The are many different forms in which a juvenile is victimized, but three apparent causes of delinquency are bully victims, property delinquent victims, and sexualized victims. The bully victims are victims who actively engage in violence or carrying some form of protection like a weapon and have been violently victimized in the past. Property delinquent victims are more closely associated with property crimes. Delinquent sex victims and child maltreatment victims experienced sexual victimization in the past and were involved in an above average level of delinquency. This is some form of correlation of juveniles ultimately becoming delinquents in response to their victimization. The apparent similarities between victimization and delinquency are displayed by the types of victimization suffered and the number of criminal acts recognized. According to Cuevas, “41.7% of males have engaged in delinquent acts as opposed to 29.6% of females” (Cuevas, C. A., Finkelhor, D., Turner, H., Ormrod, R., 2007). When a juvenile commits a crime, it is not considered a crime, however it is considered juvenile delinquency. A massive problem throughout the US is juvenile delinquent acts. Juveniles acting out in a delinquent manner can be caused by many things. However, there is not just one reason why a juvenile may commit these acts. Instead there are many reasons that could lead up to delinquency. In this essay, I will be discussing a few theories as well as ways juveniles may receive treatment.
There have been numerous studies throughout the decades regarding childhood victimization and how it relates to adult criminality. This report will summarize a few of these studies and compare their results in order to attempt to find a correlation between childhood abuse, neglect, or sexual abuse and adult criminals.
Abuse and delinquency have been linked together for many years. There have been many studies done to determine whether victims of abuse have higher rates of delinquency, as compared to those who have not encountered abuse. It has been found that adolescents who were victims of sexual assault were three to five times more likely to experience posttraumatic stress disorder, be abused again, be dependent on drugs and alcohol, or commit delinquent acts compared with adolescents who were not victimized (Impact of Child Abuse, 2011). In another study that was conducted to examine the relationship between abuse and delinquency, the data that was found, supported the data that was found in the study above; the authors of the study found that abuse nearly doubles the probability that an individual will engage in crime. This information was found to even be true with twins, one of whom was abused and other one was not (Currie & Tekin, 2006).
Youth who come to the attention of the juvenile justice system are often a challenging and underserved population. While not all youth who experience trauma engage in delinquent activity, and vise versa, studies have shown that youth who are involved in the juvenile justice system have found to have higher rates of traumatic experiences. The National Center for Mental Health and Juvenile Justice (NCMHJJ) reported that 2% of all children are victims of maltreatment, 13% are victims of neglect, and 11% are victims of physical, sexual, or emotional abuse (Ford et al., 2007). In the case of Cyntoia Brown, the audience learns early on that the sixteen year old faced sexual abuse from a man called “Kutthroat.” In an interview with Dr. William Bernet, forensic psychiatrist, Brown admits that “Kut,” real name Garion McGlothen, would choke her until she passed out, force her to strip, and hold a gun to her until she complied with his orders (The 16 Year Old Killer: Cyntoia's Story). According to Ruddell and Thomas, physical and emotional victimization in girls can also lead to delinquency. In fact, 92% of girls interviewed report some form of victimization in their lifetime (Ruddell & Thomas, 2009, p. 140).
Victimization comes in many different forms such as assault, child physical/sexual abuse, stalking, theft, rape, sexual harassment, and domestic/relationship violence. There are several negative outcomes that have been linked with childhood abuse and neglect such as neurobiological changes, emotional and psychiatric disorders, interpersonal issues and substance abuse problems (Min, Singer, Minnes, Kim, & Short, 2012). According to Reid and Sullivan (2009), children and adolescents are very vulnerable and are the most highly victimized individuals of the population and the kinds of victimization that they experience can come in many forms (Finkelhor et al., 2009). This victimization is known as poly-victimization (Finkelhor et al., 2009).
Strain theory describes the idea that there are certain events and conditions in an individual’s life that are disliked and involve the inability to achieve goals, loss of positively valued stimuli, and presentation of negative stimuli (Brezina and Agnew). Child neglect and abuse can be described by this theory, and often is, because of its elements and the effect it has on children. Before the idea of child abuse and neglect causing juvenile delinquency can be argued, juvenile delinquency must be defined. Brezina and Agnew define juvenile delinquency as law violations committed by minors. One of the largest debated consequences of child abuse and neglect is it causes juvenile delinquency in victims. Juvenile offenders are view by the justice system as “‘immature’ in the sense that they are less capable of appreciating the consequences of their actions, less able to exercise self-control and more easily lead astray by others.” Supports of this claim say abuse causes delinquency because weak bonds, low self-control, and confrontation with negative stimuli.
Juvenile delinquency is a social issue in the United States today. Juvenile delinquency, is when “a violation of the law is committed by a juvenile and is not punishable by death or life imprisonment” (Juvenile Delinquency). The juvenile system is different from the adult system in many way and most juvenile delinquents are from the age of ten to the age of seventeen (Juvenile Delinquent). Once the delinquent or anyone is at the age of eighteen, they are considered to be an adult. Therefore, in the justice system they are tried as an adult. There are many different reasons why a child would commit crime, such as mental and physical factors, peer influence, home conditions, neighborhood environment and school conditions. Teens are greatly influenced by the interactions and surroundings they are around. Their behaviors can result from the parent and/or their peer influences. Parents play a great role in the child’s life and a teen’s peers also play a strong role in how the teen behaves when the parents are not insight. This research will examine links between the social environment of teens and how it influences the teens actions and behavior which leads them to commit an offense.
A person who experiences a traumatic event may be expected to experience a range of psychological effects, and, for many years, it was assumed that these psychological effects would be the same regardless of the cause of the injury. However, a growing body of knowledge is demonstrating that the impact of criminal victimization is different than the impact of other types of injuries because the intent element makes a difference in how the victim perceives the harm. In addition, victims of different crimes may respond differently to victimization. The psychological effects of victimization are important because they can help guide the criminal justice system for how to interact with victims and how to make the process more victim-appropriate. For example, victims of violent crimes, like sexual assaults, may benefit more from a victim-centered criminal justice approach than victims of other types of crimes (Resick, 1987). However, one of the problems with the traditional approach to victimology is that it has distinguished between different groups of victims. Emerging research suggest that victim needs are similar across the entire spectrum of crime, particularly the victims' needs for information about the crime and the needs for financial restitution to make them whole (ten Boom & Kuijpers, 2012).
While the theoretical reasoning that supports the idea that child abuse often leads to crime gives a basis for the concept, much of the evidence that links the two lies in the concrete details. The visible effects of child abuse and neglect that assist with the basis that has been given by the psychological theories lies in observable behavioral and emotional effects of those who are known to have been subject to maltreatment as children. Research conducted in the United States of America clearly identifies an interaction between victim age and abuse characteristics (USDHHS, 2003). There exists a negative correlation between the onset and prevalence of physical neglect and victim age, for instance, indicative of a young child's dependency upon the caregiver for supervision and nurture (Mash & Wolfe, 2005). The incidence of physical and emotional abuse is also most prominent during developmental periods of independence, specifically the early, pre-school and adolescent transitional stages of development (ibid). Sexual abuse has prevailed most consistently, however, from an onset of age 3 throughout childhood, highlighting the vulnerability of children across the age-spectrum (ibid). Nevertheless, victim gender is emphasised as an influential variable within the incidence and nature of sexual abuse; for females have accounted for up to 80% of reported victims and are more likely to be abused by male family members in contrast to male victims, where the perpetrator of abuse is more likely to be a non-family male offender (USDHHS, 2003; Berliner & Elliott, 2002).
Juvenile delinquency is of great concern in the United States. In 2007 over 2 million arrests were juveniles. There are two types of juvenile delinquency. The first type of offense is a behavior that would be a criminal violation for an adult. The other offense is called a “status” offense. Status offenses are delinquent actions that do not apply to adults, like running away and truancy. This paper will discuss the impact of gender and family on delinquency and the treatment by gender in the juvenile justice system.
Many children become familiar with the Juvenile Justice System without knowledge of why they continue to commit crimes. Many of them suffered years of being abuses, which caused socialization changes that pushed them to withdraw or act out. This research is important because it shows the long terms effects child abuse has on children that become juvenile delinquents. Statistics show increasing numbers of children who are the victims of child abuse and neglect, although they decrease in delinquency may reflect a greater nation focus on the issue and the use of more effective programs to attack the problem. This research is important to me because the Criminal Justice System doesn’t address the causes of deviant behavior in juvenile delinquents to its full potential. They rather just focus on policing and tough sanctions. Hopefully with this paper and many others child abuse can be prevented along with the long-term effects of child abuse and better programs can be invented to treat child abuse victims.
