scientific research to demonstrate how important and vital it is to adhere to them. I will also apply
“Brad is a production engineer at a bicycle company and part of his job includes inspecting broken bikes and drafting the design repairs for their repair” (Bartlett). Brad is considering replacing a broken brake cable with a more durable material, even though the customer did not request it in their order and specifically requested that “No aesthetic changes be made to the bike” (Bartlett). Brad’s manager suggests that his considered actions would go against the company’s policy of “The customer is always right.” Should Brad disobey the manager and the customer to possibly lose his job or go along with
After analysis of the ethical philosophies of the aforementioned, I now have come to the point where I further explain my personal view. To me, choosing to torture the child is not an ameliorative measure if war, poverty, and illness were substituted with the torture of a child; it is nothing but the cliché selection between the lesser of two evils, which is reminiscent of the adage that choosing the lesser of two evils is still choosing evil. In this, my philosophy mirrors that of Kant, in that I find it highly immoral that the child would be used as a means to Omelas’ ends. If the aim was to create a world free of all societal evils, being one child away is still inexcusable, noting the moral chasm that would separate Omelas from a utopia
Throughout the first chapter it spoke of what is morally right and what is morally incorrect. Something I found interesting was page 11 moral reasoning, why you might ask? Well I feel that it describes "the morally right thing to do is always the thing best supported by the arguments" (11). I liked this because if someone is going to do something they should have the right knowledge on the situation at hand, without the correct information they will make the wrong choice and that could end up affect either them or others in the long run. Now based on the discussion question which is "Ethics claims that the morally right thing to do is always the thing best supported by reason. What assumptions about human beings and ethical decision-making
The bioethical dilemma that I used in Module 1 was concerning animal testing and if it is reasonable to use animals in order for humans to advance scientifically, specifically in medicine. There are several individuals who feel as if animals are tortured needlessly. Although this is a popular viewpoint surrounding animal medicine, there are numerous rules and regulations ensuring that the animals are taken care of and treated humanely at all times, a couple of which are the IACUC Guidelines and the Animal Welfare Act (references below). These provide a framework so that the animals are not abused and we as a people may still conduct research in order to work towards various cures and treatments for the ill individuals in our society. The dilemma is that most individuals feel a moral obligation to ensure that animals are treated well and unfortunately media coverages are incomplete at best, leading those who are suspicious to
