Juvenile delinquency is a social issue in the United States today. Juvenile delinquency, is when “a violation of the law is committed by a juvenile and is not punishable by death or life imprisonment” (Juvenile Delinquency). The juvenile system is different from the adult system in many way and most juvenile delinquents are from the age of ten to the age of seventeen (Juvenile Delinquent). Once the delinquent or anyone is at the age of eighteen, they are considered to be an adult. Therefore, in the justice system they are tried as an adult. Crime is a socially constructed phenomenon. It is not static but dynamic and is defined into existence. It changes over time and place. For example, early definitions of crime such as classicism defined individuals as rational, free and responsible for their own actions. The emergence of positivism was an attempt to bring scientific methodology to criminology. Positivists believe in objectively quantifying cause and effect. In the early twentieth century a sociological lens was applied. Functionalist sociologists such as Durkheim argued that crime had a positive function for society by reinforcing societal norms and values (Ziyanak and Williams 2014). Anomie and strain theory proposed later by Robert Merton examined how poorer classes experienced frustration through lack of opportunities leading to strain. There are many others including labelling, control and cultural deviance, however; this shows that our understanding of criminology is not static and like crime itself it changes over time and place.
The social learning theory states that criminal behavior is learned. Criminals learn their bad behaviors from close relationships they may have with criminal peers (Siegel & Worrall, 2016). Children look up to their parents; they want to be just like them. So, if children grow up surround by crime, they think that it is both normal and acceptable, and it is likely that they will participate in criminal behavior when they are older. As a result of learning this behavior, it is passed down through generations and is never broken. This can also be learned from friendships people may have with negative influences. Young adults and children want to fit in with their peers, so if they are surrounded with those who commit crimes, they are probably going to do the same because “everyone is doing it”.
