Sending Children To Juveniles

In America we sometimes house juveniles and adults in the same prison system. In the state of Wisconsin in 2014, we have incarcerated 121 minors into the adult system. While incarcerating these juveniles in the prison system some may wonder how does it affect a juvenile, Also what problems do they face while in prison and lastly, how has their life change for better or worse after they are released back into society.

If a ruthless fifteen-year old killed your mother, how would you want the inhumane murderer to be punished? How would you feel if you never got to see your mother alive again while her killer served only a short sentence before being released from jail? Clearly, one would want the worst violent punishment for that murderer to experience. We have to have a system where juveniles, even young juveniles, who commit extremely sophisticated violent criminalities, are not beyond the reach of the law. Truly, children are children. They are reckless and naïve when it comes to their actions, however if one commits a crime, moreover a violent crime, must be punished impartially according to what he/she deserves regardless of the age. Children who commit violent crimes should be held accountable for their actions and tried as adults.

Juveniles should be tried as adults because they only serve a few years in prison for doing harsh things. Manuel Sanchez and John Duncan committed a bloody murder by shooting a man several times in the chest, and John and Manuel were only twelve years old at the time. For example, “ It was a brutal, callous, bloody murder. In today's society, there are many crimes going on. Adults are not the only ones that commit crimes. One issue today is that juvenile offenses and whether juvenile offenders should be tried as adults in criminal court. A common phrase that is often used in this case of young juveniles committing crimes is "Old enough to do the crime, old enough to do the time." This phrase should be cleared to people that juveniles are not adults, and with this being said it will not make them one. "It has redefined juvenile offenses by treating most of them as delinquent acts to be adjudicated within a separate juvenile justice system that is theoretically designed to recognize the special needs and immature status of young people and emphasize rehabilitation over punishment" (Steinberg). While juveniles should be responsible for their actions, and should be held accountable for the crime, then the juvenile justice system is design to determine the consequences. Youths are still minors and are less mature. They often face a lot of negative peer pressure. Therefore, juveniles should not be tried in courts as adults.

Murder is always a devastating sight, juveniles who commit homicides is another story. Sentencing a juvenile to life without parole isn’t the best punishment for a child that is developing in life. Juveniles are full of built up steam and emotions, they aren't comprehensive with the actions they take.

Today, we live in a society faced with many problems, including crime and the fear that it creates. In the modern era, juveniles have become a part of society to be feared, not rehabilitated. The basis of the early juvenile justice system was to rehabilitate and create safe havens for wayward youth. This is not the current philosophy, although the U.S. is one of the few remaining countries to execute juveniles. Presently, our nation is under a presidential administration that strongly advocates the death penalty, including the execution of juveniles. Juveniles need to be held accountable for their crimes, however, they should not be sent to life in prison. With an increasingly growing amount minors being trialed as adults for heinous crimes, people would ask “why would they commit it?” The answer lies within each juvenile's background, mental health, age, immaturity, and morality. Therefore, it is my belief that juveniles should not be trialed as an adult. Juveniles such as Manny, Shawn, Marquese, and José interviewed in PBS’ “Frontline” were involved in gangs, familial neglect and abuse, or drugging.

Although some people believe that juvenile offenders should be treated like adults and take the same treatment as adults. The sentencing of a juvenile offender should not be tried as an adult, children should not be given the same handling as adults do, adults are different from kids. Adults know how to intake all of the effects of being treated the way they get treated in jail. Children are not capable of the pressure of being treated like adults yet, it also puts a lot of pressure on the juvenile and creates mental breakdowns. This is not right nor fair for children to have to be tried as adults, it is not the same punishments that adults get in jail, it’s more of a harsh and cruel system for adults than for the children to be placed in the facility they are in and get treated like they do.

Juveniles are not prepared mentally for adult court. There brains are not fully matured to understand everything about an adult case. In an article about juveniles being tried as adults in criminal court emphasized that juveniles are significantly different from adults(Eberhardt).Juveniles have to finish living their young lives and learn life lessons before they should be tried as adults. Before the justice system tries them as adults, they should be given the proper knowledge about life and things such as the justice system. In another article about juveniles being tried as adults, it spoke about how Americans have accepted that juveniles are different from adults (Okonkwo). Well, if juveniles are different from adults why are the justice systems across America trying them as adults in criminal court. It just doesn't make any sense. Everyday the justice system is takes advantage of juveniles by trying them as adults in criminal court.It is a shame because it is obvious that juveniles are not ready for for an adult court. They are not mature enough, they deserve a chance at learning about every element of the justice system that could possibly affect their lives. For years may people have debated whether or not juveniles should be tried as adults for serious crimes. The juvenile justice system was established in the year 1899(Long). Laws were first created to handle small cases such as truancy, shoplifting, and vandalism (Estudillo). Since 1993, at least 43 states have passed laws making it easier for children to be tried as adults (Estudillo). Juveniles should be tried as adults because by the time they’re about 12 they know that murder is wrong, if they’re grown up enough to kill someone then they’re old enough for adult consequences, and a lot of kids see the juvenile justice system as a way to get away with crime.

I believe that juveniles do deserve to be tried as adults and not be given the leeway of being called just a “teenager”. As a young adult i just turned 18 not too long ago and i can tell you from my own experience and the experience of my close friends that teenagers or anyone from the age of 12-18 does know right from wrong and fully acts upon their own decision and conscious. It would be very disrespectful to anger the victims on letting out the killer. I know that if my family member was murdered by a teenager and 10 years later they let them out, i would be beyond angered with their decision to even give them a second chance.

A juvenile is subject to a more severe sentence with the limited sentencing available. It is estimated that 250,000 youth are prosecuted as adults, each year. This number should change, as juveniles are not adults, both mentally and physically. Juveniles need an environment surrounded with guiding adults, education and the resources to help them. A juvenile is not an adult, and should not be tried as one.

In my own opinion, I consider juveniles as immature because they lack the ability to recognize the long term impact of their actions as they have decreased levels of responsibility. Therefore, the justice system should not charge juveniles in adult legal system and sentence them as adults.Trying juveniles as adults exposes the young offenders to state penitentiaries up to life in prison without parole and even sentenced to death. This raises a question on how truly effective treating juveniles as adults are to the young offenders. I do not think it is a good idea to lock juveniles up in prisons with adults. For a child to set down and plan a murder for instance, there would have to be some kind of deep emotional problem. On the other side of this, if the child knows right from wrong and he can sit down and plan a murder, then you could say if he is old enough to kill someone then he is old enough to die.
