The hard drive on the desk would be a good third source of digital evidence to seize. Assuming this hard drive is used for additional storage (i.e. does not have an Operating System on it), it would contain data similar to that which would’ve been on the USB Flash Drive: documents, images, videos, and maybe even some software files. Documentation should be done on the make, model, serial number and type (e.g. SATA, IDE, SCSI) of hard drive. For transportation, again, place into a static shock protective bag. Remember to keep the hard drive away from anything magnetic as the platters that are inside the hard drive are magnetically charged (U.S. Department of Justice, 2008).

Makestuff Inc. is a company that has just been alerted that an employee that was just fired for cause and, do to comments made by MR Got Yourporp during his exit interview, is suspected of stealing a newly developed program in order to give it to a competitor. When this situations occurs a company needs to investigate in anyway legal way it can in order to protect its propriety. However, if a company is to investigate there are several thing/questions they need to be aware of, such as what places can the company search and what items they can confiscate.

To be classified and considered as an expert witness, the person is required to have some sort of documented forensic experience that would classify them as a technical expert in a field of study. The big difference between an expert witness and a “regular” witness also known as a lay/factual witness, an expert witness is technically able to answer hypothetical questions as long as it falls in the guidelines of their area of expertise. For example, in a murder case, “a factual witness would be an observer of the actual murder or an acquaintance of the individuals involved in the case.
