After reading the transcript of the speech, “The Spirit of Liberty”, given by federal judge for more than 50 years, Learned Hand, who served most of the time on the U.S. Court of Appeals for the Second Circuit in New York, my idea of what it means to be an American was slightly shifted. The statement made by Hand which really caught my attention was, “What do we mean when we say that first of all we seek liberty? I often wonder whether we do not rest our hopes too much upon constitutions, upon laws and upon courts. These are false hopes.” I agree with Hand in the sense that the constitution can only serve purpose to our country if we, as Americans, learn to be truly accepting. To be an American, means to me, that you are accepting of the differences around you; however, we as Americans are not very good at accepting those who do not agree with us. In an article,a publisher for NBC News, quoted a leading crimes researcher who stated, “hate crimes in nine U.S. metropolitan areas rose more than 20 percent last year, fueled by inflamed passions during the presidential campaign and more willingness for victims to step forward.” Many believe being an American means you have freedom, but what freedom? Freedom of speech? Freedom of Religion? The other “freedoms” stated in the Bill of Rights? How true can that be if those around you are so quick to go as far as harming others just for being different. Americans often hide behind their right to freedom of speech to be demeaning, but
Freedom of speech is a fundamental human right. Whether or not on a college campus, people (especially college students) should have the right to speak freely. Everyone does have the right to speak freely, because it is one of the twenty-seven amendments. Colleges all around the United States are now home to many restrictions on free speech. For example, the idea and use of “free speech zones” has made its way to colleges everywhere. A “free speech zone” is a sidewalk sized place where students are allowed to speak their minds freely on college campuses. I know what you’re thinking. This sounds ridiculous. Why are there specific places for people to speak their minds? Aren’t colleges suppose to be a place where students speak their minds and learn new things? Universities should not be able to put any restrictions on free speech.
In the speech “The Spirit of Liberty”Learned Hand says,”Liberty lies in the heart of men and women; when it dies there, no constitution no law no court can save it; no constitution, no law,no court can even do much help. “ I agree with Hand because if the people think they have no liberty and can never get it they won't fight for liberty. For me to be an American means to have freedom as a whole equality and justice.. The most important Ideals related to being an American is equality, freedom and justice
America is well known for being the land of opportunities, the land of freedom, land of diversity, and overall, the land of success. However, the title of being " The Greatest Nation" didn't come to America so easily. It surely is a challenge to make of the United States of America the ideal nation that Thomas Jefferson envisioned. For this reason, the constitution emphasizes the guidelines that one must follow in order to be an ideal American. In the Bill of Rights, James Madison remarks the 10 basic amendments that America needs to follow in order to maintain its values. To be an ideal American, one must understand the vision of the founding fathers. It is understandable to conclude that The Bill of Rights is a set of guidelines that make up an ideal American. Therefore, what truly defines an ideal American is being able to
For me being an American means treating everyone that come with respect and equality, no matter the race or religion. As once stated by Martin Luther King, “No two leaves are like, and yet there is no antagonism between them or between the branches on which they grow.” When I came to America I was different from the rest, however whenever I was discriminated about something it made me feel bad and made me think that America was not really the country I was looking up to. By being an American, you should look up to your country and be proud, however, if you discriminate, it makes you look like a save
According to the Bill of Rights, we are afforded the freedom of speech through the first amendment. But this awarding of freedom is only allowed if it goes along with what the general population deems “normal”. During the middle part of the 1900’s many books were banned on political, religious, and moral views. While our society has changed these issues are still prevalent in today’s public views and opinions of author’s work. These books are not “normal” and that is why they play an unprecedented part in literature today. Books written in this era had a different political, religious, and moral atmosphere than those written in the modern day; but these same issues arise in today’s society.
Explained in Hand’s speech, the essence of liberty is not to be found in constitutions, laws, or courthouses, but “in the hearts of men and women”. No written
Under the First Amendment, we as Americans have protected rights known as Freedom of Speech. How I see Freedom of Speech is it gives us the right to voice our own opinions without any retaliation or repercussions. An example in which Freedom of Speech may be utilized is before, during and after a Presidential Election. Many people will have their own opinions about how they see each Presidential Candidate fit or unfit. Alot of times after people exercise this right, Rallys and Protests occur. Unfortunetly sometimes when this does happen, boundaries are overstepped. This can result in threats, crimes, slander ad even people getting
Freedom of speech is a right in the first amendment that is allowed to every person. No matter the age, gender, or race every person has a different way of thinking, and it's a right for them to be able to express it. Freedom of speech means that every person has the right to express their opinion without having to worry about society or the law threatening them.We are all different due that we are individuals that think, express and process in a variety of ways.If people are comfortable enough with each other thoughts why do people despise when we express them publicly, even when an opinion is never right or wrong. What we can say is that today's society has changed what freedom of speech means. We have changed the way we express our thoughts
The First Amendment say’s “Congress can make no law not allowing freedom of speech to be used by the people”. Now I will give u some historical background. The First Amendment without a doubt was an action against the silence of free speech that existed in The English society. Until 1694, there was a complicated system of licensing in England, and no public was allowed without a government license. Blackstone, with his famous commentaries in law, said that “the liberty of the press say’s laying no previous restraints upon publications, and not in freedom from censure for criminal stuff when published... To subject the press to the power of a license . . . is to subject all of the freedom of sentiment to the power of one man, and make him the
The First Amendment of the Constitution protects individuals freedom of speech. Many people think they have the right to express whatever they want, which most of the time it is true, but sometimes it does have consequences even though it's not illegal.
Everyone is entitled to their own opinion, “Freedom of Speech” as the First Amendment of the Constitution states, however, just like you said “destroying properties” does not justify whatever it is they are protesting for. I agree with you, someone will always be angry and feel that their rights are not being respected; I don’t think that people will ever come to a total agreement on certain issues, at least not on this world. The Ten Commandments were removed from public schools because someone was offended by it, just like removing "under God" from the U.S. Pledge of Allegiance. As a Christian myself I believe that my rights of freedom of religion are not being respected, when on the other hand someone that is not a Christian can care
Freedom - Power or right to act, speak, or think without hindrance or restraint, but isn’t it more? The framers of the Constitution promised the freedom of speech to all citizens of the U.S. through the first amendment. What is “America’s Gift to my Generation”? Well, it’s the freedom of speech, here are three reasons why. By allowing me to say what I believe, I can make “some” decisions and communicate them, and I’m able to think freely.
In modern day America, the topic of freedom of speech is widely disputed. More specifically in regards to when you are protected by our first amendment. It is extremely important to know what this right entitles as a way to protect yourself, as well as to keep yourself from looking like an idiot. For example, being banned from a social media site, such as Twitter, does not violate the constitution.¹ This is because Twitter is a private organization. This is also why you can be fired from your job if you say something incriminating on the internet.¹ The first amendment does not apply to private organizations. As well as this, you cannot be fined or punished for something such as not standing for the pledge. This is because it “is an act of political
Philadelphia 1787, our forefathers set forth the ideas that would establish a country of free men escaping the persecution of England. They created a set of right that every American or immigrant, has an equal opportunity too. When someone tries to take this away, by this paper, they are our enemy. A right that everyone knows is freedom of speech. As an American, I live in a country that allows for me to be whatever I want or say whatever I want, as long as it does not directly hurt an individual or group. Due to current events, freedom of speech is limited for a group of individuals. Oddly enough it's not the group one would think; it is not the Neo-Nazi’s who killed someone in Charlottesville or the group of white kids who hung a biracial child from a tree, it is the NFL players who kneeled during the anthem. A right is a right no matter what race, religion, creed, gender, or sexual orientation. Although I do not think what the NFL stands behind is solid ground, I still believe that their right to protest should not be taken away. Presidents Trump's words toward these players who did not stand were utterly uncalled for. I do not want someone who directly called a group of citizens “sons of bitches” to protect a country of millions. His statement that they should be “fired” for protesting is absurd. They, as with millions of others think that the treatment of minorities in this country is unfair, that is why they are protesting there is no other reason. If Trump wants to suppress their free speech, he must be equal and suppress all forms including his white supremacist brothers.
Have you ever thought about why we have a right to speak? The Freedom of Speech allows us to express our opinion,to show we have a say in things, and everyone has the right. The Bill of Rights states that congress shall make no law prohibiting the Freedom of Speech. Everyone should have the right to state their opinion.
