Federalism Pros And Cons

In the Unites States of America Federalism is the basic structure of the American government; it is the distribution and balance of powers between the National government and the States government. In order to obtain a compromise between those who wanted stronger state government and those who preferred a stronger national government the founding fathers arranged and settled for a federal system rather than the alternatives of a unitary or confederal system. While both National and State governments each have specific powers and authority, they also share certain powers and must be able to cooperate effectively with each other.

A federal government is one in which the powers of government are divided between a central government and several local governments. An authority superior to both the central and local governments makes this division of powers on a geographic basis; and that division cannot be changed by either the local or national level acting alone. Both levels of government act directly on the people through their own sets of laws, officials, and agencies. A great advantage of this system is that it has a strong federal unity, and the government can actually handle local problems. The government officials also have to respond to the people who elect them, limiting the power to only the government. It can also devote more time to national and international problems as well. The people have more power in this system! Then again a system always has disadvantages too. Like the fact that there are duplications of services, and citizens living in different parts of the country will be treated differently, like what is taught in the schools and in deciding where highways and government projects are to be built.

I agree with federalism because it ensures that one group never has too much power. Additionally, different states may have different values or needs and should be able to adopt their own policies. The structure of the legal systems ensures that no one branch has unlimited power and allows the three branches to keep each other in check. The organization of the American legal system is both diverse and unified at the same time.

One alternative to a federal system would be a unitary system. While a federal government (such as the one in the U.S.) divides power between national governments and local governments, a unitary government does not and all the power is in the national government ex- if the U.S. used a unitary government, marijuana would either be legal or illegal in the whole country compared to in the current federal government where various states have marijuana legalized such as; Washington, California, Colorado, and others haven’t legalized this drug; Texas, Idaho, Utah. A common misconception about a unitary government is that it is a dictatorship, which is not the case at all, they can still be democracies like France, question is would the people be more comfortable with all the power in the central government or a division of that power to local or state governments.

A federalist government is more balanced because of the roles the local, state, and national governments play in creating order.  Federalism has changed over time because of the power of the states. State and local governments have the power to make decisions and enforce policies that affect the people. Federalism guards against tyranny by dividing the power between central and state governments. Some powers given to the central government are to regulate trade, to declare war, and etc. Powers given to the state government are to hold elections, establish schools, and etc. Both the state and central governments check each other to make sure one doesn’t get too much power.

When the constitution was written, it was written so that the President of the United States is not chosen through a national popular vote, but through an electoral college, which gives each state as many votes as it has members of Congress. The system was created as a middle ground in order to keep voting fair, and to balance between congress voting and the people. Federalism has been a way to help control the abuse of power. Flexibility allows the government to work with the different traditions, and religions of people, and allows the states to develop their own policies without putting the whole country at risk. Citizens are also given the opportunity in running the government, and making contributions.

Federalism can be said to be the defining feature of all forms of American politics. Even as a literary characteristic feature, America was the first nation to adopt federalism as a concept. Federalism is a system of government whereby political power is divided between a national government and other smaller political constituents such as states. Federalism has played a large role in our government since the time that the Constitution was ratified. It originally gave the majority of the power to the states. As time went on, the national government gained more and more power. It used the "necessary and proper" clause of the Constitution to validate its acts, and the Supreme Court made decisions that strengthened the national government creating a more unified United States. Finally, the recent course of federalism has been to give powers back to the states.

Federalism is a compound way of governing, with a central government, also known as a federal government, and a local government. Each government had their own powers, but to accomplish the bigger goals the key was to have cooperation and teamwork to solve the issue. The federal government’s powers were solely focused on war, money and relations with other countries and states outside of the United States. In accordance, the local government took care of the more specific things going on in that certain state. For example, they took care of things such as elections, constructing schools, and passing laws for marriage and divorce. The idea of Federalism is that power is shared between a federal and state governments. Under the Articles of Confederation, there was a federal government but the federal government was so powerless when compared to the power of the states. The United States has a deeply rooted and embedded tradition through the Constitution of having a federalist style of governing as its structural framework for operating and guiding the government of the country. The United States government needs a strong base and a government that will protect its people. The people will not survive if there are not officials. Anti-federalists wanted each state to have its own local government which in turn makes the states less unified. If each state has different laws and there is no centralized government than there is no similarity between the states other than being on the same continent. The states have to remain united and have a strong central government so that all Americans have the same rights and laws that they are governed by.

I believe that we should keep our federal system because it is the best choice for our country. Our system separates the power between national government and state governments, it divides the power between the three branches. Our system protects against a tyrannical government and that is the biggest reason our government is created like it is. Also, federalism is more effective when some of the power of the national government is divided between all of the states, allowing the states to create solutions to their own problems, applying laws that work best for their state.
