I hate shades gray and the argument of “morals” in laws. Unfortunately, that is all Parent liability laws are, morals. And there the worst type of morals, old morals. And there popular, and the worst part is that the plaintiff and the defendant alike have strong cases against each other.
After putting on my grandmother’s readers and looking over the case and listening to witness, my gavel has been brought down. Parent Liability laws aren’t inherently bad their just poorly written. The government should articulate parent liability laws to make them fair, effective and beneficial.
Let’s first discuss why parent liability laws are important and even exist. Parent liability laws are a new idea if you look at the span of history. Even

One of the great psychologist of the world, Dr. Phil, has repeatedly stated the importance of the relationship between the child and their same-sex parent and in 2005 69% of polled people thought parents were partially responsible for children 's crimes these same people however did not believe that parents should be punished (Fabio,2014). However, this relationship had more impact on children then it does now. The idea that parents are solely responsible for their child’s crime is outdated, and certainly we wouldn’t want laws that are that are unfair like a ban on gay marriage.
Frankly, liability laws may also be ineffective. To be honest there are a lot of ineffective laws that are put in place, such as Baltimore ordinance “not to curse inside the city limits.” Obviously, that law is not being followed, but laws like this don’t harm anyone because they 're not enforced and are more less left over from times when America was trying to better itself, like during the prohibition, a stark difference when compared to liability laws.
These laws hit single parent or low income homes more than stable two parent household. Gang members often come from low income household and the children of low income households are more likely to be exposed to violent crime. The rates of adolescent exposure to violent crime are rising. Teenagers are more likely to be victims of
Today, obtaining a license is necessary for a many activities including: driving, hunting, fishing, scuba diving, teaching, and practicing medicine, to name a few. In recent debate, licensing another aspect in our lives has arisen: parenting. Although incompetent parents exist, the need for a license to parent is an unethical and unconstitutional requirement that is impossible to regulate both before and after the birth of the child.
If a child acted violently toward another child, should the parents of that child be held responsible for the inappropriate behavior, or should the child take full responsibility for his/her actions? This question of responsibility comes up often in Mary Shelley’s novel, Frankenstein. Her horrific and dark tale of the mad, science-obsessed Victor Frankenstein, wanting to create life from what had already been dead, evokes questions of who is at fault for the creature’s murders. Although some may say that the creature is at complete fault because he is own “person”, but ultimately Victor is at fault because he is the one who created a being that destroyed the lives of innocent people due to how he treated the creature.
Gang involvement and its associated violent crime have become a rapidly growing problem for the United States. Generally, gangs consist of young people of the same ethnic, racial, and economic background. Usually of a low socio-economic status, these gangs engage in illegal money making activities and intimidate their neighborhoods and rival gangs with violent crimes and victimization. Gang members exemplify a high value for group loyalty and sacrifice.

For example, in Cheng v Cheng the court held that it is enough to demonstrate a settled intention to treat children as their own for the person to be liable to pay child support. Moreover, the child support responsibilities could extend beyond the biological parentage, because in Cheng v Cheng these obligations extended to the
United States can be analyzed to support the charge. The case involved Shirley Green who was not the legal guardian of a child that failed to provide food and medicine for the child resulting in his death. She was charged with involuntary manslaughter, but it was reversed because there was no finding of legal duty CITE218. Legal duty is a critical element is cases and since Mrs. Kones has a legal duty for the care of John Jr. she can be charged with this crime. Within the text it explains that someone ca be held criminally liable when there is a statute that imposes a duty. Next, when someone has a certain relationship to another. When someone accepts a contractually duty to care for someone. Finally, when someone voluntarily assumes the responsibility to care for another CITE 218. The next individual that can fall under this category is the defendant’s husband, Charley Kones, despite not being the biological father of the child, upon marrying Cynthia he assumed responsibility for her offspring. This can be supported by the case of People v. Carroll were a stepmother was charged with child endangerment for failing to stop he husband from killing his daughter CITE229. The New York Court of Appeals concluded that the stepmother had a duty to care for her husband’s children because “a person who acts as the functional equivalent of a parent in a familial or household setting is … legally responsible for a child’s care” CITE229. The husband
“There is no scientific basis for concluding that lesbian mothers or gay fathers are unfit parents on the basis of their sexual orientation” (Armesto, 2002; Patterson, 2000; Tasker & Golombok, 1997). Ever since gay and lesbians have been parents people have questioned how the parents’ sexual orientation impacts child and adolescent development. Opponents of same-sex parents argue that sexual orientation has a negative impact on child development, while proponents argue that the relationship between the child and parents is what matters. National, state, and local governments are faced with the controversy surrounding same-sex parenting. People have very strong opinions on both sides of the argument. Children and adolescents who are under lesbian or gay parents have normal child development compared with children under heterosexual parents. These children develop normally socially, mentally, and academically.
. So now the real question emerges: Is parental guidance by two parents of thesame sex really more harmful to a child¶s development than no parental guidance at all? In someminds the answer ³NO´ flashes in bright, blinking lights however, there are many, including themajority of Americans, who disagree. Laws banning adoption by gay and lesbian couples exist
Gangs have direct effects on a society, such as increased levels of crime, violence and murder. Gangs also have long-term or late suggestions in that gang members are more likely to drop out of high school, struggle with unemployment, abuse drugs and alcohol or in end up in jail. These factors not only contribute to the gang members, but they also force taxpayers to pay for welfare and community-assistance programs. Common reasons for the younger generation to join gangs, include trying to find a place where they belong and sharing in mutual desires for safety from family problems or life challenges. Together, the feelings and attitudes among gang members haze them to act violently, often self-contradictory with rival gangs. This violence leads to injury and death of not only members but also of bystanders in the community. High gang activity also causes fear among community members, discourages business activity and obstructs home-value appreciation. Communities, also must pay for higher levels of law enforcement when gangs are prominent.
For the most part, parents have the best interest of their children at heart. However, there are unfortunately many cases throughout the United States where parents are unable to, for one reason or another, take care of their children. Sometimes, this can be seen as a health issue of the parents. Sometimes, parents are unable to raise their children well due to physical, financial, and/or emotional issues. Other times, parents do not have the best interests of their children in mind and can be neglectful or abusive to them. In these circumstances, the state may become involved and step into
Gay parents are facing discrimination because of their sexual orientation. Twenty-two states currently allow single gays to adopt and 21 states currently allow gay and lesbian couples to adopt in the U.S. (Mallon, 2007, p. 6). The ability of gay couples to rear a child should not be denied only because they are gay. Homosexuals may be looked down upon by society, but they still are humans and have morals. These morals they possess, may influence a child more than those morals taught to a child with heterosexual parents. All over the world, children suffer in families consisting of alcoholics, drug abusers, and sexual abusers (Powell, 2007, p.1). It is not possible that these environments are safer than what would be provided by homosexual
