Speech is the expression of or the ability to express thoughts and feelings by articulate sounds. The foundation of our country was creating for the sole purpose of speaking out against Britain. Our country’s freedom of speech is a key reason as to why foreigners want to gain citizenship. During the making of our country's Constitution, the founding fathers had to limit what rules would be placed on colonists and Americans later to come. Freedom of speech was on of the first thoughts that went through their heads. Thus, the reason that our “freedom of speech” can not be denied to citizens according to the first amendment. Americans have two options when looking at the Constitution and their rights. Strict constructionists abide by what the Constitution states and deny that changes need be done. Loose constructionists interpret that the Constitution needs to be changed with the time period we are in. Thereby, believing that what is not stated in the Constitution is also subjected to be granted to them. Schenck v. United States was the first real eye opener to government officials. Justices read the case of this man and how he tried to send draftees papers telling them to not fulfill their duty to their country. While Schenck tried to defy the system, he failed. The supreme court ruled in favor of the United States, because his actions were unconstitutional. Schneck violated the Espionage Act of 1917 which states that can not cause insubordination in the military or obstruct recruitment. Society today tried to take their freedom of speech to the extreme. Expressing yourself and what you believe is one thing ,but rioting is on the complete opposite spectrum. American citizens are assembling a large group of people and going to protest at specific places such as college campuses and presidential debates. A cop car was set on fire by a group of college students on a Pennsylvania campus backlashing the authorities because of an unsolved murder. In this case there should be action taken to make these students aware that this kind of backlashing will not be tolerated. U.S. supreme court justices have a difficult job when determining how to indict someone when it comes to their freedom of
