The tension between rehabilitation and punishment has been increasing dramatically. This is because there have been sharp rises in the prison population and repeat offender rates. When one area is over emphasized in relation to the other, there is the possibility that imbalances will occur. Over the course of time, these issues can create challenges that will impact the criminal justice system and society at large. (Gadek, 2010) (Clear, 2011) (Gatotch, 2011)
Other punitive measures, that have developed out of the just deserts mentality, such as three-strikes laws, which required life sentences for those with three convictions, as well as Scared Straight programs and boot camps, have negligible or detrimental effects to recidivism (Andrews & Bonta, 2010). Studies have repeatedly shown that long prison sentences and lack of rehabilitation actually increases the likelihood of reoffending (Canadian Civil Liberties Association [CCLA], 2011). While using punitive measures in the name of retribution may make those in society feel safe, there is no evidence to support this approach.
As a country, we should care about all of our citizens and work toward bettering them, because we are only as strong as our weakest link. When it concerns the issue of corrections it should not be a discussion of punishment or rehabilitation. Instead, it should be a balance of both that puts the spotlight on rehabilitating offenders that are capable and willing to change their lives for the better. Through rehabilitation a number of issues in the corrections field can be solved from mental health to overcrowding. More importantly, it allows offenders the chance to do and be better once released from prison. This paper analyzes what both rehabilitation and punishment are as well as how they play a part in corrections. It also discusses the current reasons that punishment as the dominant model of corrections is not as effective as rehabilitation. After explaining rehabilitation and punishment, then breaking down the issues with punishment, I will recommend a plan for balance. A plan that will lower incarceration rates and give offenders a second chance.
Our modern society consist of many social problems. However, many Canadians have yet to acknowledge a major issue on our international community today. The problem with prison reentry has been going on for many years in the United States, as I discussed in assignments one and two. Recidivism issues can often be linked with reentry issues because when offenders are returning to society, they need to be prepared, which is something that our current criminal justice system is not trying to achieve. Today we see five prevalent goals of corrections including retribution, incapacitation, deterrence, rehabilitation and restorative justice. Goals employed in corrections change over time depending on several factors including the trends of thought in society and issues within the prison system. Politics as well as prison overcrowding also factor into determining which goal dominates. Retribution has a long-standing history as the most culturally accepted goal because people fended for themselves prior to organized law enforcement (Bartollas, 2002, p. 71). Incapacitation, the dominant goal currently, eliminates the threat by placing the criminal outside society, typically through incarceration, and preventing the criminal from having the ability to commit additional crimes. In the past, governments had enacted laws that cracked down on crime and resulted in large numbers of incarcerations. Because of the cost and upkeep of prison sentencing, states are seeking alternatives to incarceration, such as education and rehabilitation programs. In particular, this revision of the correctional system is primarily referring to low-level first-time offenders.
Namely, all across the nation, state legislatures are facing the challenges, with providing the means of monies to build more prisons that are overly populated. For that reason alone, reinstating re-entry should be restored to save taxpayer’s money along with, containing the construction of unwanted prisons in our residential districts. These efforts also provide ex-offenders with the skills to remain free.
The United States prison population has expanded at an increasingly rapid rate over that past several decades. Each day, more and more criminal offenders are sent to prisons; most of which were designed to house fewer inmates but are now packed to their limits. This “mass- incarceration era” as many scholars and commentators of the Criminal Justice System call it, is a result of several key issues that have created an environment within the correctional system that forces many inmates to serve longer prison sentences while increasing recidivism rates. Current federal and state sentencing policies have resulted in historically high rates of offender recidivism and the highest incarceration rates in the world (Warren, 2007). As a result, prison population and overcrowding has rapidly increased and has become a serious issue across the country however, a reform in sentencing policies, more early-release incentives, and reintegration back into society through rehabilitation will help reduce recidivism and prevent the continuing rise of prison populations. The use of remand custody has been increasing significantly over the last decade. The length of time of an individual being placed in remand on custody is extended due to numerous factors. According to research and findings, the accused who is not being released on conditions is physically and mentally in pain during the period of waiting for the trial. The topic of the increased use of remand custody will be discussed in this essay, focusing on three key themes: describing the process of how individuals are placed on remand, the benefits and obstacles of remand custody, and the affection of this form of custody on criminal justice system as well as offenders. I will argue that the system of criminal justice needs to address the consequences of the shift and they should avoid the drawbacks for the system.

Convicting, sentencing, and imprisoning are just the first few steps of reducing crime. All the effort, time, and money that go into keeping criminals locked up and off the streets are really for nothing in the end if he or she commits the same crime again after release. James Haley, who is the book editor of “Prisons” points out, “Every year, close to six hundred thousand inmates are released from state and federal prisons around the country. According to the Bureau of Justice Statistics, two-thirds of former convicts commit new crimes and one-half are re-incarcerated within three years of being released from prison” (138). Are US prisons truly effective when so many prisoners are committing new crimes upon release? It is for the better interests of American safety that some prisoners are locked up for life, but this should not include the constant return of re-offenders. The life of most convicts involves committing a crime and being sentenced to jail only to repeat the same process again. Many re-offenders see incarceration as a ticket to a place to sleep and food to eat.
