New Jim Crow Racism

In the history of the United States, African Americans have always been discriminated against. When Africans first came to America, they were taken against their will and forced to work as laborers. They became slaves to the rich, greedy, lazy Americans. They were given no pay and often badly whipped and beaten. African Americans fought for their freedom, and up until the Civil War it was never given to them. When the Civil War began, they wanted to take part in fighting to free all slaves. Their opportunity to be soldiers and fight along side white men equally did not come easily, but eventually African Americans proved themselves able to withstand the heat of battle and fight as true American heroes.

Alexander’s main premises focuses on the large majority of African American men imprisoned today, as she reflects on the direct result of it that “young black men today may be just as likely to suffer discrimination in employment, housing, public benefits. And jury service as a black man in the Jim Crow era- discrimination that is perfectly legal, because it is based on one’s criminal record.” (Alexander, 181) Alexander points out not only how a significant portion of black men are ending up in prison, but how when released they face discrimination because of their criminal record making them unable to rehabilitate their lives and putting them back into the ghetto. Discrimination is a main factor which puts people of color in the penal system, and a main factor which when getting out keeps them from changing their lifestyle for the better.

Though most citizens in the United States would agree that the prison system in the U.S. needs to be amended, do they see the prison system as a way to enforce the racial caste system? At first Michelle Alexander, the author of The New Jim Crow, did not see the prison systems as racially motivated until doing further research. After researching the issue, Alexander found the prison system was a way to oppress African Americans and wrote the novel The New Jim Crow. The New Jim Crow follows the history of the racial caste system and in the novel Alexander comes to the conclusion that the mass incarceration of African American is the New Jim Crow, or in other words a new system of black oppression. Though some might try to refute the idea of mass incarceration of African Americans, Alexander offers a well thought out argument with substantial evidence and data to compellingly link Jim Crow and mass incarceration and proves that it is an issue that should be on the radar of all U.S. citizens.

Mass incarceration is known as a net of laws, policies, and rules that equates to the American criminal justice system. This series of principles of our legal system works as an entrance to a lifelong position of lower status, with no hope of advancement. Mass incarceration follows those who are released from prison through exclusion and legalized discrimination, hidden within America. The New Jim Crow is a modernized version of the original Jim Crow Laws. It is a modern racial caste system designed to keep American black men and minorities oppressed with laws and regulations by incarceration. The system of mass incarceration is the “new Jim Crow” due to the way the U.S. criminal justice system uses the “War on Drugs” as the main means of allowing discrimination and repression. America currently holds the highest rate of incarceration in the world, and even more African American men imprisoned, although white men are more likely to commit drug crimes but not get arrested. The primary targets of the criminal justice system are men of color. Mass incarceration is a rigid, complex system of racial control that resembles Jim Crow.

A large reason for the writing of this book is that there is currently not much research concerning or call for a criminal justice reform. According to Alexander, the main goal of the book is to “stimulate a much-needed conversation about the role of the criminal justice system in creating and perpetuating racial hierarchy in the United States” (2012:16). The New Jim Crow is a book that gives a look on how discrimination is still and at some post more prevalent today than it was in the 1850s. Author Michelle Alexander dives into the justice system and explains how a lot of practices and beliefs from slavery times are just labeled differently now. The labeling creates legal discrimination, but most people over look it because it is hidden with words such as “criminals” or “felon” in order to legally enslave and segregate a certain type of people. This discrimination is located in multiple areas of the U.S. government. Alexander goes through the ways of how discrimination is still prevalent in employment, the housing market, education, and basic voting rights. Alexander

But because of color-blindness, these facts are not realized by many people (141). Which makes it difficult to fix a problem that society does not know that it has (141-143). While chapter three introduces the shame that ex-prisoners face, chapter four entirely covers the system that goes into place after felons are released from jail (140). The stigmas that went with the Jim Crow laws, according to Alexander, were better than the current stigmas that African Americans face after they are released from jail in modern American(154-156). Alexander notes the dehumanization of African Americans and how the self-hate they began to face turns the entire black community against one another (161-167). Alexander believes that if there was any real equality during the Civil rights movement, mass incarceration would not exist, but it does today because of colorblindness (177).

Michelle Alexander’s The New Jim Crow: Mass Incarceration in the Age of Colorblindness goes into great detail on race related issues that were specific to black males, the mass incarceration, and how that lead to the development of institutionalized racism in the United States. She compares the Jim Crow with recent phenomenon of mass incarceration and points out that the mass incarceration is a network of laws, policies, customs and institutions that have been working together to warrant the subordinating status of black males. In this paper I will go into a brief examination of the range of issues that she mentions in her book that are surrounding the mass incarceration of black male populations.

Once slavery was “abolished” by the 13th amendment in 1865, the Blacks were promised their freedom and equality. However, this never happened because the American government still managed to oppress and discriminated them by creating the Jim Crow Laws. Jim Crow Laws of 1896 segregated whites from people of color in the Deep South. They segregated everything from water foundations to public school and they obviously gave the whites privileges and better facilities, while to the people of color they were treated as if they were

The New Jim Crow is a book that discusses how legal practices and the American justice system are harming the African American community as a whole, and it argues that racism, though hidden, is still alive and well in our society because of these practices. In the book, Michelle Alexander, author and legal scholar, argues that legal policies against offenders have kept and continue to keep black men from becoming first class citizens, and she writes that by labeling them as “criminals,” the justice system and society in general is able to act with prejudice against them and subordinate black Americans who were previously incarcerated, on probation, or on parole, by limiting their access to services as a result of their ‘criminal status’ and therefore, further degrading their quality of life. The New Jim Crow urges readers to acknowledge the injustice and racial disparity of our criminal justice system so that this new, more covert form of racism in society can be stopped.

Throughout history, African Americans both free and enslaved were not treated equally nor permitted with the same rights as white men. African Americans were enslaved and not allowed to vote or hold public office. Since the 15th century, African Americans have been treated less than human, some even experienced brutal punished for justifiable mistakes. The use of African American slave labor was an enormous contribution to agriculture and labor. It became a part of southern state’s economy within America. Additionally, African Americans were forced or born into slavery where they endured harsh working conditions with zero pay and often times were punished by their masters. Even slaves that became emancipated or paid for their freedom were also treated differently than whites. Notably, blacks did not have the same privileges as whites and were forced to carry a “freedom card” wherever they went. Failing to do so would lead to severe consequences, such as being forced back into slavery. Once African Americans were considered free, they faced additional discriminations such as not being able to vote or serve as a figure in public office. Due to this and additional factors, African Americans were almost entirely incapable of defending themselves against whites. Since the start of the 17th century, African Americans, free and enslaved were punished for their skin color and were considered the lowest scale by not being allowed to the same opportunities and rights and white men.

The United States of America is known for its claims of democracy, equality, and freedom for all of it’s citizens. These claims are the foundation of America’s independence and essentially its entire history. But “claims” are simply all they were in history. While many achieved equal democracy and freedom, the African-American population of the US was exempt from these “inalienable rights” and heavily oppressed by society. The cruelty of slavery and oppression as a whole reached its peak in the 19th century bringing upon the abolitionist movement, which eventually aided in the historic removal of slavery and the continued fight for equal right of citizenship for African-Americans. The African American experience is one that is quite different from other racial/ ethnic groups. The majority of the first African American came over, unwillingly, on ships from various African countries. They were brought to America by white, European settlers to be used as slaves in an order to plant and harvest their crops and make money for the white man. This racial group was treated as if they were property and not people. However, with the ending of the American Civil War, African Americans gained freedom, freedom that not all white American were quite ready to handle. After gaining their freedom came the need for education, jobs and suffrage rights. Now in America this racial group has come a long way, having elected its first African American present for two terms, yet still there are many issues that are very prevalent. This racial group has been fighting their way to equality since the birth of this nation. African Americans have experienced an array of conflict, violence, stereotypes, prejudice acts, and discrimination against them throughout their history in America.

African Americans have been through so much since being uprooted from their home in Africa. Most people do not understand what happened to African Americans and they understand what they had to go through to be where they are today. It went from being kings in the comfort of their home to being thrown on a boat packed like sardines to be forced to work in the fields. The trip was a massacre itself because many did not make it due to the treatment from others. African Americans have always been treated like outsiders and it took many people to sway the perception of others to be where they are today. Through all the ups and downs African Americans persevered and made it out the struggle. African Americans has always been treated badly all groups of people and they always looked down on African Americans. Throughout the history involving African American, it showed the constant inferiority treatment. African Americans were slaves years ago, people still look at blacks as less important than other people. Slavery has a huge impact on our society today because people are still bias and unfair towards African Americans, most African Americans are still living in poverty and don’t have proper education beyond high school which is why they don’t have the equal opportunity for jobs. African Americans still continue to sit in the shadow behind white people.
